on the rules of the gas market



The Energy Regulatory Office shall determine under section 98a of paragraph 1. 2 (a). I) Act

No. 458/2000 Coll., on conditions for business and the public administration in

energy sectors and on the amendment of certain laws (Energy Act),

as amended by law no 131/2015:



PART THE FIRST



INTRODUCTORY PROVISIONS



§ 1



The subject of the edit

§ 2



The basic concepts



(1) For the purposes of this Ordinance means

§ 3



Gas market



(1) in the framework of the gas market are all the time data recorded in the time

valid on the territory of the Czech Republic.



(2) gas market shall be carried out with the use of numeric codes and dials

managed by the market operator. The numeric codes are used to indicate

offtake points customers to transfer jobs to cross-border gas pipelines,

points of production of gas, transfer seats, or a summary of transfer points between

transmission and distribution networks, the transfer of posts between the distribution

networks, transfer points between the reservoir and the transport system and the

participants in the gas market, with the exception of customers.



(3) the place of consumption of the customer, item, production plants and a gas pass-through space

cross-border gas pipeline are assigned only to the distribution network or

the transmission system in the place of connection.



(4) the transmission system operator, the distribution system operator

and operator of the storage tank shall be considered as customers in the range of losses

and private consumption.



(5) the distribution system operator, which is divided into multiple

distribution networks, is considered one of the customer with multiple virtual

sampling points representing the loss or Unassigned subscription

distribution system operator in each of the distribution network.



(6) the quantity of gas at the outlet of the gas distribution network for the day

equal to the quantity of gas at the entry to the distribution network and the change of accumulation in the

the distribution network.



§ 4



Points of the gas system



(1) entry points to the gas system are the border points, points

virtual gas storage, gas works, points a pass-through space

cross-border gas pipelines and virtual points transmission

the system.



(2) the exit points of the gas system are the border points, points

virtual gas storage, sampling the place customers, pass-through space

cross-border gas pipelines, virtual sampling locations representing the loss

§ 5



Designation of participants in the gas market, transfer points and offtake points



(1) the market operator records the registered market participants with spinners

TRANSPORT OF GAS



§ 6



The participants in the transport

instead of the customer's directly connected to the transmission system.



(3) transport of gas distribution system operator arranges for

§ 8



Conclusion of a contract for the provision of transport services



(1) the application for conclusion of a contract for the provision of transport services of gas is

served by the subject of settlement or a foreign participant at the latest 10

working days 10:00:00 pm prior to the shipment on or before

reservation of transport capacity or before the auction on the auction

booking platform.



(2) the transmission system operator shall evaluate the application for conclusion of a contract

for the provision of transport services referred to in paragraph 1 and in the case of

the positive evaluation of the proposal sends a contracts for the provision of transport services

gas to the conclusion of the contract until 16:00:00 p.m. 5th working

the date of submission of the application.



(3) an applicant for the conclusion of contracts for the provision of transport services of gas

adopt the draft Treaty on the provision of transport services referred to in paragraph

2, so that a contract for the provision of transport services has been closed

no later than two business days by 12:00:00 pm prior to the

transport or transport before booking or before the auction on the auction

booking platform.



§ 9



Types of transport capacity on the individual input and output points

the transmission system



(1) on the basis of a contract for the provision of transport service allows you to

mode on the following day and intra-day transmission capacity.

transport capacity in the mode on the following day and intra-day transmission

capacity.



(3) on the basis of a contract for the provision of transport service allows you to

the participant for the border point of the annual standard capacity reservation,

Quarterly, monthly capacity standard capacity, daily

standard capacity, intraday capacity. Transport

through the information system of the transmission system operator.



Procedures and terms for booking capacities for points of virtual stack

gas and gas generating stations for points



§ 10



(1) the transport of gas when booking the monthly transport capacity is initiated

the first natural gas on the day of the calendar month to which the transport

reserved capacity.



(2) the clearing or foreign participant can reserve

the transmission capacity from other gas month, than natural gas

the month immediately following the month in which the reservation

monthly transportation capacity, however, asks the first 24 calendar months

before the shipment starts.



