DECRETA:

CHAPTER I.

OF VOCATIONAL AND TECHNOLOGICAL TECHNICAL AND TECHNICAL HIGHER EDUCATION INSTITUTIONS.

ARTICLE 1o. PROFESSIONAL TECHNICAL INSTITUTIONS. They are Institutions of Higher Education, which are characterized by their vocation and manifest identity in the fields of knowledge and work in activities of a technical nature, duly substantiated in the nature of a knowledge, whose training must ensure the interaction of the intellectual with the instrumental, the operational and the technical knowledge.

These institutions will be able to offer and develop training programs up to the professional level, only for propedeutic cycles and in the areas of engineering, information technology and administration, provided they are derived from the programs technical and professional technical training which they offer, and subject to compliance with the requirements set out in this Law.

ARTICLE 2o. TECHNOLOGICAL INSTITUTIONS. They are institutions of higher education, which are characterized by their manifest vocation and identity in the fields of knowledge and professions of a technological nature, with scientific foundation and research.

These institutions will be able to offer and develop training programs up to the professional level, only for propedeutic cycles and in the areas of engineering, information technology and administration, provided they are derived from the programs of technological training which they offer, and subject to compliance with the requirements set out in this Law.

ARTICLE 3o. TRAINING CYCLES. The technical and professional technical institutions of higher education will organize their undergraduate training activities in propedeutic cycles of training in the areas of engineering, the technology of the information and administration, as well:

a) The first cycle, will be oriented to generate competencies and intellectual development such as the skills, skills and skills by providing the necessary technical knowledge for the job performance in an activity, in specific areas of the productive and service sectors, which will lead to the title of Professional Technician in ..

Professional technical training includes tasks related to technical activities that can be performed autonomously, enabling to behave programming and coordination responsibilities;

b) The second or cycle, will offer a common basic training, which is based on the scientific knowledge and the theoretical understanding for the formation of an innovative and intelligent thinking, with the capacity to design, build, to execute, control, transform and operate the means and processes that must favor the action of man in the solution of problems demanded by the productive and service sectors of the country. Technological training includes the development of conception, management and management responsibilities in accordance with the specificity of the program, and will lead to the degree of Technologist in the respective area;

c) The third cycle, will complement the second cycle, in the respective area of knowledge, in a coherent manner, with the theoretical foundation and the methodological proposal of the profession, and must make explicit the principles and purposes that the orientate from an integral perspective, considering, among other aspects, the characteristics and competences that the future professional is expected to possess. This cycle allows for the autonomous exercise of high-level professional activities, and implies the mastery of scientific and technical knowledge and will lead to the professional title in ..

The professional and technological technical institutions of higher education in a manner consistent with the training achieved in each cycle, will be able to offer programs of specialization in a specific field of the technical, technological and/or professional area. ARTICLE 4. OF THE TITLES. Professional technical institutions and technological institutions will grant the titles corresponding to the programs that they can offer in accordance with this law in accordance with the Law 30 1992 and Law 115 of 1994.

ARTICLE 5o. THE TRANSFER OF STUDENTS. All Institutions of Higher Education, for the purpose of training the System of Higher Education when regulating, in the use of its responsible autonomy, the criteria for the transfer of students and (a) the training programmes shall be adopted in accordance with the procedures for the student mobility of those who have completed technical and professional technical programmes, taking into account the recognition of diplomas awarded by the system institutions.

ARTICLE 6o. OF THE ARTICULATION WITH THE TECHNICAL AVERAGE. The professional technical institutions, despite the curricular development that they achieve through the propedeutic cycles, will maintain the technical level in the different programs that offer for (a) to enable students to complete their secondary basic education and wish to start their career in higher education in a technical career; in the event that these students opt for the technological cycle in the future; and/or professional must graduate as a bachelor.

Professional technical institutions, in the use of their responsible autonomy, shall set the criteria for the approval or validation of curricular content to those who have completed their studies of secondary education in technical colleges, taking into account the recognition of diplomas awarded by the institutions of the system.

CHAPTER II.

QUALITY ASSURANCE OF TECHNICAL AND TECHNOLOGICAL HIGHER EDUCATION.

