On technical requirements for equipment for the transportation of persons

Government directs pursuant to § 22 Act no. 22/1997 Coll., On technical
requirements for products and amending and supplementing certain acts, as amended
Act no. 71/2000 Coll. and Act no. 102/2001 Coll. (Hereinafter the "Act")
implementation of § 11 para. 2, § 12 para. 1 and 4 and § 13 para. 2, 4 and 8 of the Act:

§ 1

(1) This regulation is in accordance with European Community law ^ 1) and
with an international treaty by which the Czech Republic is bound ^ 2)
which was published in the Collection of Laws or Collection of International Treaties
down technical requirements for certain equipment for the transportation of persons.

(2) Devices for the transport of persons for the purposes of this Regulation
system set up at a designated place, consisting of infrastructure and
subsystems listed in Annex no. 1 hereto
consisting of multiple elements, designed, manufactured, assembled and put into operation for the purpose
transport of persons ( "the facility").

(3) The equipment for the purposes of this Regulation shall be

A) funicular railways and other installations with vehicles mounted on wheels or
curtains and traction is provided by one or more cables,

B) Gondola lift, vehicles mounted and towed
one or more cables; this category also includes gondolas and chair
track

C) drag lifts, where users with appropriate equipment are dragged
rope.

(4) Infrastructure is specially designed for each installation and constructed
at the site and formed the leadership of trails, construction of stations and track
structures needed for the operation of the facility, including the foundations.

(5) security feature of every element or group of elements or devices

function, which is determined in the safety analysis as defined in Annex no. 3 to
this Regulation, if its failure would threaten the safety or health

(6) This regulation does not apply to

A) cable-operated tramways,

B) cable conveyors for agricultural purposes,

C) or mobile entertainment device similar to the cableway,

D) lifts under special legislation, 3)

E) mining installations or installations used for industrial purposes,

F) cable-operated ferries,

G) cog railway,

H) chain conveyors.

(7) As the supplier of equipment for the purposes of this Regulation shall be his
manufacturer or importer. ^ 4)

§ 2

(1) Before the safety features on the market provided by the supplier
conformity assessment (§ 12 para. 4 of the Act), any of the following
of their choice

A) type examination in accordance with Part I of Annex no. 4 to this Regulation

B) quality assurance of production under Part II of Annex no. 4 to this
regulation

C) product verification in accordance with Part III of Annex no. 4 to this Regulation

D) verification unit pursuant to Part IV of Annex no. 4 to this Regulation

E) a comprehensive quality assurance in accordance with Part V of Annex no. 4 to
hereto.

(2) The Contractor ensures the conformity assessment in accordance with paragraph 1, even if that
safety feature intended for his own use.

§ 3

(1) Before the subsystems on the market provided by the supplier conformity assessment
(§ 12 para. 4 of the Act) examination in accordance with Annex no. 5 to this Regulation
.

(2) Checks for each sub-system is done

A) upon completion of its production,

B) upon completion of its installation and completion of acceptance tests.

(3) The Contractor ensures the conformity assessment in accordance with paragraph 1, even if that
sub-systems are intended for his own use.

§ 4

(1) documentation of the method of conformity assessment pursuant to § 13 para. 8 of the Act shall include


A) the technical documentation referred to in the various annexes to this regulation
regardless of whether structural or other documents prepared
person other than the supplier

B) documents and findings issued in conformity assessment authorized person

C) instructions for use of the equipment according to Annex no. 2 hereto.

