on technical requirements for pyrotechnic articles and their placing on the
market
The Government ordered under section 7 (2). 3, § 8 paragraph. 3, § 9 (2). 4 and section 10, paragraph 1.
3 of Act No. 206/2015 Coll., on pyrotechnic articles and the treatment of
them and on the amendment of certain laws (law on the pyrotechnics), (hereinafter referred to as
the "law"):
§ 1
The subject of the edit
This regulation incorporates the relevant provision of the European Union "^ 1") and modifies the

§ 2
Conformity assessment procedures
Description and contents of each conformity assessment procedures including documentation,

the procedure of the manufacturer and the notified body for individual assessment procedures
of conformity is given in annex 1 to this regulation.
§ 3
Documentation
Documentation attached to the application for assessment of conformity of the
the EU type-examination)
1. technical documentation and

harmonised standards have not been applied in full; If it is necessary to

d) conformity based on comprehensive quality assurance
1. the technical documentation for one model of each category of
pyrotechnic articles, which they produce, and
2. the documentation of the quality system.
§ 4
The technical documentation
(1) the technical documentation must enable the conformity of the
a pyrotechnic product with the requirements of the Act and includes the corresponding
analysis and risk assessment.
(2) the technical dossier contains at least
and a general description of the pyrotechnic article),
b) conceptual design and manufacturing drawings and schemes of components, subassemblies,
circuits, and possibly other parts of the product, including their descriptions and
the explanatory notes,
(c)) the list of harmonised standards, which were wholly or partly used, and
for which references have been published in the official journal of the European Union, and
a description of the solutions adopted to meet the essential safety requirements
the law; list of other relevant technical specifications
have been used, if harmonized standards have not been applied; in the case of
partially applied harmonised standards, the technical documentation

d) results of design calculations carried out examination and, where applicable,
other information necessary for the assessment of conformity of a product, and
e) protocols on the testing carried out.
§ 5
The quality system documentation
(1) the quality system documentation must permit uniform interpretation of
programmes, plans, manuals and quality records.
(2) documentation of the quality system contains
and quality objectives,) a description of the organizational structure, responsibilities and powers of the

§ 6
The EU type-examination certificate
(1) the EU type-examination Certificate and its annexes shall contain the information

§ 8

§ 9
The effectiveness of the

Annex 1
CONFORMITY ASSESSMENT PROCEDURES
1. the EU type-examination (module B)
1.1 EU type examination is the part of a conformity assessment procedure, in which
the notified body shall examine the technical design of the pyrotechnic article and
verifies that the technical design meets the requirements of the pyrotechnic article
the law.
1.2 the EU type-examination shall be carried out in order to assess the suitability of the
the technical design of the product through examination of the bomb
the technical documentation and supporting evidence, and the examination of a sample of the complete
the product which corresponds to the planned product (combination of production type and
the type of design).
1.3. The notified body must examine the pyrotechnic article technical
documentation and supporting evidence to assess the adequacy of the technical
the design of the pyrotechnic article.
1.4 the notified body for a sample of
1.4.1 examine whether the sample was made in accordance with the technical
documentation and identify the elements which have been designed in accordance with the applicable
the provisions of harmonised standards and elements which have been designed in

1.5 If the type meets the requirements of the Act, which apply to the
the pyrotechnic article, the notified body shall issue a certificate to the manufacturer of the EU
type-examination.
If the type does not satisfy the requirements of the Act, the notified body shall issue the certificate
the EU type-examination certificate and shall inform the applicant, and
no need to justify to the certificate.

The manufacturer shall inform the notified body that holds the technical

the product with the essential safety requirements of the law or the conditions of
the validity of this certificate. These customizations require additional approval
in the form of a supplement to the original EU type-examination certificate.

States at their request, a copy of the technical documentation and the results of the

type-examination, the notified body shall retain a copy of this certificate,
its annexes and appendices, as well as the technical file including the
the documentation submitted by the manufacturer.

2. Conformity to type based on internal production control and tests
under the supervision of the product at random intervals (module C2)

2.2 Production
The manufacturer shall take measures in order that the manufacturing process and its control
ensure conformity of the manufactured pyrotechnic articles with the type described in the
the EU type-examination certificate and with the requirements of the Act.
2.3 Test product
The notified body chosen by the manufacturer carries out the test product or allow
such tests to be carried out at random intervals, which itself
lays down, in order to verify the quality of the internal tests of pyrotechnic
the product, taking into account inter alia the technological complexity of
pyrotechnic products and the quantity produced. Before placing on the market

3. Conformity to type based on quality assurance of the production process
(module D)
3.1 the assessment of conformity to type based on quality assurance of the
the process is part of a conformity assessment procedure, that the manufacturer fulfils the
the obligations laid down in points 3.2 and 3.5, and on their own responsibility
declares that the pyrotechnic articles are in conformity with the type
as described in the EU type-examination certificate and satisfy the requirements of the Act.
3.2 Production
The manufacturer must operate an approved quality system for production, final inspection
and tests of pyrotechnic articles concerned referred to in section 3.3 and subject to
the surveillance referred to in point 3.4.
3.3. Quality System
3.3.1. The notified body shall assess the quality system meets the requirements of
laid down by law.
The elements of the quality system which conform to the provisions of the harmonised
standards, the notified body, the conformity with these requirements. Of the person,
that the name of the notified body carrying out the assessment of the quality system,
(hereinafter referred to as the "audit team") must have experience with systems management
the quality and knowledge of the requirements of the Act and at least one Member must have
experience with the assessment of the relevant products and with the relevant
technology product. The audit includes an evaluation visit in the operating
the premises of the manufacturer. The audit team shall review the technical documentation,
to verify that the manufacturer shall proceed according to the requirements of the Act for the given type
conformity assessment and conducts all the necessary examination, in order to guarantee
the conformity of the pyrotechnic article with these requirements.
The conclusions of the audit, including the reasons therefor shall be notified to the manufacturer.
3.3.2. the Producer is obliged to fulfil the obligations arising from the approved
of the quality system and to maintain it so that it remains adequate and efficient.
3.3.3. The manufacturer may change the quality system, which was developed
the quality system documentation, only with the prior consent of the notified
the body.

