THE CONGRESS OF THE REPUBLIC

Having regard to the text of the amendments to the Convention on International Trade in Endangered Species of Wild Fauna and Flora, signed in Washington, D. C., on 3 March 1973, adopted in Bonn, Germany, on 22 June 1979 and in Gaborone, Botswana, on April 30, 1983, which to the letter reads:

AMENDMENT

Pursuant to Article XVII of the Convention on International Trade in Endangered Species of Wild Fauna and Flora, signed in Washington, D. C., on 3 March 1973, an extraordinary meeting of the Conference of the Parties was convened. in Bonn (Federal Republic of Germany), on 22 June 1979.

The following parties were represented: Germany (Federal Republic of), Botswana, Canada, Chile, Costa Rica, Denmark, Ecuador, Egypt, United States of America, Finland, France, India, Kenya, Nigeria, Norway, Panama, United Kingdom Great Britain and Northern Ireland, Senegal, South Africa, Sweden, Switzerland, Union of Soviet Socialist Republics and Zaire.

With the majority of two-thirds of the Parties present and voters, the Conference of the Parties adopted the following amendment to the Convention.

Words and financial provisions must be added at the end of sub-paragraph (a) of paragraph 3 of Article XI of the Convention.

AMENDMENT

According to Article XVII of the Convention on International Trade in Endangered Species of Wild Fauna and Flora, signed in Washington, D. C., le 3 de mars, 1973, an extraordinary meeting of the Conference of the Parties was convened. in Gaborone (Botswana) on 30 April 1983.

The following Parties were represented: Argentina, Australia, Austria, Bahamas, Botswana, Brazil, Canada, Chile, China, Denmark, United States of America, Finland, France, Gambia, Guyana, India, Indonesia, Israel, Italy, Japan, Kenya, Liberia, Madagascar, Malavi, Malaysia, Mozambique, Nepal, Norway, Pakistan, Papua New Guinea, Paraguay; Peru, Portugal, Federal Republic of Germany, United Republic of Cameroon, Rwanda, St. Lucia, Senegal, Sudan, South Africa, Sweden, Switzerland, Togo, Union Soviet Socialist Republics, United Kingdom of Great Britain, and Northern Ireland, Uruguay, Venezuela and Zambia.

With most of the two-thirds of the Parties present and voters, the Conference of the Parties adopted an amendment to Article XXI of the Convention by adding the following 5 paragraphs after the words Depositary Government.

1. This Convention shall be open to the accession of any regional economic integration organisation constituted by Sovereign States with competence to negotiate, conclude and enforce international agreements on matters which have been referred to them by their Member States and are covered by the present Convention.

2. In their instruments of accession, such organisations shall declare their degree of competence in matters covered by the Convention. These organisations shall also inform the Depositary Government of any substantial changes in their degree of competence. Notifications sent by organisations which aim for regional economic integration in relation to their competence in the matters covered by this Convention and the amendments thereto shall be distributed to the Parties to the Depositary Government.

3. In the case of their jurisdiction, those organisations shall exercise the rights and fulfil the obligations which the Convention attributes to their Member States, which are Parties to the Convention. In such cases, Member States of such organisations shall not exercise such rights individually.

4. In the areas of their competence, organisations which aim for regional economic integration shall exercise their voting rights with a number of votes equal to the number of their Member States which are Parties to the Convention. Such organisations shall not exercise their right to vote in the event that their Member States exercise their right, and vice versa.

5. Any reference to a Party within the meaning of Article I (h) of this Convention, to State/States or to State Party/States Parties to the Convention shall be construed as including a reference to any integration organization regional economic competition to negotiate, conclude and enforce international agreements on matters covered by this Convention.

AMENDMENTS TO THE CONVENTION ON INTERNATIONAL TRADE IN ENDANGERED SPECIES AND WILD FAUNA AND FLORA, SIGNED IN WASHINGTON, D.C., on 3 March 1973, adopted in Bonn, Germany, on 22 June 1979 and in Gaborone, Botswana, on 30 June. April 1983.

Honorable Senators and Representatives:

On behalf of the National Government and in compliance with the provisions of Articles 150 numeral 16 and 189 numeral 2 of the Constitution Politics of the Republic of Colombia, we have the honor to submit to your consideration the Bill, by means of which the Amendments of the Convention on International Trade of Endangered Species of Wild Fauna and Flora are approved, signed in Washington, D. C., on 3 March 1973, adopted in Bonn, Germany, on 22 June 1979 and in Gaborone, Botswana, on 30 April 1983.

The Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) was made in Washington on March 3, 1973 and came into force on the first (1o) of July 1975, with Colombia being part of the Convention on the International Trade in Endangered Species of Wild Fauna and Flora (CITES). November 19811.

This Convention basically establishes the regulation of international trade in endangered species of wild fauna and flora with a view to their protection against excessive exploitation. To date two amendments have been adopted by the Conference of the Parties: the first of them held in Bonn, Germany, on 22 June 1979 and, the second of them in Gaborone, Botswana, on 30 April 1983.

The amendment adopted in 1979 is intended to include, within the functions of the Conference of the Parties, the adoption of financial provisions, in such a way that the Conference is the highest organ of the Convention, in which all the Contracting Parties are given powers to deal with and decide on matters of financial type under the Convention.

It should be noted that this Amendment has been in force since 13 April 1987 when the minimum number of ratifications provided for in the Convention was reached. With the amendment, the powers of the Conference were adapted to the general practice in the area of the Environmental Multilateral Agreements, since as has already been mentioned, this is the supreme body of the Convention, which decides on all kinds of matters within which it was important to include those of a financial type.

The Amendment adopted in 1983 opens the Convention for the Accession of Regional Economic Integration Organizations formed by sovereign states and regulates, among other things, the rights and obligations of the members and the voting system.

The opening of the Convention to regional economic integration organisations, such as the European Union, will allow for more coordinated regional management, in so far as these bodies may be empowered to negotiate, conclude and enforce international agreements on matters relating to the subject matter of the Convention.

Colombia's accession to this amendment can be seen as a gesture of support for the European Union, which has been an ally of our country in several of the positions adopted in relation to the object of the Convention.

For the above reasons, the National Government of the Republic of Colombia, through the Minister of Foreign Affairs and the Deputy Minister of the Environment, in charge of the functions of the Office of the Minister, requests the honorable Congress National approving the amendments to the Convention on International Trade in Endangered Species of Wild Fauna and Flora, signed in Washington, D. C., on 3 March 1973, adopted in Bonn, Germany, on 22 June 1979 and in Gaborone, Botswana, 30 April 1983.

By which the international conventions signed by Colombia are ordered to follow.

The Congress of Colombia

DECRETA:

ARTICLE 1o. The National Government through the Foreign Ministry will submit annually to the Senate and Chamber Foreign Relations Committees and within the first thirty days of the post-period calendar. This is an in-depth report on how the international agreements signed by Colombia with other states are being implemented and developed.

ARTICLE 2o. Each dependency of the National Government charged with implementing the International Treaties of its competence and requiring reciprocity in them, will transfer the relevant information to the Ministry of Foreign and East relations, to the Second Commissions.

ARTICLE 3o. The full text of this law shall be incorporated as an annex to any and all international conventions that the Ministry of Foreign Affairs presents to the Congress.

ARTICLE 4. This law governs from its enactment.
