Having regard to the text of the "Protocol of Amendment to the Treaty of Amazonian Cooperation", made in Caracas, on the fourteen (14) of December of a thousand nine hundred and ninety-eight (1998), which the letter says:

" TREATY AMENDMENT PROTOCOL

AMAZON COOPERATION

The Republics of Bolivia, Brazil, Colombia, Ecuador, Guyana, Peru, Suriname and Venezuela,

Reaffirming the principles and objectives of the Amazon Cooperation Treaty,

Considering the desirability of perfecting and strengthening, institutionally, the process of cooperation developed under the aegis of the said instrument,

AGREE:

I-Create the Organization of the Treaty of Amazon Cooperation (OTCA), with legal personality, being competent to conclude agreements with the Contracting Parties, with non-member States and with other international organizations.

II-Amend, in the following form, Article XXII of the Treaty:

The Organization of the Treaty of Amazonian Cooperation will have a Permanent Secretariat based in Brasilia, which is responsible for implementing the objectives provided for in the Treaty in accordance with the resolutions emanating from the meetings of Ministers of Foreign relations and the Amazon Cooperation Council.

Paragraph 1a. The powers and functions of the Permanent Secretariat and its holder shall be laid down in its Rules of Procedure, which shall be approved by the Foreign Ministers of the Contracting Parties.

Paragraph 2a. The Permanent Secretariat shall draw up, in coordination with the Contracting Parties, its work plans and programme of activities, as well as formulate its budget-programme, which shall be approved by the Amazon Cooperation Council.

Paragraph 3a. The Permanent Secretariat shall be headed by a Secretary-General, who may conclude agreements, on behalf of the Organization of the Treaty of Amazonian Cooperation, when the Contracting Parties so authorize by unanimity.

III-This amendment shall be subject to compliance with the internal constitutional requirements by all Contracting Parties and shall enter into force on the date of deposit with the Government of the Federative Republic of Brazil, of the last note in which it is communicated that these constitutional requirements were met.

DECRETA:

ARTICLE 1o. Approve the "Protocol of Amendment to the Treaty of Amazonian Cooperation", signed in Caracas, on the fourteenth day (14) of December of a thousand nine hundred and ninety-eight (1998).

ARTICLE 2o. In accordance with the provisions of Article 1 of Law 7a of 1944, the "Protocol of Amendment to the Treaty of Amazonian Cooperation", signed in Caracas, on the fourteenth day of December nine hundred and ninety-eight (1998), which under article 1or this law is approved, will force the country from the date on which the international link with respect to it is perfected.

ARTICLE 3o. Authorize the National Government to pay for the payment of annual contribution from Colombia to the expenses related to the operation of the Amazon Cooperation Treaty Organization, OTCA, in the terms of the Organic Statute of the Budget.

ARTICLE 4. The costs that the application of the "Protocol of Amendment to the Treaty of Amazon Cooperation" will cause must be subject to the budgetary appropriations that for the effect are authorized in the respective Annual Budget Law.

ARTICLE 5o. This law governs from the date of its publication.