(2) The Contractor shall submit documents to the supervisory authority pursuant to paragraph 1

(3) Supervision over whether to subsystems and safety components placed on the market
was issued a declaration of conformity and, in the case of security features

equipment referred to in § 1 par. 3 point. c) the Czech Trade Inspection. ^ 6)

§ 5

(1) Statement of compliance security elements according to § 13 para. 2 of the Act
will be conducted in the Czech language and contains the following elements:

A) the identity of the producer or importer declaration of conformity
issues, (name and surname, residence, place of business and identification number
natural person or business name, address and identification number of a legal
persons)

B) a description of the security element (such as name, type, batch, serial
number, year of manufacture)

C) a list of technical regulations and harmonized technical standards
used in conformity assessment, which must meet the element, and the conditions for its use
,

D) details of the conformity assessment procedures,

E) data on authorized person (company name, registered office, identification
number of authorized person) and the registration number and date of certificate
examination, or with details about the duration and conditions of validity
certificate | ||
F) supplier confirmation that the characteristics of the security element
meet the basic requirements, or other technical requirements
regulations and that the safety component under conditions of normal or intended use
supplier of safe

G) the date and place of issue of the declaration of conformity, the name and position of the responsible
person authorized to sign on behalf of the supplier and his signature.

(2) Statement of compliance subsystems according to § 13 para. 2 of the Act
drawn up in the Czech language and contains the following elements:

A) the identity of the supplier of the declaration of conformity is issued,
(name, residence, place of business and identification number
natural person or business name, address and identification number
legal persons) ,

B) a description of the subsystem (such as name, type, batch number, serial number,
mounting location, year of installation, purpose)

C) a list of technical regulations and harmonized technical standards
used in conformity assessment, which must meet the sub-system, and
particular conditions of use

D) if the conformity assessment involved an authorized person, information about this
person (company name, address, identification number of the authorized person) and
number and the date of the award, a reference to the type examination certificate || | issued by an authorized person

E) confirmation of the supplier that the subsystems meet the essential
requirements, or the requirements of other technical regulations that
sub-systems are under common conditions, or the manufacturer of the intended use
safe

F) the date and place of issue of the declaration of conformity, name and position of the person responsible
contractor and his signature.

§ 6

(1) Security elements that have their origin in the Czech Republic or
Member States of the European Communities and meet the requirements of this regulation
must be supplied with CE marking and the corresponding declaration of conformity
.

(2) Safety components which do not originate in the Member States of the European Communities
must be tested and supplier after the issue
declaration of conformity in accordance with this Regulation, they placed the CE mark according
special law. ^ 7)

(3) The CE marking must be affixed clearly and legibly on
security element, or if this is not possible, a label inseparably
affixed to the safety element.

(4) The minimum requirements that must be taken into account in the authorization
activities in conformity assessment of subsystems and safety components
according to § 11 para. 2 of the Act are set out in Annex no. 6 to this
regulation.

§ 7

(1) sub-systems, security features and infrastructure must be in
compliance with the essential requirements of Annex no. 2 hereto.

(2) If the essential requirements for sub-systems, safety components and infrastructure

(3) For each planned equipment manufacturer will analyze the security
according to Annex no. 3 to this Order, which includes all
safety aspects of the system and its surroundings in the context of the design, implementation and
commissioning operation and that the experience gained
it allows you to identify all the risks that may occur during operation
.

(4) Issuance or demonstration devices, sub-systems and safety features
fairs and exhibitions is not considered their
marketing, 3) if they bear an indication that fulfill
the basic requirements of this regulation, they are not intended for sale, and if
appropriate measures are taken to prevent danger to persons.

§ 8

In the case of the Czech Republic into the European Union before May 3
2004 ^ 9) will be put into operation, as well as subsystems and
safety features on the market made up by 3 May 2004
existing legislation.

§ 9

This Regulation shall enter into force on the date of entry into force of the treaty

Příl.2 Basic requirements


First range

This Annex sets out the basic requirements for equipment, including requirements
service and operating requirements applicable to the design, construction
and commissioning.

Second General requirements

2nd and safety of persons

The safety of users, operating personnel and third parties is a fundamental requirement
for the design, construction and operation.


2.b Safety Rules
All equipment must be designed, operated and maintained by
following principles that should be used to

Subsystems and all its safety components must be dimensioned,

2.e Assembly


2.ea subsystems and all the safety components must be designed and constructed
so that they can be safely assembled and installed.

