By means of which the certificate of psycho-physical fitness for the carrying and possession of firearms is implemented and other provisions are dictated.

COLOMBIA CONGRESS

DECRETA:

ARTICLE 1o. Natural persons who are linked or who at the time of entry into force of this law are linked to the private security and surveillance services (vigilantes, escorts and (a) and who are required to carry or have firearms, must obtain the certificate of psycho-physical fitness for the carrying and possession of firearms, which must be issued on the basis of the parameters set out in the literal (d) of the article 11 of Act 1119 of 2006, by a registered specialized institution and certified to the respective authority and to the standards of law.

The validity of the certificate of psycho-physical fitness for the carrying and possession of firearms, issued to the persons mentioned in this article; it shall be valid for one (1) year, which shall be renewed each year.

PARAGRAFO. The psycho-physical fitness certificate referred to in this article shall be performed at no cost by the ARP to which the workers are affiliated. The National Government shall regulate the content of this paragraph.

ARTICLE 2o. When legal persons or natural persons providing surveillance and private security services with duly accredited guards or escorts or supervisors who must have or carry weapons of fire, they render them without having obtained the certificate of psycho-physical fitness for the carrying and possession of firearms, they will be punished with fine of five (5) to one hundred (100) minimum legal salaries in force, which will be imposed by the Superintendence of Surveillance and Private Security, which also monitor, monitor and advance administrative investigations.

ARTICLE 3o. SECURITY SYSTEM. The Integrated Safety System on the issue of the physical fitness certificate is intended to ensure the presence of the applicant in the specialized institution or institution; tests and evaluations by the means or specialists; that the certificate is issued from the geographical location of the specialised institution or institution; and that such tests are carried out from the computer equipment of the centres or institutions specialised in order to avoid possible fraud on the issue of the said certificate.

The safety protocols for conducting the examinations of the certificate of physical fitness performed by the centres of specialized institutions, in a single Integrated Security System, are as follows:

1. Record, authenticate, and validate the identification of people at the beginning and end of each of the medical evaluations or tests. The aspiring and professional user of health should proceed to identify with biometric readers, as well by the biometric reading of the fingerprint at the time of the medical examination. Fingerprint readers must have the live finger functionality.

The validation of the footprint will be done with the System of the National Civil State System, for which this entity will have to adopt the technical and legal measures for the effect.

2. Take citizenship card information with barcode readers.

3. Register the signature using signature digitizer devices.

4. Capture the photo of the user through a camera with high definition digital sensor, which generate sharp images with more detail, in order to identify the aspirant person.

5. Register and send the test results at the end of each test, directly to the Integrated Security System or from the application of each specialized institution integrating with the System, complying with the standards of the system. This system will monitor the minimum times when each test (psychomotor, optometry, hearing, medical) should be performed.

PARAGRAFO. The Integrated Security System must validate each and every evaluation of the tests performed against the assessment criteria set in the literal d) of the article 11 of Law 1119 of 2006 and Resolution 1555 of 2005.

6. The connectivity with the Integrated Security System will be carried out through a Virtual Private Network that will be assembled with security devices and communications that control, validate the geographical location of the specialized institution, and be able to ensure that examinations are carried out in order to obtain the certificate of physical fitness from the location of the registered office, controlling and authorizing the computer equipment of the Specialized Institution verifying the identification of the main components of each computer.

Specialized institutions or centers will connect with the Integrated Security System through optimal Internet channels for the operation, with a Fixed Public IP address. The Integrated Security System will have a dedicated channel sufficient for the connection of the Centers or specialized institutions, and will allow the access of the secure information to the Superintendence of Surveillance and Private Security.

PARAGRAFO 1o. All institutions that issue or are to issue physical, mental and physical fitness, mental and coordination certificatesmust be accredited as certification bodies. persons, under the ISO/IEC 17024:2003 standard, for which they shall be required to obtain, renew or maintain accreditation, to ensure compliance with the Integrated Safety System of this Article.

PARAGRAFO 2o. The integrated security system must obtain recognition by registration and/or application filed and admitted for patent processing of and/or Utility Model, in accordance with Decision 486 of 2000 issued by the Superintendence of Industry and Commerce. In addition to the case of the software, it must have the registration or deposit of intellectual property, according to Law 23 of 1982 and Decree 1360 of 1989.

PARAGRAFO 3o. The entity in charge of the Registration of Information on Physical, Mental and Motor Fitness Certificates under Law 769 of 2002 must deliver the information or allow access to all records of medical certificates of physical, mental and psychomotor fitness, in real time in order to confront, compare with the information stored in the Integrated Security System, the latter deliver a legitimate daily report to the control and surveillance authorities for the examinations that they have complied with the criteria set out in the literal d) of article 11 of Law 1119 of 2006 and Resolution 1555 of 2005.

ARTICLE 4. In order to allow the Superintendence of Surveillance and Private Security to exercise the controls and to advance the administrative actions outlined in this law; it will have access to the base of details of the certificates of physical fitness issued by the specialised institutions registered and certified by the respective authority.

ARTICLE 5o. The Specialized Institutions duly registered with the respective health authority shall install and maintain in operation the equipment and technologies necessary for access to the system and the database by the Sectionals of the Superintendence of Surveillance and Private Security.

ARTICLE 6o. VALIDITY. This law governs from its publication in the Official Journal and repeals any provisions that are contrary to it.
