DECRETA:

ARTICLE 1o. Effective the following addition in the revenue and capital resources budget for the fiscal year of 2001, in the sum of FIVE BILLION. FORTY-THREE THOUSAND SEVEN HUNDRED AND EIGHTY PESOS LEGAL CURRENCY ($5,102,055.943,780), according to the following detail:

ARTICLE 2o. Addition to the Expenditure Budget for the fiscal year 2001 in the sum of FIVE BILLION AND FIVE BILLION NINE HUNDRED AND FORTY-THREE THOUSAND SEVEN HUNDRED AND EIGHTY PESOS LEGAL ($5.102.055.943,780) according to the following detail:

ADDITIONS TO THE NATION ' S GENERAL BUDGET 2001

ARTICLE 3o. Contraccredit the General Budget of the Nation for the fiscal year 2001, in the sum of TWO HUNDRED THOUSAND FOUR HUNDRED AND NINE MILLION FIVE HUNDRED AND THIRTY-FOUR THOUSAND EIGHT HUNDRED SIXTY-NINE PESOS LEGAL CURRENCY ($201.409.534,869) according to the following detail:

ARTICLE 4. Based on the resources that the previous article deals with, open the following credits in the General Budget of the Nation for the fiscal year 2001, in the sum of two hundred and one thousand FOUR HUNDRED AND NINE MILLION FIVE HUNDRED AND THIRTY-FOUR THOUSAND EIGHT HUNDRED AND SIXTY-NINE PESOS LEGAL CURRENCY ($201.409.534,869) according to the following detail:

CREDITS TO THE GENERAL BUDGET OF THE NATION 2001

ARTICLE 5o. Substitute in the Nation's Capital Resources and Resources Budget the sum of NINE HUNDRED AND FORTY BILLION PESOS LEGAL CURRENCY ($940,000,000,000), of domestic credit income by external credit income.

Replace the sum of FIVE HUNDRED AND THIRTY MILLION PESOS LEGAL CURRENCY ($530,000,000), from the revenue of the external credit for internal credit income, in the Budget of the Rentas and Resources of the Nation.

Replace the sum of THOUSAND FOUR HUNDRED MILLION PESOS LEGAL CURRENCY ($1,400,000,000), income from external credit for donations

donations, in the Budget of Rentas and Resources of the Nation.

Replace in the Nation's General Archive's Rent and Capital Resources Budget, the sum of TWENTY-FOUR MILLION PESOS LEGAL ($24,000,000) of capital resources for current income.

The Ministry of Finance and Public Credit-Directorate General of the National Budget-in use of the power granted by Decree 568 of 1996 will make corrections to the resources and their corresponding codes, which are of a nature information.

ARTICLE 6o. Substitute in the investment expense budget of the Comptroller General of the Republic, the sum of FIVE HUNDRED AND THIRTY MILLION PESOS LEGAL CURRENCY ($530,000,000) of credit resources external with specific destination for other treasury resources.

Replace in the investment spending budget of the Institute of Hydrology, Meteorology and Environmental Studies -IDEAM, the sum of THOUSAND FOUR HUNDRED MILLION PESOS LEGAL ($1,400,000,000) of resources from the external credit with destination specific donations authorized.

Replace in the investment spending budget of the Nation General Archive, the sum of TWENTY-FOUR MILLION P THOSE LEGAL CURRENCY ($24,000,000) of other treasury resources for current income.

Replace in the investment spending budget of the National Administrative Department of Planning, the sum of THREE HUNDRED AND THIRTY-FIVE MILLION SEVENTY-SIX THOUSAND FIVE HUNDRED PESOS LEGAL CURRENCY ($335,076,500) of credit resources external to external credit resource-specific destination prior authorization.

Substitute in the investment spending budget of the Agustín Codazzi-IGAC Geographic Institute, the sum of BILLION PESOS LEGAL ($1,000,000,000) of external credit resources with specific destination for credit resources prior to authorization.