2.eb safety components must be designed so that mistakes impossible
mounting either the result of construction or appropriate markings on the
elements.

2.f Operating fitness facility

2.fa safety components must be designed, constructed and used
so that in each case, their own operational capability
and that the security of the installation is ensured, as stipulated in the analysis
safety Annex no. 3, so that their failure is highly improbable
fit and adequate security.

2.fb Equipment must be designed and constructed so that when
operation ensures that any failure of a component which might affect safety
, perhaps indirectly, was detected in a timely manner appropriate measure.

2.FC Safeguard measures referred to in points 2.fa and 2.fb must be used throughout
period between two scheduled inspections of the relevant elements.
Time period for the scheduled inspection of safety components must be clearly
specified in the instructions.

2.fd Safety components which are incorporated into installations as
spare parts must satisfy the essential requirements of this Regulation and
conditions for a smooth interaction with the other parts of the installations.

2.fe must take measures to fire in the installation do not endanger the safety of persons being transported

2.ff must take special measures to protect installations and persons from the effects of lightning

@ 2 Safety equipment

2.ga Any defect in the device that could cause a malfunction
endangering safety must, where practicable, be detected, reported and processed

Equipment must be designed and constructed so that any internal or external
emission of harmful gases, noise emissions or vibrations falls within the prescribed limits

Third Infrastructure requirements

3.a equipment must be designed so that it can be operated safely
given the characteristics of the terrain and its surroundings, atmospheric and meteorological conditions

under all operating conditions.

3.bb entry and exit areas must be designed to ensure the safety

4.bc Brakes

4.d The communication device

Operating personnel must be able to use appropriate equipment allowing

Fifth Vehicles and towing devices

5.a Vehicles and towing devices must be designed and equipped so as
foreseeable operating conditions no person can fall out or be otherwise compromised
.

5.b fittings of vehicles and towing devices to the rope must be designed and implemented

falling vehicle.

5.g Funicular vehicles and, when ordering facility allows

6th Equipment for user

Children and persons with reduced mobility must be
able to safely use the equipment if the equipment is designed for
transport of such persons.

7th Operation requirements


7th and Security
7.aa must be taken all the technical provisions and measures to
equipment used for its intended purpose according to its technical specifications and
specified operating conditions and in order to meet
instructions on safe operation and maintenance.

7.ab persons responsible for operating the installation must be provided with the appropriate
material resources and must be qualified to carry out tasks.

7.b Safety equipment during operation

Must be taken all the technical provisions and measures to
ensure that users can be brought to safety within a set time
appropriate type of facility and its surroundings when the machine stops and can not be
quickly again to resume operations.

7.c Other special precautions

7.ca Operator

Movable parts which are normally accessible in the stations must be
designed, constructed and installed in such a way as to preclude any danger

7.cb Fall Hazards
Workplaces and working areas, including those used

8th Instructions for using the device

Device must be accompanied by instructions drawn up so that

A) mounting

B) connection

C) adjusting,

D) operation,

E) evacuation of people

F) maintenance

G) test
can be carried out correctly and without risk to the people involved.

Security Analysis
Safety analysis required for each facility according to § 7 para. 3
this regulation must take into account every mode of operation envisaged.
Safety analysis must follow a recognized or established method and
must take into account the current state of the art and the complexity of
devices. The purpose of the safety analysis is also to ensure that the design and installation
take into account the surroundings and the most adverse situations,
to ensure satisfactory safety conditions.

First They are eligible to respond to emerging malfunction or failure detected,
so as to remain either in a state that ensures the safety or condition
hedge against failure

Second They are redundant and monitored, or

Third are such that the probability of their failure can be evaluated and
showed normal condition, which is equivalent

Conformity assessment of safety components

I.


EC TYPE-EXAMINATION
First This is a procedure where the authorized person verifies and certifies that
sample of the production envisaged meets the provisions of this Regulation.

