COLOMBIA CONGRESS

For which the system and methods are set for the Colombian Institute for the Promotion of Higher Education, Icfes, to set rates for the services it provides and other provisions are dictated.

DECRETA:

ARTICLE 1o. Authorize the Colombian Institute for the Promotion of Higher Education Icfes or whoever does its times, to define and collect the fees corresponding to the costs of the services provided by him.

ARTICLE 2o. The Icfes or whoever does their time may charge for the provision of the following services:

(a) The conduct of examinations for educational mediation and evaluation, as well as the processing and production of results, the issuance of diplomas, certificates and duplicate results;

(b) Studies leading to the creation of higher education institutions, recognition of the legal status of private institutions of higher education, the authorization of the creation of sectionals, the recognition of institutional as a university and the modification of the academic character;

c) The issuance and modification of the records for the offering and development of academic programs of undergraduate and postgraduate, except those presented in the process of recognition of legal status of private institutions of higher education, and the creation of official higher education institutions.

State or official higher education institutions that are neglected two percent (2 percent) of contributions that they receive from the national budget for any concept will be exempt from the payments referred to in this literal, up to the amount of the resources contributed by this concept.

d) The issuance of records related to records;

e) The issue of copies in printed or magnetic media of the information contained in the archives and documentary bases of the institute or in those consulted remotely from the institute;

f) Documentary, bibliographic or interlibrary consultations to be carried out through the National University Hemeroteca, through national or international networks;

g) The assignment of the International Serial System Number, ISSN.

(h) The legalization of documents issued by Colombian institutions of higher education, to be accredited abroad, the approval of studies, and the validation of certificates issued or obtained abroad.

ARTICLE 3o. The basis for the settlement of the tariffs will be the cost of the services defined in the previous article.

ARTICLE 4. The rates will be set at daily or monthly minimum legal wages in force.

In the case of the services referred to in point (c) of article 2or. of this law, such tariffs shall be concerted with the legally authorized higher education associations. If a joint agreement is not reached in the first month of the respective validity, the Icces or whoever does its times will be forced to fix them according to the provisions of article 95 the Political Constitution.

With them, we will look for the full or partial recovery of the costs of services provided by the Icfes or who does its times, for which the following technical guidelines will be used, taking into account the costs of the operations and the costs of the technology programmes:

a) Elaboration and normalization of flujograms for different processes for the purpose of determining their routines;

b) Quantification of materials, supplies and other technological and human resource inputs, used, annually, in each of the processes and procedures defined in the previous literal. These inputs should include percentages of the general administration costs of the Icces or who do their times quantified according to accepted standards and principles of cost accounting;

c) Market price valuation of the inputs described in the previous literal for each of the processes and procedures. Where one of the procedures is to be contracted with third parties, the value of the contracted service shall be taken;

(d) Assessment of the human resource used directly in the provision of service, based on the salaries and benefits of the staff plant of the Icces or who does its own times as well as the value of the contracts to be concluded for the effect;

e) Quantification of the costs and programs of technology and modernization of the operation of the services;

f) Estimation of the frequencies of use of the services. The frequency is understood as the number of operations or executions of each of the services provided by the Icfes or who does its times.

PARAGRAFO 1o. Both the definition of procedures and the quantification of costs must be performed under maximum efficiency parameters, taking into account the principles set out in the General Accounting Plan. Public.

PARAGRAFO 2o. The Icfes or whoever does their time to encourage democratization in access to higher education, will set the rates of the state examination for higher education income based on ranges that respond to the socio-economic conditions of grade 11 students according to the monthly value of the school pension reported by each educational institution.

ARTICLE 5o. The system for defining tariffs is a system of standardized costs, in which the assessment and weighting of the factors involved in its definition will be carried out by means of technically accepted costs.

The rate for each of the services provided listed in 2or. of this law, shall be the result of adding the value of the inputs and the human resources used, in accordance with the literals (c), (d) and (e) of Article 4, divided by the frequency of use of which treats the literal f) of the same article.

ARTICLE 6o. The payment of the fees shall be borne by the natural or legal person who requests the provision of the services offered by the Icfes or who does his or her times.

ARTICLE 7o. The collection corresponding to the rates authorized by this law, will be carried out by the Colombian Institute for the Promotion of Higher Education, Icfes or whoever does its own times. Its total amount shall be intended to cover the expenses incurred by the institution for the performance of the functions assigned by the law, without prejudice to the other resources assigned to it.

ARTICLE 8o. The user will credit the payment of the set rate at the time of filing with the Icfes or who does his/her times.

ARTICLE 9o. Failure to comply with the deadlines set by the law, the procedures of the services that the user requests to the Icfes or who does his or her times, will be a cause of misconduct for the person responsible or responsible for such non-compliance.

ARTICLE 10. This law governs from the date of its enactment.