Replace in the budget of the National Public Foreign Debt Service, the sum of TWO THOUSAND THIRTEEN MILLION TWO HUNDRED AND EIGHT THOUSAND PESOS LEGAL CURRENCY ($2,013,208,000) of external credit resources prior to authorization by credit resources external with specific destination.

Replace in the investment spending budget of the National Institute of Vias-INVIAS, the sum of SEVENTY-EIGHT MILLION SIX HUNDRED AND SIXTY-FOUR THOUSAND SEVEN HUNDRED AND TWENTY PESOS LEGAL CURRENCY ($78,664,720) of external credit resources with specific destination authorized by external credit resources prior to authorization.

Replace in the operating expenses budget of the Ministry of Justice and Law, the sum of FOUR HUNDRED AND FIFTY-FIVE MILLION SIX HUNDRED AND FORTY THOUSAND PESOS LEGAL CURRENCY ($455.640,000) of donations for donations internal.

Replace in the operating expenses budget of the Special Administrative Unit Tax and National Customs Directorate, the sum of THREE THOUSAND FOUR HUNDRED AND EIGHTY MILLION FOUR HUNDRED AND TWENTY-NINE THOUSAND FOUR HUNDRED AND EIGHTY-SEVEN LEGAL CURRENCY PESOS ($3,480,429,487) of donations for internal donations.

Replace in the operating expenses budget of the Financial Information and Analysis Unit, the sum of TWO HUNDRED AND FORTY-SIX MILLION SIXTY THOUSAND AND SEVEN PESOS LEGAL CURRENCY ($246,060.087) of donations for donations internal.

Replace in the operating expenses budget of the Office of the Prosecutor General of the Nation, the sum of THREE HUNDRED AND NINETY-EIGHT MILLION THREE HUNDRED AND SIXTY-ONE THOUSAND THREE HUNDRED AND FORTY-SIX PESOS WITH TWENTY-SIX CENTS LEGAL CURRENCY ($398,361,346.26) of donations for internal donations.

The Ministry of Finance and Public Credit-Directorate General of the National Budget, in use of the power granted by Decree 568 of 1996, will make corrections to the resources and their corresponding codes, which are of a nature information.

ARTICLE 7o. Adjust the Capital Resources and Resources Budget in the sum of TWO BILLION PESOS LEGAL CURRENCY ($2,000,000,000,000), stemming from the tax reform contained in the href="ley_0633_2000.html#1"> 633 , 2000, to balance the Revenue Budget with the expense budget, as follows:

ARTICLE 8o. Substitute in the Budget of Rentas and Resources of Capital of the Nation the sum of TWO HUNDRED AND FIFTY-SEVEN THOUSAND EIGHTY-SIX MILLION EIGHT HUNDRED AND TWENTY-TWO THOUSAND FOUR HUNDRED PESOS LEGAL ($257,086,822,400), from Special Funds for current income from the Nation.

ARTICLE 9o. The commitments acquired from the available appropriations that cover the following fiscal convergence do not require the authorization of future vigencies. For this purpose, budget reserves should be set up.

ARTICLE 10. When an organ requires commitments to cover several fiscal vigencies, it must obtain authorization to commit future vigencies.

ARTICLE 11. Delete the 3o incites. and 5o. of article 13, article 15, the other that says "until June 30, 2001" and paragraph 2o.of article 22, the article 36 and article 63 of Law 628 of 2000.

ARTICLE 12. The National Government will be able to allocate resources from the National Budget to the Social Security Fund of the Magisterium for the payment of pensions. These resources will be part of the review of the Court of Auditors ' Law 91 of 1989, once the respective law authorizing such review is issued.

ARTICLE 13. The National Government, under the appropriations of this fiscal force, may grant credits that may be condonable to the Social Insurance Institute, in order to support the payment of the payroll and of the retirees of the ISS, strengthening of the internal network, obligations under the Institute for the acquisition of goods and services in health, under the conditions established by the General Directorate of Credit Public. Failure to comply with these conditions shall result in the enforceability of the claims.