Second The manufacturer or importer established within the European Communities (hereinafter
"Community") is obliged to submit the authorized person, which he
The application for EC type examination.

The application must include

) The name and address of the manufacturer and, if the request presented by the importer, his
name and address

B) a written declaration that the same application has not been submitted to another

Authorized person

C) the technical documentation pursuant to Section 3
applicant is required to give the authorized person a sample intended
production, hereinafter called "type". The authorized person may request further samples
if it is necessary to carry out the test program.

Third Technical documentation must enable assessment of conformity with the requirements
element of this Regulation. It shall, to the extent necessary for such assessment
cover the design, manufacture and operation of the element.

The documentation must contain, if it is important for the assessment

A) a general description of the type

B) conceptual design and manufacturing drawings and diagrams of components, assembly parts,
circuits, etc.,

C) descriptions and explanations necessary for understanding these drawings and diagrams and the operation
product

D) list of technical regulations which were wholly or in part, and
descriptions of the solutions adopted to meet the essential requirements if the
regulated by technical regulations

E) results of design calculations, tests, etc.,

F) test.
Must also indicate the field of application components.

Fourth The authorized person shall

4th and examine the technical documentation, verify that the type has been manufactured in
conformity with the technical documentation, and identify the elements which have been
designed in accordance with the relevant provisions of the technical regulations, as well as
elements which have been designed without applying the relevant provisions
technical regulations

4.b perform or have performed appropriate examinations and necessary tests
to determine whether where they were used in technical regulations, meet
solutions adopted by the manufacturer of the basic requirements of this regulation

4.c perform or have performed appropriate examinations and necessary tests
to ascertain whether, where the manufacturer has chosen to apply the relevant
technical regulations, these have actually been applied

4.d agree with the applicant the location where they carry out these checks and tests necessary
.

Fifth It corresponds to the type of provisions of this Regulation, an authorized person
obliged to issue a certificate to the applicant of the EC-type examination.
The certificate must state the name and address of the manufacturer, conclusions
examination, conditions for its validity, its duration and the necessary data for identification of the approved type
.

This certificate must be accompanied by a list of the relevant parts
technical documentation and a copy kept by an authorized person.
Refusal of an authorized person shall issue a certificate to the manufacturer
EC type examination is required to detail the reasons.
Must be set for an appeals procedure.

6th The applicant is obliged to inform the authorized person, who has
available technical documentation relating to the EC type-examination
of all modifications to the approved component which must be re-approved
where such changes may affect the conformity of the
essential requirements or the prescribed conditions for its use.
This additional approval is given in form of an addition to the original
certificate of EC type examination.

7th Each authorized person is obliged to inform the other authorized persons
relevant information concerning the certificates of EC type examination
and additions issued and withdrawn.

8th Other authorized persons may obtain copies of certificates
EC type examination and addenda. The annexes to the certificates must be kept
available to other authorized persons.

9th The manufacturer or importer is required along with the technical documentation
copies of the certificate of EC type examination and their additions
at least 30 years after the last element.

Unless the manufacturer is based in the Czech Republic, the obligation to keep the technical documentation available
seems importer who places the component on the market

II.


PRODUCTION QUALITY ASSURANCE
First This is the procedure whereby the manufacturer who satisfies the obligations of Section 2
ensures and declares that the elements are in conformity with the type
described in the EC type examination certificate and satisfy the requirements of this regulation
. The manufacturer or importer must affix the marking element
compliance and issue a written declaration of conformity. Conformity marking
must be accompanied by the identification number of the authorized persons responsible for supervision under Section 4


Second The manufacturer shall operate an approved quality system for production,

Final inspection and testing of elements in point 3 and subject them to supervision under Section 4


Third Quality system.

3.a manufacturer must submit an authorized person, which he
choice for the assessment of the quality system for the constituents.