(3) the monthly capacity reserves on one or more

the following gas for months.



(4) the monthly shipping capacity for the virtual gas storage points can be

§ 11



(1) the transport of gas when booking daily transport capacity is initiated

(2) the clearing or foreign participant can reserve

the transmission capacity from other gas day, than is natural gas

the day immediately following the day on which the gas on

(3) the daily transport capacity is reserved for one or more consecutive

the following gas days.



(4) Daily transportation capacity it is possible to book for a maximum of 31

gas days of the date of the request on the booking day or

interruptible transportation capacity.



§ 12



(1) the transport of gas in the reserve capacity in the mode of the following day

§ 14

§ 15



(1) the request for the reservation of transport capacity under sections 10 and 11 shall

§ 17



(1) the request for the reservation of transport capacity according to § 13 serves the body

Procedures and terms for booking capacities for border points



section 18



(1) on the border points can be booked only standard products

§ 19

supplier of gas in the event that the customer has entered into a contract for the

associated gas supply services, and, in the cases referred to in § 110, paragraph. 1

and § 113 paragraph. 5, on the dates under section 110, paragraph. 3 or § 113 paragraph. 5.



(2) the transmission system operator shall notify the participant of the gas market of the

options for booking transport capacity in term according to § 111 paragraph. 1.

§ 84



The delivery of two or more suppliers of gas to one delivery point



(1) the customer may have one or more of the contracting of suppliers of gas.

§ 85



Financial payment settlement entities

(2) if the entity does not have sufficient financial settlement payment for

PART SEVEN



SHORT-TERM MARKET



§ 86



The short-term market, its organization and its settlement



(1) the market operator organizes short-term market in the form of intraday market

with gas and unused flexibility.



(2) short-term market can participate in the accounting entity only.



(3) the Shops on short-term market referred to in paragraph 1 are to each

anonymous.



§ 87



Intraday gas market



(1) intra-day market is organized within the gas day and can be

to enter and receive bids for the supply of gas for the basic subscription or

point. As a result of trades on the intraday market is the destination of the agreed

supplies, subscriptions and gas prices.

disagreement with the results of the daily market evaluation of the derogations referred to in § 102

paragraph. 6, the market operator shall notify the individual subjects of settlement new

16:00:00 hours the same day.



(3) the market operator shall notify the results of market with unused flexibility

§ 91

§ 93



The procedures for establishing the unit price for the daily amount of compensation



(1) the unit price for a positive amount in the buffer of the day

gas day shall be determined under the procedure referred to in annex 10 to this

the Decree.



(2) the unit price for the negative amount in the buffer of the day

gas day shall be determined under the procedure referred to in annex 10 to this

the Decree.



(3) For the unit prices referred to in paragraphs 1 and 2 shall in case of need

their transfer to the CZK/MWh rate uses the Czech vyhlašovaný

§ 94



Account of neutrality



(1) the market operator records the account of neutrality as a separate revenue and

locations of customers with the measurement of type C or CM



§ 99



(1) Type supply diagrams are used as a replacement method

gas sampling in collecting customer locations with the measurement of type C or CM.



(2) the Operator of the market based on the data provided by the operators of the

distribution system supplies the diagrams normalized type valid for

the whole gas system for each class of load profiles

delivery and throughout the calendar year.

(4) the distribution system operator assigns individual class

§ 100



(1) the planned annual gas consumption in the sampling locations of customers with

the measurement of type C or CM establishes the distribution system operator

§ 101



Evaluation subscriptions using the replacement values for measurement type (B)

established in accordance with annex 6 to this Ordinance for gas a month,

(5) for the relevant calendar month are charged the differences referred to in paragraph 4

§ 105

(5) Settlement referred to in paragraph 4 shall give the operator the market no later than

16th calendar day until 17:00:00 pm four calendar months after the

the calendar month to which the settlement referred to in paragraph 4 applies. At the same time

shall make available to the market operator in the information system of settlement, bodies

where appropriate, other entities entitled to settlement to familiarize yourself with the following

data, the settlement referred to in paragraph 4 in the Division after each

gas days.



