Whereby the National Agricultural Council and Agroindustrial is created. Summary
THE CONGRESS OF COLOMBIA DECREES:
ARTICLE 1o. CREATION. Create the National Agricultural Council and Agroindustrial ascribed to the Presidency of the Republic.
. NATURE. The National Agricultural and Agroindustrial Council is a consultative and advisory body of the National Government to serve as a mechanism for participation and government, unions and civic planning and development of agricultural policy consultation.
ARTICLE 3. INTEGRATION. The National Agricultural and Agroindustrial Council shall consist of:
The President or his delegate, who will preside. Only he may act as delegate the Minister of Agriculture.
- Minister of Agriculture.
- The Minister of Finance and Public Credit.
- Minister of Defense.
- The Minister of the Environment.
- The Minister of Mines and Energy.
- The Minister of Foreign Trade.
- Minister of Economic Development.
- Minister of Health.
- The General Manager of the Caja Agraria.
- The General Manager of Incora.
- A representative member of the Board of the Bank of the Republic and elected by it.
- The National Director of Planning.
- President of the National Federation of Coffee Growers.
- A leader of the National Association of Peasant, chosen according to the regulations determined by the Ministry of Agriculture.
- The Director of SENA, the IFI, the ANDI, SAC, FEDEGAN and Fenalce.
- A representative of black communities, other indigenous and peasant smallholders one elected by the Ministry of Interior and Agriculture, according to their competence.
- Anti-kidnapping Tsar.
- A representative of the National Trade Union Federation of Agricultural -Fensuagro-.
- A representative of the Society of Agronomists and Veterinarians. PARAGRAPH 1.
. Attendance at the National Agricultural Council and Agroindustrial is delegated, except for the Presidency of the Republic. PARAGRAPH 2.
. Council members will make their recommendations based on criteria of democracy, equality, justice, equality, solidarity, efficiency and effectiveness. Effective Notes
ARTICLE 4. FUNCTIONS OF THE COUNCIL. The functions of the National Agricultural and Agroindustrial Council are:
a) advise the Government on research, analysis, preparation, planning, development, adoption, application and development of agricultural and agro-industrial policy;
B) Conceptualize on the outlines of agricultural and agroindustrial policy; study the programming of agricultural and agroindustrial policy in the short, medium and long term, develop a budget project concerning the agricultural and agro-industrial sector, propose alternatives for improvement; conceptuar on the need and desirability of legislative reforms, assess the level of preparedness of officials working in the agricultural sector and recommend the theoretical academic programs that contribute to their improvement; establish a system of incentives and sanctions for these officials;
C) Review the periodic evolution of the agriculture and fisheries sector and each of the subsectors that comprise it;
D) Evaluate the degree of social welfare reached by the rural population and small fishmongers and propose measures to improve desirable;
E) Consider the state of international trade in agricultural goods and suggest measures to increase the participation of Colombia in the same;
F) Conceiving on social investment programs in the field that the state intends to do or perform;
G) To propose measures aimed at increasing physical, economic productivity and improving the agricultural sector;
H) recommend a modernization plan to use as instruments and cybernetics computer, so that enables and facilitates the understanding, communication and information among the various sectors of the agricultural system;
I) I recommend a plan of education of agricultural policy for officials of the agricultural system;
J) Strengthen the necessary degree of coordination among all state institutions in order to unify efforts for the development and growth of the agricultural and agro-industrial sector;
K) integrate and link the above functions with aspects of the agroindustrial sector;
L) To propose formulas for the field of security and mechanisms to reduce violence.
PARÁGRAFO. The National Government will provide for the operation of the National Agricultural and Agroindustrial Council, through their respective agents.
The 5th ITEM. Public hearings. The National Agricultural Council and Agroindustrial hold public hearings when requested by four (4) members.
In order to receive information and useful criteria for the performance of its functions, the Board may require written to the organizations and public bodies and guilds in the agricultural sector or verbal reports.
It is mandatory for state servants provide them, except in the case of matters submitted to the legal reserve. Effective Notes
ARTICLE 6o. FREQUENCY OF MEETINGS. The National Agricultural and Agroindustrial, Council shall meet as often as deemed necessary within the first four months at the beginning of each government. It hold ordinary sessions four times a year. So will an extraordinary way when circumstances warrant, convened by its President or four (4) of its members. Effective Notes
ARTICLE 7. This Law governs from its enactment and repealing Chapter 12 of Law 101 of 1993 and the provisions that are contrary.
