on conformity assessment of simple pressure vessels when they are making available on the
market
The Government directs pursuant to § 4 and § 50 para. 5 of law No. 90/2016 Coll.
conformity assessment of specified products when they are making available on the market (hereinafter
"the Act"):
§ 1
The subject of the edit
(1) this regulation incorporates the relevant provision of the European Union ^ 1) and
regulates the technical requirements relating to simple pressure vessels (hereinafter referred to as
"vessels"), which must comply when placing on the market and/or put into service,
the conditions and procedures for their making available on the market and means of assessment
of conformity.

§ 2
Technical requirements for vessels
(1) basic technical requirements for vessels in respect of which the product of PS. In

§ 3
Making available on the market and putting into service

§ 5
Authorized representative

§ 6
The importer

§ 7

§ 8

bar. L shall be used according to the manufacturer's choice, either of the following procedures:
1. conformity to type based on internal production control and testing of containers
under the supervision of (module C1) set out in point 2 of annex 2 to this
Regulation, or
2. conformity to type based on internal production control (module C)
in point 4 of annex 2 to this regulation.
(3) the records and correspondence relating to conformity assessment procedures
referred to in paragraphs 1 and 2 shall be drawn up in the official language of the Member
State of the European Union, in which the notified body is established or in a language
where the manufacturer to the notified body shall agree with this.
§ 10
Presumption of conformity
If the container is in conformity with harmonised standards or parts thereof,
that the vessels concerned and for which references have been published in the official
Journal of the European Union, it shall be deemed to be in compliance with the essential
technical requirements covered by those standards or parts thereof
apply.
§ 11
EU Declaration of conformity
(1) the EU Declaration of conformity shall state that the fulfilment of has been shown to

(2) the EU Declaration of conformity shall be drawn up in accordance with the model set out in
Annex 4 to this regulation, shall contain the elements specified in the relevant
the modules set out in annex 2 to this regulation and must still be
updated. EU Declaration of conformity shall be translated into the language or languages of the
required by the Member State of the European Union, in which the receptacle is placed or
available on the market.
(3) If the vessel is subject to more harmonisation of the laws of the European
the Union setting out the elaboration of EU Declaration of conformity,
a single EU Declaration of conformity referring to all of these provisions,
including links to their publication. This single EU Declaration of conformity
may take the form of a folder consisting of declarations of conformity issued by the

§ 12
Affixing the CE marking, signs and identification numbers of the notified
subjects
(1) the CE marking, which is placed before placing the container on the market, and
the inscriptions provided for in point 1 of annex 3 to this regulation are placed on the

(c) the identification number of the notified body) were placed in violation of §
12 or not,
d) inscriptions provided for in point 1 of annex 3 to this regulation have not been
located or have been placed in breach of section 12 or section 1 of the annex No. 3
to this regulation,
e) EU Declaration of conformity has not been drawn up,
f) EU Declaration of conformity has not been drawn up in accordance with this

g) technical documentation is missing or incomplete,
h) information referred to in § 4, paragraph 4. 6 or in section 6 (1). 5 is missing or
incorrect or incomplete, or
I) was not fulfilled other administrative requirement referred to in paragraph 4 or in section 6
or in section 6 (1). 1, 5, or 6, or in § 8 para. 1, 3, 6, or 7 of the Act.
§ 14
Transitional provisions
(1) a container that meets the requirements of the regulation of the Government No. 20/2003 Coll. laying
laying down technical requirements for simple pressure vessels, may be
placed on the market and put into service, if placed on the market
before the date of entry into force of this regulation.
(2) valid certificates and other documents that certify the detected

BASIC SAFETY REQUIREMENTS
1. materials
Materials must be selected according to the intended purpose the use of containers and
in accordance with 1.1 to 1.4.
1.1 parts subject to pressure
Materials used for manufacturing the pressurized parts must be:
a) weld,
b) ductile and tough, so that the material at the lowest

1.2. Welding materials
Materials used for containers or for their production shall be
appropriate and compatible with the welded material.
1.3 Accessories that affect the strength of the container
Accessories for containers (for example, bolts or nuts) must be made of
the material provided for in heading 1.1, or from other types of steel, aluminium
or aluminium alloys, which are compatible with the materials used for the
production of parts exposed to pressure.
These materials must be at the lowest permissible temperature for reasonable
elongation after rupture and the impact work when bending impact test.
1.4 with pressure
All parts with pressure vessels that are attached by welding,
must be made of materials compatible with the materials to which they are

use:
I) containers must not be exposed to voltages which could impair their
safety in use, and
(ii)) the internal pressure shall not permanently exceed the maximum allowable pressure PS.