ARTICLE 7o. OF THE REQUIREMENTS FOR THE ENTRY INTO HIGHER EDUCATION TECHNICAL, TECHNOLOGICAL AND PROFESSIONAL TECHNICAL EDUCATION. They are requirements for the entry into the different programs of Higher Education and professional technology for cycles, in addition to the to point to each institution, the following:

a) Poseer bachelor's degree or its equivalent abroad and have submitted the State exam for entry to Higher Education;

(b) For the specialization programmes referred to in the field of technology and technology and for specializations of the professional field, possess technical, technological or professional qualifications.

They may also be able to enter vocational technical training programs in higher education institutions empowered to do so in accordance with this law, who meet the following requirements:

a) Having completed and approved secondary basic education in its entirety and being greater than ten and six (16) years, or

b) You have obtained the Certificate of Professional Aptitude (CAP) issued by the National Learning Service (Sena).

ARTICLE 8o. THE OFFERING AND DEVELOPMENT OF HIGHER EDUCATION ACADEMIC PROGRAMS. To be able to offer and develop a professional technical, technological, and professional training program undergraduate, or specialization, new or operational, requires obtaining qualified registration of the same. ARTICLE 10. OF THE CURRENT PROGRAMES. The professional technical institutions and the Technology Institutions may continue to offer and develop the academic programs that are registered in the National System of Information from Higher Education, or which is being processed, obtain the respective one. Once the respective minimum standards of quality are issued, they will have to make the programs more compliant.

ARTICLE 11. 62 of Law 962 of 2005. The new text is as follows: > Technical and professional technical institutions by their nature are the institutions of higher education called to lead the technical and technical training in the country, and to respond with quality the demand for this type of training.

However, technical and professional technical institutions will be able to offer professional programs only through propedeutic cycles, when they are derived from technical and technological training programs. To this end, they must obtain the qualified registration for each of the cycles that the program integrates.

The registration granted to a program structured in propedeutic cycles will be considered as a unit being necessary for its operation to preserve the cycles as recorded in the National System of Information of Education Superior, SNIES.

CHAPTER III.

ACADEMIC CHARACTER CHANGE AND REDEFINITION OF TECHNICAL AND PROFESSIONAL TECHNICAL HIGHER EDUCATION INSTITUTIONS.

ARTICLE 13. ACADEMIC CHANGE OF PROFESSIONAL AND TECHNOLOGICAL TECHNICAL INSTITUTIONS IN UNIVERSITY INSTITUTIONS OR TECHNOLOGICAL SCHOOLS. The technical and professional technical institutions may request the Minister of National Education, through the Colombian Institute for the Promotion of Higher Education, ICFES, recognition of the change of their academic character to a university institution or a technological school, as long as they meet the requirements established by the National Government, in accordance with the provisions of Law 30 of 1992, the decrees regulations of the same and this law.

ARTICLE 14. THE REDEFINITION OF TECHNICAL AND PROFESSIONAL TECHNICAL HIGHER EDUCATION INSTITUTIONS. The technical and professional technical institutions as defined in this law that decide to offer training for courses propedeuticos will be able to request the Minister of National Education, through the Colombian Institute for the Promotion of Higher Education, ICFES, the recognition of the statutory reforms that redefine them in accordance with the first, second and third articles of this law as long as they meet the requirements established by the National Government.

ARTICLE 15. OF THE REQUIREMENTS FOR THE RECOGNITION OF THE NEW ACADEMIC CHARACTER OF TECHNICAL AND PROFESSIONAL TECHNICAL INSTITUTIONS, OR THEIR REDEFINITION AND EVALUATION CRITERIA. The Ministry of National Education, no longer than one year from the time from the issuance of this law, with the technical support of the Colombian Institute for the Promotion of Higher Education ICFES, of the academic community and the productive sector of the country, will define the minimum requirements that must be met professional and technological technical institutions wishing to redefine or change their academic character of the University Institutions or Technology Schools, and the criteria for their evaluation in the process referred to in the previous articles, which will be taken into account by both the institutions and those who carry out the assessment of the information submitted by the institutions.