The application must include

A) all relevant information on the proposed category element

B) documentation

C) the technical documentation of the approved type and a copy
certificates for EC type examination.

3.b quality system must ensure compliance with the type described in
certificate of EC type examination and the requirements of this Regulation.

All the elements, requirements and provisions adopted by the manufacturer must be
systematic and orderly documented in the form of written policies, procedures and instructions
. The quality system documentation must permit a consistent interpretation
quality programs, plans, manuals and records
quality.

Shall contain in particular an adequate description

) The quality objectives and the organizational structure, responsibilities and powers
guidance regarding the appropriate quality

B) techniques, processes and systematic actions that will be used
manufacturing, quality control and assurance,

C) the means of monitoring the achievement of the required quality
elements and the effective operation of the quality system.

3.c authorized person shall assess the quality system to
determine whether it satisfies the requirements of point 3.b. Compliance with these requirements
anticipated for quality systems, which have been used
relevant harmonized standards.

Least one member of the group of auditors must have experience of assessments of the technology concerned
element. The assessment procedure must include an inspection
visit the manufacturer's premises.

The decision must be notified to the manufacturer. The notification must contain the conclusions
examination and the reasoned assessment decision.

3.d manufacturer must undertake to fulfill the obligations arising
out of the approved quality system and will be adhered to, so that it remains adequate and efficient
.

Manufacturer or importer is obliged to inform the authorized person who
approved the quality system of any intended updating of the quality system
.

Authorized person shall assess the proposed changes and decide whether
changed quality system will still satisfy the requirements referred to in point 3.b,
or whether a reassessment is required.

Authorized person shall notify the manufacturer of its decision.
Notification must contain the conclusions of the examination and the reasoned assessment decision.

Fourth Surveillance under the responsibility of the authorized person

4th and purpose of surveillance is to ensure that the manufacturer duly fulfills the obligations
arising from the approved quality system.

4.b manufacturer shall allow the authorized person for the purpose of inspection
access to the manufacture, inspection, testing and storage, and
provide it with all necessary information, in particular

First the quality system documentation,

Second the quality records, eg. the inspection and test
calibration data, reports on the qualifications of the personnel concerned, etc.

4.c authorized person shall carry out periodic audits to make
sure that the manufacturer maintains and applies the quality system and pass
manufacturer with audit reports.

4.d In addition, the authorized person to carry out unannounced visits to the manufacturer
. During such visits, the authorized
person may carry or have carried out tests to verify
that the quality system is functioning correctly. The authorized person shall
provide the manufacturer with an inspection report and, if a test has
test report.

Fifth The manufacturer shall keep the national authorities after
at least 30 years after the last element

A) the documentation referred to in point 3.a,

B) an update of the second paragraph of point 3.d,

C) the decisions and reports from the authorized person under paragraphs 3.d, 4.ca 4.d.

6th Each authorized person is obliged to provide other authorized persons
relevant information concerning
issued and withdrawn quality system approvals.

III.
PRODUCT VERIFICATION


First This is the procedure whereby the manufacturer or importer and ensures
declares that the elements under the provisions of section 3 are in conformity with the type
described in the EC type examination certificate and satisfy the requirements of this regulation
.


Second The manufacturer shall take all measures necessary to
manufacturing process ensures compliance of the type described in the certificate of EC type examination
with the requirements of this Regulation. The manufacturer affixes each element
conformity marking and issued a declaration of conformity.

Third The authorized person is obliged to perform appropriate examinations and
tests to check the conformity of the requirements of this regulation, according
choice of the manufacturer either by examination and testing of each element according to claim 4 or
examination and testing of components on a statistical basis | || under 5.

Manufacturer or importer must keep a copy of the declaration of conformity
at least 30 years after the last element.

Fourth Verification by examination and testing of every component

4.a All components must be individually examined and must undergo appropriate tests
specified in technical regulations or equivalent
tests to verify their conformity with the type described in the EC type examination
with the requirements of this ordinance.