(6) the financial settlement of the differences referred to in paragraphs 2 to 5 are performed by the operator

the market.



§ 107



The use of the load profiles of gas supply for the purposes of billing for supplies

gas



(1) the consumption of gas and its distribution in each period shall be determined

in accordance with annex 18 to this Decree, taking into account the

readings made by the distribution system operator and samoodečty

of the customer.



(2) in the case of unavailability of the data recorded by the measuring device for

the period laid down by the other law, which regulates the measurement

plynu15), the distribution system operator shall apply for the establishment of

consumption of the customer with the measurement of type C or CM readings made by

distribution system operator and duly adopted samoodečty this

the customer or the supplier of gas from the last statement of the gas supply.

the distribution system in accordance with annex 18 paragraph 2 to this

Track prices of related services in the gas industry



Prices for related service in the gas industry are the price of transport services

gas, the price of the service and the price for distribution system operator's activities

the market. The composition of the price of transport of gas, the price of distribution service

system and the prices for market operator's activities is provided in annex No. 19

to this Decree.



section 109



The procedure for the determination of advance payments



(1) a trader with gas or producer gas provides for advance payments

no more than the planned annual gas consumption in the sampling site

the customer with the measurement of type C or CM in accordance with Annex 15 to this

the Decree.



(2) a trader with gas or producer gas provides for advance payments

maximum in the range of contracted gas consumption in the sampling site

the customer with the measurement of type A or B.



PART TEN



CHANGE GAS SUPPLIER



Standard change gas supplier



section 110



(1) the standard by changing the gas supplier gas market participant is

supplier of gas to the market operator. In the event that a new supplier of gas

ensures delivery according to the contract of associated gas supply services

makes a request for the reservation of the distribution capacity pursuant to section 39 at the latest in

the date of filing of the application for a standard change gas supplier and the first 10

working days prior to the application of a standard change of the supplier

gas. The application for a standard change gas supplier must contain

the following data:



and the identification of new gas supplier) in the form of the code assigned according to §

(b)) the type of contract for the supply of gas and the date from which the shipment of gas

take place, and the duration of the contract,



(c) identification of the body in the form of showdown) code assigned according to § 5

(4) every working day at the latest 12:00:00 hours, if the request was

referred to in paragraph 3 taken in 10:00:00 of the working day,

the operator shall inform the market through its information system

the existing gas supplier, the existing body of reckoning, the new

gas supplier, new body clearing, operator of the distribution

or the transmission system, which is the place of consumption, and other connected

the bodies concerned, to which the request for change of the supplier concerned, standard

(4) within 14:00:00 a.m. on the eighth working day following the submission of information in accordance with

§ 110, paragraph. 4 can a new supplier of gas through the information

the request referred to in section 111, paragraph. 3, the operator shall inform the market through

the information system of the new gas supplier, all interested entities

(3) If the existing gas supplier asked to stop standard

change gas supplier according to § 111 paragraph. 3, but a new supplier of gas

on the basis of the written submissions of the customer, from which it is clear that

related services in the gas industry and the procedure for the determination of the imprest

the payments, which shall apply from the 1. January 2016.



(2) in accordance with Decree No. 365/2009 Coll., as amended effective prior to the date

the effectiveness of this Ordinance, is to assess all end

processes, deadlines and time for change of the supplier of the gas, which started to run

before the 1. January 2016, even if the change of supplier will be terminated after 1.

January 2016.



(3) an estimate of the gas consumption to the effective date of the change of the supplier of the gas referred to in

§ 113 paragraph. 3, in the period up to 30. June 2016 shall make the procedure referred to in

Decree No. 365/2009 Coll., as amended, effective the day of the entry into force of this

the Decree.



(4) the initial state of the balance of the account of deviations of each body's clearing

or a foreign participant is equal to zero.



(5) the effective date of this Ordinance is the initial account size