The regulations that the National Government may issue for this purpose shall include at least the following assessment requirements or criteria:

(a) A clear formulation of its institutional mission, in a consistent and relevant manner in accordance with the provisions of the first, second and third articles of this law or of the new academic character in the terms of Law 30 of 1992;

b) Institutional Educational Project: As a fundamental reference to the decision-making processes in the field of teaching, extension, research and international cooperation, it incorporates strategies for the promotion of integral training in the context of technical, technological and professional knowledge, which expresses the concern to build an academic community in an adequate environment of well-being;

c) Existence of academic policies that integrate teaching, research and extension into the formative process;

(d) Disenos of curricula consistent with social and academic relevance;

e) A proper academic physical structure that gives the institution the identity with the observance of quality criteria;

f) Sufficient, appropriate and relevant academic support resources with the nature of modern technology programs and advances;

g) Financial consolidation as regards the shaping of your assets and your administration;

h) Academic and administrative organization within the principles of efficiency, effectiveness and economy;

i) Self-assessment and self-regulatory processes;

j) Projection of institutional development through a short-and medium-term strategic plan.

ARTICLE 16. THE VERIFICATION OF REQUIREMENTS. The verification of the requirements laid down in this law for the recognition of the new academic character of the technical and professional technical institutions or redefinition thereof shall be the position of the Consultative Commission of Institutions of Higher Education or of the body that does its times, with the technical support of the Colombian Institute for the Promotion of Higher Education, ICFES, which will have the task of issuing, with destination to the Minister of National Education the respective technical concept. The Minister of National Education shall issue the administrative act of recognition of the change of academic character or the corresponding statutory reform approval as the case may be.

The process of verifying requirements for the change of academic character or redefinition of technical and professional technical institutions may not exceed ten and eight months, counted from the moment of complete radication. of the documentation at the Colombian Institute for the Promotion of Higher Education, ICFES. This term has not been decided on the application, the positive administrative silence will be configured, and the cause of misconduct for the failure of its functional duty, for the public servants who had to promote and decide the process.

PARAGRAFO. The Minister of National Education, has set the process of verifying the requirements of the article 20 of Law 30 of 1992 which will be in charge of the Commission Consultative of Higher Education Institutions, may recognize as Universities the University Institutions or Technology Schools that demonstrate compliance with all the requirements established in the current legal norms. This procedure may not exceed twenty-four (24) months, counted from the moment of complete documentation at the Colombian Institute for the Promotion of Higher Education, ICFES. This term has not been decided on the application, the positive administrative silence will be configured, and the cause of misconduct for the public servants who had to promote and decide the process, for the failure of their duty functional.

ARTICLE 17. CONTROL AND SURVEILLANCE. Technical and professional technical institutions shall be subject to inspection and surveillance, in accordance with Article 189, numerals 21, 22 and 26 of the National Constitution.

CHAPTER IV.

PUBLIC INSTITUTIONS.

ARTICLE 18. PUBLIC OR STATE INSTITUTIONS. State or official higher education technical and professional technical institutions are public establishments in accordance with Article 57 of the Law 30 of 1992 and the change of its academic character or redefinition thereof shall be carried out by means of the processing and fulfilment of the requirements laid down in Chapter III of this Law, and the other rules which modify it, They regulate without this implying change in their legal nature.

ARTICLE 19. OF THE TRANSFORMATIONS. University institutions or State Higher Education Technology Schools or officers are public establishments in accordance with Article 57 of Law 30 of 1992 and the change of its academic character to Universidad corresponds to the Congress of the Republic, to the Departmental Assemblies, or to the municipal or district councils or to the territorial entities that have created them, at the initiative of the Government National or territorial executive as the case may be, in accordance with the provisions of Articles 150 numeral 7 and 154 of the Political Constitution and in article 142 numeral 3 of the Law 5a. In 1992, after verification of compliance with the following requirements:

a) Experience in high-level scientific research;

b) Academic programs and also programs in Basic Sciences that support the former;

c) Consolidation in aspects of academic quality, physical, economic and administrative development;

(d) Those established by the National Government in accordance with the powers laid down in Article 20 literal (c) of Law 30 of 1992.

ARTICLE 20. VALIDITY. This law governs from its enactment and repeals all rules that are contrary to it.