2.1.1 Calculation method
The smallest thickness of the pressurized parts must be calculated in the light of

2.1.2 experimental method

withstand pressure equal to at least five times the highest

The containers must be manufactured and checked in accordance with the requirements of

3.1 Production of components
In the manufacture of components (such as when forming or precipitation
edges) must not be superficial defects, cracks, or changes to mechanical
properties that might affect the safety of the vessels.

Welds and adjacent areas must have similar characteristics as welded
materials and shall be free of surface or internal defects that could
endanger the safety of the vessels. Welds must be executed by qualified
Welders or staff with the appropriate level of competence in accordance with the
approved welding procedures. Approval and qualification tests must
be carried out by the notified bodies.

THE CONFORMITY ASSESSMENT PROCEDURES
1. the EU type-examination (module B)
1.1 EU type examination is the part of a conformity assessment procedure in which
the notified body examines the technical design of the container and verifies and confirms that the
the technical design of the vessel meets the requirements of this regulation, that the

(b)) a written declaration that the same application has not been lodged with any other
the notified body, and
(c)) the technical documentation. Technical documentation shall enable
the conformity of the receptacles with the relevant requirements of this regulation and
contains an adequate analysis and assessment of the risk.
The technical documentation shall specify the applicable requirements and to the extent necessary
for the assessment must cover the design, manufacture and operation of the vessel.
The technical documentation shall contain, where relevant, at least the following
elements:
I) a general description of the vessel,
II) conceptual design and manufacturing drawings and schemes of components, where appropriate,
additional design documentation,
III) descriptions and explanations necessary for the understanding of the drawings,
schemes and the operation of the vessel,
IV) list of the harmonized standards, references to which have been published in the
The official journal of the European Union and which have been applied in full
or in part, and descriptions of the solutions adopted to meet the essential
safety requirements of this regulation, where those harmonised
the standards have not been applied, including a list of other documents that
prescribe the technical requirements to meet the vessel (hereinafter referred to as
"technical specification") that were used. In the case of partially
applied harmonised standards, the technical documentation shall list those
parts which have been applied,
v) results of design calculations made, examinations and inspections,
vi) test reports,
VII) instructions for use and safety information set out in point 2
Annex 3 to this regulation, and
VIII) document that describes:
1. selected materials,
2. the selected welding procedures,
3. the selected controls and
4. any details relating to the construction of the vessel,
d) in appropriate cases, the prototypes of the containers representative of
the planned production. The notified body may request further specimens of the containers,

e) other documents as to the adequacy of the technical design solution.
This supporting evidence shall mention any relevant documents,
that have been applied, in particular where the relevant harmonised standards have not been
applied in full. The supporting evidence shall include, if necessary,
the results of the tests carried out in accordance with other relevant
technical specifications by the appropriate laboratory of the manufacturer, or by another testing
laboratory on his behalf and under his responsibility.
If you review the prototype container, technical documentation must also
include:
I) certificate relating to the suitability of qualification of welding procedures and
Welders or operators of welding machines,
II) document checks for materials used for the manufacture of parts and components
contributing to the strength of the container and
III) report on the examinations and tests or description

1.4. The notified body must:

1.4.1 examine the technical documentation and supporting evidence to

documentation, whether they can safely be used under its intended
working conditions, and identify the elements which have been designed in accordance with the
the applicable provisions of the relevant harmonised standards, as well as
elements which have been designed in accordance with other relevant technical
specifications,
1.4.3. carry out or have carried out appropriate inspections and tests to verify
whether, where the manufacturer has chosen the solutions in the relevant
harmonised standards, these have been applied correctly,
1.4.4. carry out or have carried out appropriate inspections and tests to verify
whether in a case where the solution has been applied according to the relevant
harmonised standards comply with the other relevant
the technical specifications used by the manufacturer, the corresponding basic
safety requirements of this regulation and
1.4.5 agree with the manufacturer, at which point the examinations and tests
performed.
1.5. the notified body shall draw up an evaluation report that records the
the activities carried out in accordance with the requirements set out in point 1.4 and their
the results. Without prejudice to the obligations of the notified body to the authority
for standards, metrology and testing (hereinafter referred to as

1.6. Where the type meets the requirements of this regulation, the notified body shall issue a
the EU type-examination certificate to the manufacturer. The certificate must contain
name and address of the manufacturer, conclusions of the examination, conditions for its validity
certificate and the particulars necessary to identify the approved type. To
the EU type-examination certificate may be accompanied by 1 or more of the annexes.
The EU type-examination certificate and its annexes shall contain all