3.4. Surveillance under the responsibility of the notified body
3.4.1. The purpose of surveillance is to ensure that the manufacturer duly fulfils the obligations
arising out of the approved quality system.
3.4.2 in order to exercise supervision, the manufacturer must allow the notified body
access to the places of manufacture, inspection, testing and storage
and provide it with all the necessary documents, in particular the
and) the quality system documentation;
(b)) the quality records, in particular the reports of the inspections, the records of the
tests carried out, records of the performed calibration and reports on
the qualifications of the persons responsible for the assessment of conformity.
3.4.3. The notified body must periodically carry out audits to verify whether the
manufacturer maintains and applies the quality system and to submit a report on the
the audit.
3.4.4. The notified body may carry out the manufacturer of control and without
prior notice. Under the control of a notified body in the case of

a report on the inspection and test, if the test was performed.
3.5 the CE marking and the EU Declaration of conformity

3.6 the manufacturer shall keep available for the national authorities according to § 18 paragraph.

4. Conformity to type based on product quality assurance (module E)
4.1 assessment of conformity to type based on quality assurance of the product is
part of the conformity assessment procedure, that the manufacturer fulfils the obligations laid down
in points 4.2 and 4.5, and on their own responsibility declares that the
pyrotechnic articles are in conformity with the type as described in the certificate of the EU
type-examination and meet the requirements of the Act.
4.2 Production
The manufacturer must operate an approved quality system for final inspection and
tests of pyrotechnic articles concerned as specified in point 4.3, and shall be subject to
surveillance as specified in point 4.4.
4.3. Quality System
4.3.1. The notified body shall assess the quality system meets the requirements of
laid down by law.
The elements of the quality system which conform to the harmonised
standards, the notified body, the conformity with these requirements.
The audit team must have experience with the quality management systems and knowledge
the requirements of the Act and at least one Member must have experience with
the evaluation of the relevant products and product technologies. Audit
includes the assessment visit to the manufacturer's premises.
The audit team shall review the technical documentation to verify that the manufacturer
in accordance with the requirements of the Act for the type of conformity assessment and performs
the necessary examination, in order to guarantee compliance with the pyrotechnic article

4.3.2. The manufacturer is obliged to fulfil the obligations arising from the approved

manufacturer maintains and applies the quality system and to submit a report on the

4.4.4. the notified body may carry out without checking the manufacturer

4.6. The manufacturer shall keep available for the national authorities according to § 18 paragraph.

5.2 Production
The manufacturer shall take measures in order that the manufacturing process and its control
ensure conformity of the manufactured product with the requirements of the bomb

examinations and tests specified in the harmonised standards, or
equivalent to the tests referred to in other technical specifications to

6. the conformity based on comprehensive quality assurance (module H)
6.1. Conformity assessment based on comprehensive quality assurance is
the conformity assessment procedure whereby the manufacturer fulfils the obligations laid down in
paragraphs 6.2 and 6.5 and on their own responsibility declares that the
pyrotechnic products meet the requirements of the Act.
6.2 Production
6.2.1. The manufacturer must operate an approved quality system for design, manufacture,
final inspection and testing of pyrotechnic articles concerned by
6.3.
6.2.2 the manufacturer is subject to supervision in accordance with point 6.4.
6.3 the quality system
6.3.1. The notified body shall assess the quality system meets the requirements of
laid down by law.
The elements of the quality system which conform to the harmonised
standards, the notified body, the conformity with these requirements.
The audit team must have experience with the quality management systems and knowledge
the requirements of the Act and at least one Member must have experience with
the evaluation of the relevant products and the relevant technology of the product.
The audit includes an assessment visit to the manufacturer's premises.
The audit team shall review the technical documentation to verify that the manufacturer
in accordance with the requirements of the Act for the type of conformity assessment and performs
all the necessary examinations, in order to guarantee the consistency of the pyrotechnic
of the product with these requirements.
The conclusions of the audit, including the reasons therefor shall be notified to the manufacturer.
6.3.2. The producer is obliged to fulfil the obligations arising from the approved
of the quality system and to maintain it so that it remains adequate and efficient.
6.3.3. The manufacturer may change the quality system, which was developed
the quality system documentation, only with the prior consent of the notified

(b)) the quality records provided for in part of the quality system relating to
the proposal, in particular the results of analyses, calculations and tests;
(c)) the quality records provided for in the manufacturing part of the quality system, in particular the
reports of inspections, the records of the tests carried out, the records of the
the calibration carried out and reports on the qualifications of the persons responsible for the
assessment of conformity.
6.4.3. The notified body must periodically carry out audits to verify whether the
manufacturer maintains and applies the quality system and to submit a report on the
the audit.
6.4.4. the notified body may carry out without checking the manufacturer
prior notice. Under the control of a notified body in the case of
necessary to perform, or have performed, the test of products, in order to verify whether the

6.5 the CE marking and the EU Declaration of conformity
