DECRETA:

Having regard to the text of the "Statute of the Center for Science and Technology of the Movement of Non-Aligned Countries and other developing countries", made in New York on February 4, 1985.

Preamble

The meeting of Plenipotentiaries of Non-Aligned Countries,

In compliance with the common strategy for cooperation between non-aligned countries and other developing countries;

In accordance with the decisions taken in the fields of science and technology, in the Fifth, Sixth and Seventh Conferences of Heads of State or Government of the Non-Aligned Countries, held respectively in Colombo in 1976, in La Havana in 1979 and New Delhi in 1983;

Remembering the Declaration and the Program of Action on the establishment of the New International Economic Order, as well as the Charter of Economic Rights and Duties of the States, approved by the United Nations General Assembly and the relevant provisions of the International Strategy for Development and the Caracas Action Programme;

Convinced that the essential element of the New International Economic Order is the promotion of collective self-sufficiency in developing countries;

Making an appeal for close cooperation between non-aligned countries and other developing countries in the fields of science and technology;

You have decided the following:

CHAPTER I.

ESTABLISHMENT AND HEADQUARTERS

ARTICLE 1o. Establish the Science and Technology Center of Non-Aligned Countries and other developing countries (hereinafter referred to as "the Center").

ARTICLE 2o. The Center will be based in New Delhi, India.

CHAPTER II

COMPOSITION

ARTICLE 3o. All members of the Non-Aligned Movement may be members of the Center. Other developing countries may be members of the Centre, subject to the approval of their requests by the Management Board (hereinafter referred to as "the members").

ARTICLE 4. The national liberation movements recognized as observers by the Non-Aligned Countries movement will also have the status of observers in the Center and will be able to use their services.

CHAPTER III.

OBJECTIVES AND FUNCTIONS

ARTICLE 5o. The Center will promote various measures advocated in the program of action in the field of economic cooperation and in the common strategy for cooperation in the fields of science and technology, in order to strengthen cooperation between the Non-Aligned Countries and other developing countries. The Center also:

a) Help establish links between national and regional centers for technology development and transfer;

b) Promote the widest possible and mutually advantageous collaboration between scientists and technicians and the scientific organizations of the Non-Aligned Countries and other developing countries;

c) Promote the establishment, in cooperation with national and regional centres, of a system of regular meetings and consultations of scientists and technicians from Non-Aligned Countries and other developing countries;

d) It will act as a center for information exchange regarding the technological capabilities of the various Non-Aligned Countries and other developing countries to promote technological cooperation and technology transfer between them. countries; provide, at the appropriate time, information on the imminent technological changes and seek to establish a data bank;

e) Carry out a register of senior scientific and technical experts whose services may be used by the members of the Centre;

(f) Stimulation and promote research and development projects and joint training programmes, on a bilateral or multilateral basis, among the members of the Centre in certain areas of particular importance;

g) Appoint special groups of qualified experts for the preparation of reports on the latest technological developments in relation to certain areas and problems and to provide expert advice to the members on of technology selection, as well as its scientific and technological development, including the development of human resources;

h) Will make suggestions and provide models for balanced scientific and technological development, based on optimal resource utilization;

i) Will monitor the implementation of scientific and technological development programmes that have been recommended or approved at the intergovernmental meetings of the Non-Aligned Countries and other developing countries.

ARTICLE 6o. The Center may perform other functions that may be entrusted to it by the meetings of Foreign Ministers or the Conference of Heads of State or Government of the Countries. Aligned.

ARTICLE 7o. The Center may, within the limits of its objectives and with the approval of the Board of Directors, carry out appropriate cooperation activities with the United Nations and its agencies. specialized, as well as with other governmental and non-governmental organizations.

CHAPTER IV.

STRUCTURE

ARTICLE 8o. The Center will have the following structure:

a) A board of directors composed of representatives of all members of the Center, and

b) A secretary headed by a director.

ARTICLE 9o. The regular sessions of the Board of Directors will be held once a year. Extraordinary sessions may be held at the request of at least two-thirds of the members.

ARTICLE 10. For each session of the Board of Directors, a President, two Vice-Presidents and one Rapporteur will be elected.

ARTICLE 11. The Board of Directors:

a) Set the guidelines for the work of the Center;

b) Examine and approve the Center Director's report;

c) Examine and approve the Center's work program and budget;

(d) Report on the activities of the Centre to the ministerial meetings of the Non-Aligned Countries and, where appropriate, the ministerial meetings of the Group of 77;

e) Will Approve the admission, as members of the Center, of other developing countries not belonging to the Non-Aligned Countries movement.

ARTICLE 12. The Board of Directors shall approve its rules of procedure in accordance with the decision-making procedure applied in all the bodies of the Non-Aligned Movement.

