GOVERNMENT REGULATION



of 30 March 2004. March 2016



on conformity assessment scales means their activities, making available on the

market



The Government directs pursuant to § 4 and § 50 para. 5 of law No. 90/2016 Coll.

conformity assessment of specified products when they are making available on the market (hereinafter

"the Act"):



§ 1



The subject of the edit



(1) this regulation incorporates the relevant provision of the European Union ^ 1) and

regulates the technical requirements for the balance with a package of activities that

must comply when placing on the market, the conditions and procedures for their

making available on the market and the conformity assessment methods.



(2) for the purposes of this regulation, the distinction between these categories of instrument use

and for the purposes of determining weight) of trade,



b) determination of mass to calculate fees, tariffs, taxes, premiums,

fines, compensation, indemnity or similar type payments,



(c)) determination of mass in the application of laws or the

expert opinions in judicial proceedings,



d) determination of mass in medicine for weighing patients for the purposes of

monitoring, diagnosis and medical treatment,



e) determination of mass for making up medicines on prescription in a pharmacy

and determination of mass in analyses carried out in medical and

pharmaceutical laboratories,



f) pricing based on the weight, for the purposes of direct sales

the public and the preparation of prepackaged and



g) all other uses than those listed in points (a)) to

(f)).



§ 2



Definition of terms



In this regulation means

§ 3



Technical requirements for balance with a package of activities



(1) balance with a package of activities used or intended for use

meet the essential requirements laid down in annex 1 to this regulation.



(2) if the means of activities include weight equipment or are

associated with devices that are not being used or intended for use

referred to in § 1 (1). 2 (a). a) to (f)), these essential requirements are to

§ 4



Making available on the market and putting into service



(1) balance with a package of activities can be supplied on the market only if

the requirements of this regulation are met.



(2) the selected weights can be placed in service only if they are satisfied

maintained in accordance with the requirements of this regulation.



§ 5



The manufacturer of the



(1) when placing on the market of weights selected manufacturer shall ensure that these weights

have been designed and manufactured in accordance with § 3 (1). 1, shall establish the technical

documentation set out in annex 2 to this regulation and shall

have carried out one of the conformity assessment procedures provided for in paragraph 10.



(2) if the compliance of the instruments with the appropriate requirements of selected competent

the conformity assessment procedure referred to in article 10 shown, the manufacturer shall draw up a

EU Declaration of conformity and affix the CE marking to the selected scale and complementary

Metrology marking.



(3) the manufacturer shall keep the technical documentation and the EU Declaration of conformity

§ 6



Authorized representative



Authorized representative shall keep the EU Declaration of conformity and the technical

documentation for the requirements of a supervisory authority for a period of 10 years after the selected

weighing on the market.



§ 7



The importer



(1) before putting weights on the market activity means the importer shall ensure that the

§ 8



Distributor

§ 9

The conformity assessment procedures

(2) the EU type-examination (module B) is not required for selected instruments

which are not applied to electronic devices and in which the measuring unit

§ 11



Presumption of conformity

§ 12



EU Declaration of conformity

relevant modules set out in annex 2 to this regulation and shall

(1) the CE marking and supplementary metrology marking shall be placed on the selected

weights or on their plate before placing them on the market.



(2) the supplementary metrology marking consists of the capital letter "M" and the last

two digits of the year in which it was located, bounded by the rectangle whose

height is equal to the height of the CE marking. The supplementary metrology marking

immediately follows the "CE" marking. The General principles of the CE marking apply to

the supplementary metrology marking accordingly.



(3) the CE marking and supplementary metrology marking followed by a

§ 14



Formal defects



A formal deficiency is considered when



and) the CE marking or the supplementary metrology marking is placed in the

§ 15



Transitional provisions
