REGULATION OF THE GOVERNMENT
of 20 December. December 2012
on the adjustment of compensation for loss of earnings after the end of work incapacity
resulting from an accident at work or occupational diseases, on the adjustment of compensation for
loss of earnings after the end of the incapacity or disability
and on the adjustment of the refund of the cost of food to survivors (of compensation)
The Government ordered under section 390, paragraph. 2 of Act No. 262/2006 Coll., code
work, as amended by Act No. 362/2007 Coll. and under section 447, paragraph. 4 of law No.
40/1964 Coll., the civil code, as amended by Act No. 132/1982 Coll., Act
No 160/2006 Coll. and Act No 264/2006 Coll.:
PART THE FIRST
ADJUSTMENT OF COMPENSATION FOR LOSS OF EARNINGS AFTER THE END OF WORK INCAPACITY
RESULTING FROM AN ACCIDENT AT WORK OR OCCUPATIONAL DISEASE, AND THE ADJUSTMENT OF THE REFUND
THE COST OF FOOD TO SURVIVORS ACCORDING TO THE LABOUR LEGISLATION
§ 1
Compensation for loss of earnings after the end of incapacity resulting from
an accident at work or an occupational disease (hereinafter referred to as "compensation for the loss of the
earnings ") and the reimbursement of the cost of the food to survivors belonging
employees or survivors under the labour code, as appropriate,
the earlier legislation of ^ 1), shall be adjusted so that the average earnings
decisive for the calculation of compensation for loss of earnings, increased, where applicable,
According to the labour legislation ^ 2), and for the calculation of refunds of the costs of
food to survivors, or increased under labour legislation,
is increased by 0.9%.
§ 2
(1) where a claim for compensation for loss of earnings and for compensation
the cost of food to survivors after 31 December 2006. December 2012, the average earnings
decisive for the calculation of compensation for loss of earnings and costs on
food to survivors according to § 1 does not increase.
(2) the adjustment referred to in § 1 shall be carried out without the request of the employee, or
survivors; at the request of the employee, be carried out in cases where he
compensation for the loss of earnings as a result of the increase in nepříslušela only

PART THE SECOND

OR IN RESPECT OF INVALIDITY AND THE ADJUSTMENT OF THE REFUND OF THE COST OF FOOD TO SURVIVORS
ACCORDING TO THE CIVIL LEGISLATION
§ 3
Compensation for loss of earnings after the end of the incapacity or
invalidity ^ 3) (hereinafter referred to as "replacement") and the reimbursement of the cost of the food
survivors are adjusted so that the average earnings determined for the calculation of the
refunds, or increased according to the earlier legislation ^ 4), and for
the calculation of the refund of the cost of food to survivors, or increased by
civil law, is increased by 0.9%. The adjustment of the refund in accordance with
the first sentence shall not apply, where a claim for compensation and for compensation
the cost of food to survivors after 31 December 2006. December 2012.
PART THE THIRD
COMMON PROVISIONS
§ 4
For compensation for loss of earnings, even after the adjustment made under section 1 and
for compensation, even after her adjustment made under section 3 shall apply article. In Act No.
160/1993 Coll., amending and supplementing Act of the Czech National Council No.
589/1992 Coll., on social security and a contribution to the State
employment policy, as amended by the Act of the Czech National Council No. 10/1993
Coll., and some other laws.
§ 5
Compensation for loss of earnings, compensation and reimbursement of the cost of food
survivors, adjusted in accordance with this regulation, from 1. January 2013.
§ 6
This Regulation shall enter into force on the date of its publication.