ARTICLE 14. The financial surpluses to be transferred by INDUMIL to the Nation for the year 2000 will be executed without a fund by the Ministry of National Defense in accordance with the appropriations that are incorporated into this law for the purpose, prior to the implementation of the budgetary rules.

ARTICLE 15. The financial returns, which have generated funds destined for works and that have a royalty origin, will be invested in the respective work without there being any reintegration, if proven which were duly invested for the same purposes.

ARTICLE 16. Modify Article 110 of Law 633 of 2000, which will remain so:

FINDETER will transfer annually to the Nation the proceeds of the debt collection of municipalities and utilities with INSFOPAL, carried out according to Law 57 of 1989, resources that will be used in its entirety, to the financing of the Program Business Modernization for the sector of drinking water and basic sanitation implemented by the Ministry of Economic Development, and the structuring of the business modernization projects, including the payment of the liabilities that guarantee the integral viability of the same.

ARTICLE 17. The additional approved in 2001 for the restructuring of hospitals for the sum of 50 billion pesos, are condonable resources for the hospitals that comply with the agreements of the performance signed between these hospitals and the Ministries of Health and Finance.

ARTICLE 19. Under the Ministry of Education for $5 billion, which is intended to "support the universities" (transfers), authorize it to be distributed among the universities of Cundinamarca, Cartagena-Atlantico-U.I.S.-Sucre, Cauca and Cordoba, in attention to the efforts they are making to overcome the deficit they face, and the respective agreement.

ARTICLE 20. Name a commission composed of a member of each of the economic commissions to monitor the destination and prioritization of the items comprising the present addition bill The budget in the amount of 77,000 million pesos for the FOREC.

ARTICLE 21. For procurement contracts for goods and services and for interadministrative contracts that are signed before December 31, 2001, the entities that are part of the General budget of the Nation will constitute the respective budget reserves in terms of the article 89 of the Organic Law of the Budget.

For the purposes provided for in this article, in the case of the Ministry of National Defense, the Military Forces, the National Police, the Administrative Department of Security, DAS, and the National Penitentiary Institute, INPEC, it will be commitment to the opening of the tendering procedure, the merit contest or any other contractor selection process in the terms set out in the rules in force.

ARTICLE 22. They constitute operating expenses of the Banking Superintendence, the sums that it transfers to the Social Security Fund of the Banking Superintendence-Capregb, to pay for the payment of the services that the latter entity lends to the Superbank, according to the law.

ARTICLE 23. Consider, for the purposes of the application of Article 133 of Law 633 of 2000, the debt for electricity supply, for services directly provided by the municipalities or producer departments with rights in the Oil Savings and Stabilization Fund and by the municipalities and non-producer departments, in the areas of health, primary and secondary basic education, drinking water and basic sanitation and public lighting.

The payment of the debts referred to in the preceding paragraph shall be made up to the amount of the obligations in force on 29 December 2000.

The municipalities or producers ' departments with rights in the Oil Savings and Stabilization Fund and the municipalities and non-producer departments shall have as the maximum time limit for the filing of the documents that bear the debts to which refers to this Article, until 17 December 2001, subject to the other requirements and conditions laid down in Decree 1939 of 2001.

The municipalities or producer departments with rights in the Oil Savings and Stabilization Fund and the municipalities and non-producer departments, with the available balance of their rights in the FAEP or the quota allocated as a municipality or Non-producer department as set out in Articles 9 and 10 of Decree 1939 of 2001, may cancel the debts referred to in this Article, provided that they have strictly complied with the prepayments established in the numeral 2 of Articles 7o. and 10 of the decree 1939 of 2001, respectively.

ARTICLE 24. Include in section 2201, program 113, subprogram 700, Universidad Francisco de Paula Santander Ocana.

ARTICLE 25. This law governs from the date of its publication.