ARTICLE 13. The Director of the Center shall be appointed by the Board of Directors.

ARTICLE 14. The Center Director:

(a) Organise the Centre and draw up the rules governing its operation, for approval by the Board of Directors;

b) Be the legal representative of the Center;

c) Be responsible for the implementation of the work plan and the implementation of the guidelines established by the Board of Directors;

(d) (i) Prepare the Centre's budget and submit it to the Board of Directors for examination and approval;

ii) Management of the Center's finances will be in charge;

e) Name the staff of the Centre and shall be responsible for the day-to-day operation of the Centre in accordance with the directives of the Management Board.

CHAPTER V.

PERSONAL

ARTICLE 15. The staff of the Center shall be recruited on the basis of their knowledge and experience, taking into account the principle of geographical distribution.

CHAPTER VI.

QUOTES AND CONTRIBUTIONS

ARTICLE 16. The Center will have the following financial resources:

(a) A fixed and uniform contribution of the members to be determined by the Board of Directors each time *.

(b) Voluntary contributions of members, States, intergovernmental organizations and other persons or bodies, provided that they are accepted by the Board of Directors; and

c) Other income from your activities.

ARTICLE 17. The records, books and accounts of the Center shall be verified by an independent auditor appointed by the Board of Directors.

CHAPTER VII.

LEGAL STATUS, PRIVILEGES, AND IMMUNITIES

ARTICLE 18. The center will have legal personality. You will be able to:

a) Sign contracts;

b) Acquiring and disposing of movable and immovable property;

c) Interpose court actions.

ARTICLE 19. The Center shall have at its headquarters, pursuant to an agreement to be signed with the host country, the privileges and immunities necessary to exercise independently its functions and to implement the programs approved by the Management Board.

ARTICLE 20. The Center will also have, under agreements to be signed with the members, the necessary privileges and immunities in their respective territories to exercise independently the functions and implement the programmes approved by the Management Board.

ARTICLE 21. The representatives of the members and officials of the Center shall have the privileges and immunities necessary to exercise independently the functions related to the Center.

ARTICLE 22. In the exercise of their duties, the Director and staff of the Center shall not request or receive instructions from any member or any other source outside the Center. Members shall respect the international character of the functions of the Director and the staff of the Centre and shall not seek to influence them in the performance of their duties.

CHAPTER VIII.

OFFICIAL WORKING LANGUAGES

ARTICLE 23. The official working languages of the Center will be Arabic, Spanish, French, and English.

CHAPTER IX.

AMENDMENTS TO STATUTE

ARTICLE 24. Any member may submit draft amendments to the Staff Regulations to the Board of Directors.

ARTICLE 25. The proposed amendment or amendments will be examined in the ordinary or extraordinary sessions of the Board of Directors at least six months after the draft amendments have been distributed to all members.

ARTICLE 26. The Board of Directors shall approve by consensus the amendments, which shall enter into force for all members 60 days after they have been ratified, accepted or approved by a majority of two Third, third, third

CHAPTER X.

SIGNATURE, ACCEPTANCE, AND ENTRY INTO EFFECT

ARTICLE 27. Once approved by the Conference of Plenipotentiaries, this Statute shall be open to the signature for six months in the Permanent Mission of India to the United Nations, in New York, and later in the Ministry of Foreign Affairs, in New Delhi, India, for one year. However, the Statute will remain open for accession.

ARTICLE 28. The Statute shall be subject to the ratification, acceptance or approval of the signatory members. The instruments of ratification, acceptance or approval and the instruments of accession shall be deposited with the Government of India.

ARTICLE 29. The Statute shall enter into force within thirty days of the date of deposit of the 30th instrument of ratification, acceptance, approval or accession.

ARTICLE 30. For members who ratify, accept, approve or accede after the 30th instrument of ratification, acceptance, approval or accession has been deposited, the Statute shall enter into (a) the thirtieth day from the date on which the members have deposited their instrument of ratification, acceptance, approval or accession.

ARTICLE 31. The depositary member shall communicate to all signatories and to all members who have acceded, the date of entry into force of the Statute and any other relevant matter. It shall also communicate to all the parties to the Statute the date and duration of the first session of the Management Board.

ARTICLE 32. The Arabic, Spanish, French, and English texts of the Statute are equally authentic.

DECRETA:

ARTICLE 1A. Approve the "Statute of the Center for Science and Technology of the Movement of Non-Aligned Countries and other developing countries", made in New York on February 4, 1985.

ARTICLE 2A. Pursuant to article 1o. of Law 7a. In 1944, the "Statute of the Center for Science and Technology of the Movement of Non-Aligned Countries and other developing countries", made in New York on February 4, 1985, which is approved by the first article of this law, will force the country to of the date on which the international link with respect to the same is improved.

ARTICLE 3A This Law governs from the date of its publication.
