DECRETA:

TITLE I.

PRACTICING THE PROFESSION OF TECHNOLOGIST AT

ELECTRICITY, ELECTROMECHANICAL, ELECTRONICS AND RELATED

ARTICLE 1o. 78 of Law 842 of 2003 > Technologist in electricity, electromechanical, electronic or related is the professional graduate of a program of technological education, duly recognized and approved by the Ministry of National Education, and offered by a university, university institution or technology school, who is trained to install, operate and maintain facilities and equipment related to their respective area.

PARAGRAFO. The technology according to Law 30 of December 28, 1992, in its article 7or and 14 literal b), 18 , and 25 is considered a profession.

ARTICLE 2o. 78 of Law 842 of 2003 > For the purposes of this law, it is considered as branches or related professions of the technology in electricity, electromechanical, electronic:

a) Technology in electricity and telephony;

b) Technology in electrification and rural telephony;

c) Technology in industrial instrumentation.

PARAGRAFO. The National Council of Technology in Electricity, Electromechanical, Electronics and Aends, will be able to extend the coverage to new technological professions related to this branch, whose programs are approved by the Ministry of National Education and regulated by CESU.

ARTICLE 3o. 78 of Law 842 of 2003 > It is lawful the free exercise of the Profession of Technologist in Electricity, Electromechanical, Electronic and Finnish in the national territory and in all the countries that subscribe treated with Colombia, in equal conditions and within the terms of these.

ARTICLE 4. 78 of Law 842 of 2003 > Only the Profession of Technologist in Electricity, Electromechanical, Electronic and Purposes can be exercised by those who obtain the professional registration that must be issued by the National Council of Technologists.

ARTICLE 5o. 78 of Law 842 of 2003 > Regarding requirements for the exercise of the profession, the rights acquired legally prior to the validity of this law shall be respected.

ARTICLE 6o. 78 of Law 842 of 2003 > They will not be valid for the exercise of the Profession of Technologist in Electricity, Electromechanical, Electronic and Finnish, the titles obtained in institutions that procedures other than those provided for in Article 1or this law.

TITLE II.

OF THE REQUIREMENTS TO PRACTICE THE PROFESSION OF TECHNOLOGIST

IN ELECTRICITY, ELECTROMECHANICAL, ELECTRONICS, AND RELATED

ARTICLE 7o. 78 of Law 842 of 2003 > May only exercise the Profession of Technologists referred to in Article 1or of this law and those who meet the following requirements:

a) Having graduated from a university, university institution, technology school and technological institution approved by the State, in accordance with the laws and regulations;

b) Enroll the title in the National Council of Technologists in Electricity, Electromechanical, Electronic, and Finnish registration;

c) Obtain the professional registration by the National Council of Technologists in Electricity, Electromechanical, Electronics and Purposes;

d) Not be disabled by sanction arising from the exercise of the profession.

TITLE III.

PROFESSIONAL PERFORMANCE

ARTICLE 8o. 78 of Law 842 of 2003 > Professional registration of Technologist in Electricity, Electromechanical, Electronic and Purposes, grants the full right for the professional exercise.

ARTICLE 9o. 78 of Law 842 of 2003 > Technologists in Electricity, Electromechanical, Electronic and Tuition Fees, in accordance with this law, may register as such and contract with the entities In the case of the Joint Economic and Social Committee, the

ARTICLE 10. 78 of Law 842 of 2003 > From the validity of this law, the Nation, the departments and municipalities, as well as their decentralized entities, in approving their respective structures administrative, will determine the charges that require to be exercised by technologists specifying the specialties.

PARAGRAFO. The Colombian Association of Technologists, through the Sectional Associations, will develop the monitoring and surveillance mechanisms to comply with this article.

ARTICLE 11. 78 of Law 842 of 2003 > The National Government will regulate the requirements for obtaining the Professional Matriculation of Technologists in this law contemplated; in any case the presentation will be required of the original of the title obtained in their respective specialty, in a university, university institution or technological school and technological institution, legally approved by the ICFES and/or CESU.

TITLE IV.

THE NATIONAL PROFESSIONAL TECHNOLOGY COUNCIL

IN ELECTRICITY, ELECTROMECHANICAL, ELECTRONICS, AND RELATED

ARTICLE 12. The inspection and surveillance of these professions will be carried out by the National Professional Council attached to the Ministry of National Education.

ARTICLE 13. The National Professional Council will be integrated as follows:

a) 64 of Law 962 of 2005 > Un (1) representative of the Ministry of Education;

b) One (1) representative of universities and university institutions or technology schools and private technology institutes;

c) One (1) representative of Aciem (Association of Electronic, Electrical and Finnish Engineers);

d) Two (2) representatives of the Technology Associations of this area.

PARAGRAFO. The representative of the university, university institution, technology school or technology institute is either official or private, and must be a graduate of an institution that contains programs in technology to the which is referred to in this law.

ARTICLE 14. The National Council of Technologists in Electricity, Electromechanical, Electronics and Purposes, will have the following functions:

a) Vellar for compliance with this law and subsequent regulatory standards;

b) Take the National Register of Technologists with professional registration;

c) Exorder provisional permits for the exercise of the profession referred to in this law, to foreign personnel who for some reason require the development of work in our country;

d) Promote the issuing of standards on ethics of the professions referred to in this law, within ninety (90) days after the law is sanctioned;

e) Promote and sponsor congresses and seminars in order to raise the scientific level;

f) Grant the professional license plates to the technologists who are dealing with this law;

g) Exorder your own internal operating rules.

ARTICLE 15. The Sectional Councils of Technologists in Electricity, Electromechanical, Electronics and Purposes will be integrated as follows:

a) By the governor of the department or his representative, who should preside over it;

b) A rector of the university, university institution or technology school and official or private institution;

c) Three (3) representatives of the Associations of Technologists in Electricity, Electromechanical, Electronics and Purposes.

ARTICLE 16. The Sectional Councils of Technologists in Electricity, Electromechanical, Electronics and Purposes, will have the same functions of the National Council.

PARAGRAFO. For Sectional Councils to be able to issue the respective tuition, they require confirmation from the National Professional Council.

TITLE V.

SANTIONS

ARTICLE 17. 78 of Law 842 of 2003 > In addition to the civil and criminal penalties to which there is a place, the violators of the provisions herein shall apply those prescribed in their decrees regulations.

TITLE VI.

VARIAS PROVISIONS

ARTICLE 18. 78 of Law 842 of 2003 > The resources to meet the expenses required by the National Council and the Sectional Councils, to comply with this law will be obtained from the funds that are collect by way of donations, contributions, registrations and other resources that come from the development of their functions.

ARTICLE 19. 78 of Law 842 of 2003 > To be held in a public office whose performance requires this professional prototype, you must be required to submit your respective professional registration.

ARTICLE 20. 78 of Law 842 of 2003 > For all purposes of the administrative career, consideration will be given to what is dealt with in Article 213 of the General Law of Education.

ARTICLE 21. 78 of Law 842 of 2003 > For the term of twelve (12) months counted from the validity of this law and while the National Council and the Sectional Councils, the Ministry of Education may be issued on a provisional basis.

ARTICLE 22. This law governs since its promulgation and repeals the provisions that are contrary to it.