4.b authorized person shall provide or cause to be affixed on each element
approved its identification number and issue a written
certificate of conformity relating to the tests carried out.

4.c manufacturer or importer is obliged to ensure that it is able to
request the certificates of conformity issued by an authorized person.

Fifth Statistical verification

5. a manufacturer must present his components in the form of homogenous lots
and take all necessary measures to ensure that the manufacturing process ensures the homogeneity
each batch.

5.b The verification must be in possession of all the elements in the form of homogeneous
benefits. For each batch must be random sample is taken.
Components in a sample must be individually examined and appropriate
tests indicated in the technical regulations pursuant to § 8.
2 of this Regulation or equivalent tests in order to verify their conformity with the requirements of this Regulation
and decide whether the lot is accepted or rejected
.

5.c statistical procedure should be guided by the following principles

A) statistical method

B) the sampling plan with its operational characteristics.

5.d If the batch is accepted, the authorized person must provide or obtain
give each element its identification number and issue a written
certificate of conformity relating to the tests carried out. All elements of
batch may be placed on the market except those components from the sample
which have been found to be incoherent.

If a batch is rejected, the authorized person or a competent
authority shall take appropriate measures to prevent that production
lot on the market. In the event of frequent rejection of lots the
authorized body may suspend statistical verification.

Manufacturer may, during the manufacturing process, affix the responsibility of the authorized person
its identification number.

5.e. manufacturer or importer is obliged to ensure that it is able to
request the certificates of conformity issued by an authorized person.

IV.

Unit verification

First This is the procedure whereby the manufacturer ensures and declares that the
element to which the certificate was issued pursuant to Section 2
meets the requirements of this Regulation which apply to it. The manufacturer or importer is obliged to provide an element
conformity marking and issue the declaration of conformity.

Second The authorized person is obliged to check the element and perform
appropriate tests set out in the relevant technical regulations by
§ 8 paragraph. 2 of the Regulation, or equivalent tests, to check
their conformity with the requirements of this Regulation.

Authorized person shall affix or have affixed to the approved element
its identification number and issue a certificate of conformity relating to the tests carried out
.

Third The technical documentation is to enable assessment of conformity with the requirements of this Regulation
and the design, manufacture and operation of the element.

For the purposes of assessing the documentation must contain

A) a general description of the type

B) conceptual design and manufacturing drawings and diagrams of components, sub-assemblies, circuits, etc.
.

C) descriptions and explanations necessary for understanding these drawings and diagrams and the operation
product

D) list of relevant technical regulations under § 7 para. 2 of this regulation
, wholly or in part, and descriptions of the solutions

Taken by the manufacturer to meet the essential requirements of this Regulation
if these technical regulations are not applied

E) results of design calculations, examinations carried out
etc.,

F) test reports

G) use of the area.

V.
FULL QUALITY ASSURANCE


First This is the procedure whereby the manufacturer who satisfies the obligations of paragraph 2
ensures and declares that the components meet the relevant requirements of this Regulation
that apply to them. The manufacturer or importer is obliged
each element to affix the compliance and issue a written declaration of conformity
. Conformity marking must be accompanied by the identification number
authorized person responsible for the supervision under Section 4

Second The manufacturer shall operate an approved quality system for design,
production, final inspection and testing of elements in point 3 and subject them
surveillance under Section 4

Third The quality system

3.a manufacturer must submit an authorized person for the assessment of the quality


The application must include

A) all relevant information on the intended element

B) the quality system documentation.

3.b quality system must ensure compliance of the components with the relevant requirements of this Regulation
.

All the elements, requirements and provisions adopted by the manufacturer must be
documented systematic and orderly manner in the form of written
measures, procedures and instructions. This quality system documentation must
permit a consistent interpretation of the quality policies, plans, manuals and quality
records.

