For which the exercise of the profession of statistician recognized by the Ministry of National Education is regulated.

COLOMBIA CONGRESS

DECRETA:

ARTICLE 1o. For all legal purposes, understand by exercise of the Statistics, the application of knowledge and means of sciences, mathematics, computer science and humanities in the analysis, administration, management, supervision and process control in which the collection, ordering, evaluation, control, capture and criticism of the information is carried out in the design of mathematical, economic and administrative models use in any public, private, university, entity dedicated to the research that you need from this process to make decisions.

ARTICLE 2o. Who, within the territory of the Republic of Colombia, exercises or decides to pursue the profession of statistician, must prove its training and professional suitability by presenting the respective State title, conferred by any Colombian University, recognized and authorized, for the purpose, by the Government of the Nation.

PARAGRAFO. Those who have obtained or obtained professional title from the State abroad, for the validity of the professional title will be governed for this effect by Decree 2150 1995.

ARTICLE 3o. They are legally authorized to obtain the certificate of technologist in statistics of the Professional Council of Statistics who credit their training and professional suitability through the presentation of the respective degree of technologist in statistics, conferred by any university or university institution.

ARTICLE 4. They are prevented from using the title of statistician, exercising the profession, taking responsibility and enjoying the prerogatives inherent in the exercise of statistics in the country not only those who do not comply with the above requirements, but also those who hold correspondence certificates or certificates and constances which accredit them as practical or empirical and diplomas which correspond only to incomplete curriculum or level studies inter-media.

PARAGRAFO 1o. The persons referred to in the previous article under the direction and responsibility of a statistician or a technologist in statistics may be auxiliary to statisticians. a certificate of having completed the pensum of studies of the Technical Schools of these teachings and whose curriculum has earned the approval of the National Government and the persons who have not done the necessary studies obtained a practice of at least five years as a Statistics Auxiliary.

Higher education institutions that award the title of Professional Technician in Statistics and the other Institutions that grant the certificates, constances, diplomas stipulated in the present The article shall adopt names and specifications indicating the level of study and the degree of training of the holder of the respective document.

PARAGRAFO 3o. People who have such a certificate, constances, diplomas or diplomas that credit it as statistics auxiliaries and have been obtained abroad, must submit to the Statisticians graduates in the '1', 2 or 2. and 3o. of article 2o. of this law.

ARTICLE 5o. Commercial firms intended for the processing of statistical information, including the collection, processing, analysis and dissemination of statistical results, will be required by the This law will have the technical assistance of a statistician, with a full or partial time contract, as prescribed by the Regulatory Decree.

ARTICLE 6o. The planning, direction, execution, supervision and technical control in the studies, projects and research carried out by public entities, whose function requires knowledge of statistics, be entrusted to the State with the corresponding registration number granted by the Professional Council of Statistics.

ARTICLE 7o. The Industrial or Commercial Entities or Companies, whose activities are related to the statistics, must have the services with total or partial dedication, according to the statutory decree of this law, of at least one state of Colombian nationality, which has registration or title as the case may be.

PARAGRAFO. For legal purposes of this article, entities or companies or research entities, as referred to in the previous article, are considered to be directly related to the legal effects of this article. with the exercise of the profession of Statistics referred to in Article 1. of this law and its paragraph.

ARTICLE 8o. Any entity, industrial, commercial or research company engaged in partial or wholly in the processing of statistical information shall have at least 90% of the statistics to its Colombian nationality service.

PARAGRAFO 1o. ARTICLE 9o. The heads of the dependencies related to the statistics of the official or semi-official entities involved in the country's industrial development plans shall be entitled and with registration issued by the Professional Council of Statistics.

ARTICLE 10. In proposals, tenders or public tenders for the treatment of statistical information before official or semi-official entities, the beneficiary must be at least in the 70% of Colombian States with registration issued by the Professional Council.

ARTICLE 11. Teachers linked to formal baccalaureate education, which dictate the professorships of Statistics, must be technologists in Statistics, legally recognized by the Professional Council of Statistics or persons with a minimum of three (3) years of experience in teaching and have done, at least one course on descriptive statistics at a university recognized by the ICFES.

ARTICLE 12. The respective authority will require at least one Statistician with tuition for the following charges:

(a) Technical advice concerning the evaluation of investment projects with funds from both official and semi-official and private financial institutions.

(b) Consultations or interventories of entities, industrial or commercial companies wholly or partially engaged in the processing of statistical information, conferred by the judicial or administrative authority.

c) The calculations and projections of the information through the time of the entities, industrial or commercial companies partially or totally dedicated to the processing of the statistical information.

PARAGRAFO. The authority referred to in this Article shall be that which reviews and approves the financial operations of the credit institutions established in the country and which they grant for the purposes mentioned above.

ARTICLE 13. Those without filling the requirements required by this law exercise the statistics in the country will be under the regime of sanctions that the ordinary law establishes for the illegal exercise of the professions.

ARTICLE 14. Create the Professional Statistics Council, which shall be composed of the following principal members or their respective alternates:

1. The Minister of National Education or his delegate.

2. The National Planning Director or his delegate.

3. The Director of the Dane or his representative.

4. A representative of the teaching staff of each one of the national universities with undergraduate or postgraduate programs in Statistics.

5. A representative of each of the associations of statistics.

PARAGRAFO. The representatives of the Colombian Association of Statistics and the recognized and approved universities will be qualified and enrolled statisticians.

This requirement for professional registration will not apply to the members of the first Council, and only as long as the corresponding organization and processing lasts. The members of the Professional Statistics Board shall perform their duties ad honorem and their period shall be two (2) years.

ARTICLE 15. The Professional Council of Statistics, will have its permanent seat in Santa Fe de Bogota, D. C., and its functions will be as follows:

(a) Dictate its own rules, organise its own executive secretariat and fix its forms of financing.

b) Exorder registration to professionals who fill in the requirements and take it to the corresponding professional registration and grant the respective certifications.

(c) Set the rights of issue of the professional registration and the investment budget of these funds.

d) To ensure compliance with this law by sanctioning or cancelling the registration of those who do not comply with the provisions of the Code of Professional Ethics.

e) To collaborate with associations, associations, scientific and professional associations and other organizations of statistics in the stimulation and development of the profession and the continuous improvement of the qualification and use of the State The European Research and Technological Research (EETI) programme is designed to improve the quality of life.

(f) to submit to the Ministry of National Education and other competent authorities any problems arising in connection with the illegal exercise of the profession and the compatibility or incompatibility between the titles granted in Statistics and the actual levels of education and suitability of those who hold such qualifications.

ARTICLE 16. The Professional Council of Statistics of Colombia will always count for the effective performance of its functions, with the advice of professional associations and technical scientific societies and administrative statistics that officially work in the country, as well as its affiliates or chapters, of the Colombian Association of Statistics.

ARTICLE 17. Appoint the Colombian Association of Statistics as a National Government Advisory Body in all development plans and activities related to the activities of the statistics, referred to in Article 1. of this law.

PARAGRAFO. For the development of these plans, the Presidency of the Republic, the National Directorate of Planning and the National Administrative Department of Statistics will request the consulting of the Colombian Association (a)

ARTICLE 18. The legal department of the National Planning Directorate and the National Department of Statistics will know about the failure of one or any of the articles of this law.

ARTICLE 19. This law repeals all provisions that are contrary to you.

ARTICLE 20. This law governs from your expedition.
