Treaty between the Czechoslovak Socialist Republic and the Swiss

Confederation concerning the protection of data of origin, designation of origin and other

geographical indications



Day 16. November 1973 in Bern was signed between

The Czechoslovak Socialist Republic and the Swiss Confederation on the

the protection of data of origin, designation of origin and other geographical indications.



With the Treaty expressed their consent the Federal Assembly of the Czechoslovak

Socialist Republic and the president of the Republic has ratified it.

The instruments of ratification were exchanged in Prague on 14. October 1975.



According to article 11 of the Agreement entered into force on 14. January 1976.



The Czech version of the Treaty shall be designated at the same time.

between the Czechoslovak Socialist Republic and the Swiss Confederation

on the protection of data of origin, designation of origin and other geographical indications

in an effort to consolidate and expand mutual relations in the field of industrial

ownership,



taking into account the interest of both Contracting States to effectively protect against unfair

competition of natural and industrial products, as well as information about the origin, including

designations of origin and other geographical indications, which shall reserve the

certain products or goods,



have agreed to conclude a treaty for this purpose and name its designee:

Article 1



Each of the Contracting States undertakes to take all necessary measures to

1. a natural or industrial products originating in the territory of the other

Contracting State against unfair competition in the course of trade and



2. the names, descriptions and illustrations referred to in articles 2, 3 and 5, paragraph

2, as well as the indications referred to in annexes A and B of this Treaty, in accordance with

the provisions of this Treaty and the Protocol to this Treaty.



Article 2



(1) the names of the "Czechoslovak Socialist Republic", "the Czech

Socialist Republic "," the Slovak Socialist Republic, "marking

"Czechoslovakia" and the historical names of individual countries in the Czechoslovak

Socialist Republic, as well as the marking referred to in Annex A to this

the contract shall be reserved exclusively to the territory of the Swiss Confederation

Czechoslovak products or goods and may there use only

the same conditions as those laid down by the Czechoslovak legislation, if

Article 3

Article 4

Article 5

Article 6



Claims arising from the violation of the provisions of this Treaty may, before the courts

the Contracting States to apply, in addition to natural and legal persons, and

companies that are authorised to do so under the legislation of the Contracting

States, whether or not the unions and associations that directly or indirectly represent

the participating manufacturer, contractor, traders or consumers and have

its registered office in one of the Contracting States in accordance with the legislation

an action in civil disputes. Under these assumptions may

Article 7

Article 8

Article 9

Article 11

documents and remain in force for an unlimited period of time.

in a period of one year.

Desiring to modify the use of certain legislation closer to the Treaty of

1. The provisions of this Treaty shall not apply to the labelling of animal breeds.