It must in particular contain an adequate description

) The quality objectives and the organizational structure, responsibilities and powers
leadership in terms of design and quality features

B) technical design specifications, including technical regulations under §
7, paragraph. 2 of the Regulation, which will be used, and where technical regulations
fully in use, the means that will be used in order | || ensure that the essential requirements of this regulation, which applies to
products.

C) the inspection and verification of designs, processes and systematic
actions that will be used when designing the elements belonging to the respective category
elements

D) appropriate methods, processes and systematic actions that will be used
manufacturing, quality control and quality assurance

E) the examinations and tests that will be carried out before, during
and after manufacture and the frequency with which,

F) the quality records, eg. Protocols on inspections, testing results,
calibration data, reports on the qualifications of the personnel
etc.,

G) the means of monitoring the achievement of the required quality
design and component and the effective operation of the quality system.

3.c authorized person shall assess the quality system to
determine whether it satisfies the requirements of point 3.a. Compliance with these requirements
anticipated for quality systems, which have been used
relevant harmonized standard.

Least one member of the group of auditors must have experience of assessments
technology concerned. The assessment procedure must include an inspection
visit the manufacturer's premises.

The decision must be notified to the manufacturer. The notification must contain the conclusions
examination and the reasoned assessment decision.

3.d manufacturer must undertake to fulfill the obligations arising out of
quality system as approved and to maintain it so that it remains adequate and efficient
.

Manufacturer or importer is obliged to inform the authorized person who
approved the quality system of any intended change of the quality system.

Authorized person shall assess the proposed changes and decide whether
changed quality system will still satisfy the requirements referred to in point 3.b,
or whether a reassessment is required.

Authorized person shall notify the manufacturer of its decision.
Notification must contain the conclusions of the examination and the reasoned assessment decision.

Fourth Surveillance under the responsibility of the authorized person

4th and purpose of surveillance is to ensure that the manufacturer duly fulfills the obligations
arising from the approved quality system.

4.b manufacturer shall allow the authorized person for the purpose of inspection
input into the design, construction, inspection and testing, and
storage and provide it with all necessary information, especially


A) the quality system documentation,

B) the quality records required under the quality system regarding the design
eg. The results of analyzes, calculations, tests, etc.,

C) the quality records required under the quality system relating to manufacture
eg. The inspection and test data
calibration, reports on the qualifications of the personnel concerned, etc.

4.c authorized person shall carry out periodic audits to make
sure that the manufacturer maintains and applies the quality system and pass
manufacturer with audit reports.

4.d In addition, the authorized person to carry out unannounced visits to the manufacturer
. During such visits, the authorized
person may carry or have carried out tests to verify
that the quality system is functioning correctly. The authorized person shall
provide the manufacturer with an inspection report and, if a test has
test report.

Fifth The manufacturer shall keep the national authorities after
at least 30 years after the last product

A) documentation described in section 3.In order,

B) an update of the second subparagraph of point 3.d,

C) the decisions and reports from the authorized person under paragraphs 3.d, 4.ca 4.d.

6th Each authorized person is obliged to provide other authorized persons
relevant information concerning
issued or withdrawn approvals of quality systems.

7th Additional requirements of the design examination

7.a manufacturer must submit an application for examination of the design only authorized person


7.b The application must enable the design, manufacture and operation of the component
conformity with the requirements of this Regulation. The application must include

A) the technical design specifications, including technical regulations under § 7
paragraph. 2 of the Regulation, which are used

B) the necessary supporting evidence for their adequacy, in particular where they have not been used
technical regulations under § 7 para. 2 of this Regulation.
This supporting evidence must include the results of the examinations carried
appropriate laboratory of the manufacturer or on his order.

7.c authorized person shall examine the application and where the design
complies with the provisions of this Regulation which apply to it, issue a certificate to the applicant
an EC proposal.
Certificate must contain the conclusions of the examination, conditions for its validity, the necessary data for identification of the approved design
, a description of the function of the elements.

7.d. applicant is obliged to inform the authorized person who issued the certificate
EC design-examination of any amendment approved
proposal. Changes to the approved design must receive additional approval
authorized person who issued the certificate of examination
draft, where they may affect conformity with the essential requirements by
Annex no. 2 of the Regulation or the prescribed conditions for use of the element
. This additional approval is an addendum to the original
certificate of EC design examination.

7.e authorized person shall communicate to the other authorized persons
relevant information concerning

A) certificates issued by the EC design and additions

B) withdrawn approval by the EC design and additions

C) certificates withdrawn by the EC design and additions.
Annex 5


Conformity Assessment subsystems

First EC examination is the procedure whereby, at the request of the manufacturer or importer
authorized body checks and certifies that the subsystem is

A) in accordance with the provisions of this Regulation

B) in accordance with the technical documentation and

C) finished.

Second The technical documentation accompanying the examination certificate must contain


A) design drawings and calculations, electrical and hydraulic diagrams,
control circuits, description of computer and automatic systems
instructions for use and instructions for operation, maintenance, inspection and testing,

B) a list of devices which have been used in subsystems
according to Annex no. 1 of this Regulation

C) a copy of the declaration of conformity in accordance with Annex no. 4
safety components together with the relevant design plans and copies of the reports made
further testing.

Third Documentation and correspondence in connection with the procedure for examination
must be written in the same language as written operating instructions according
point 7.aa Annex No. 2.


Fourth supervision
Through
4th and supervision to ensure that the obligations arising from the technical documentation are
during construction of the subsystem met.

4.b authorized person responsible for EC examination must have permanent access
production workshops, warehouses, and when necessary, to
prefabrication areas, testing plants and more generally to any place
whose visit is needed to fulfill its task.
Manufacturer or importer must provide, or arrange to provide all the documents requested
this goal, especially drawings and technical documentation
pertaining to the sub-system.

4.c authorized person responsible for the EC is obliged
conduct regular audits to ensure compliance with the provisions of this Regulation
. Every inspection visit is required to grant the head of the personnel department
audit report.

4.d In addition, the authorized person to carry out unannounced visits
production shops. During such visits
can perform full or partial audits. The authorized person is obliged to draw
visit report and, if necessary, submit to the manager
an audit report.

Fifth Each authorized person is required to periodically disclose information regarding


A) all applications for EC examination,

B) all issued certificates of examination,

C) all certificates withdrawn by the EC.
Appendix 6


Minimum requirements that must be taken into account in the authorization (K
implementation of § 11 para. 2 of the Act)

First Employees authorized persons responsible for carrying out verification
nor the designer, manufacturer, supplier or installer
safety components or subsystems which they inspect, nor
authorized representative of any of those parties or the natural or
legal person who places the safety components or subsystems on the market
. They may not be involved either directly or as authorized representatives
in the design, manufacture, construction, marketing or maintenance
these safety components or subsystems. This does not exclude the possibility
exchanges of technical information between the manufacturer and the authorized person
.

Second The body and its staff must carry out the verification
to the highest degree of professional integrity and technical competence and
not cause them any pressures and motives
particularly financial, which might influence their judgment or the results
inspection, especially from persons or groups of persons with an interest in the outcome
authentication.

Third The authorized person shall have the necessary staff and possess
equipment necessary to enable it to perform properly
administrative and technical tasks connected with verification must also have
access to the equipment needed for exceptional verifications.

Fourth The staff responsible for inspection activities must have

A) qualified technical and vocational training,

B) knowledge of the requirements relating to the tests they carry out and
adequate experience of such tests

C) the ability to draw up certificates, records and reports required for authentication
tests performed.
For installations under § 1 par. 3 point. a), b)
employees must still meet the professional competence pursuant to special legislation 10).

Fifth It must be ensured independence of staff performing inspections.
Their salary should not depend on the number of tests carried out or on the results of these tests
.

6th The authorized persons are obliged to maintain confidentiality about
facts which they learn in the activities of the authorized persons
