DECRETA:

ARTICLE 1o. CREATION. Create the National Agricultural and Agro-Industrial Council attached to the Presidency of the Republic.

ARTICLE 2o. Nature. The National Agricultural and Agro-Industrial Council will be an advisory body and an adviser to the National Government, which will serve as a mechanism for participation and consultation of the government, union and citizens for planning and development of agricultural policy.

ARTICLE 3o. INTEGRATION. The National Agricultural and Agricultural Council shall be composed of:

The President of the Republic or his delegate, who will preside over it. Only the Minister for Agriculture may act as a delegate.

-The Minister of Agriculture.

-The Minister of Finance and Public Credit.

-The Minister of Defense.

-The Minister of the Environment.

-The Minister of Mines and Energy.

-The Minister of Foreign Trade.

-The Minister of Economic Development.

-The Minister of Health.

-The General Manager of the Agrarian Fund.

-The General Manager of the Incora.

-A representative, member of the Board of Directors of the Bank of the Republic and elected by it.

-The National Planning Director.

-The President of the National Federation of Cafeteros.

-A leader of the National Association of Peasant Users, elected according to the regulations that the Ministry of Agriculture will determine.

-The Director of the SENA, the IFI, the ANDI, the SAC, Fedegan and Fenalce.

-A representative of the black communities, others of the indigenous people and one of small peasant owners, elected by the Ministry of the Interior and Agriculture, according to their competence.

-The anti-kidnapping Zar.

-A representative of the National Federation of Agricultural and Agricultural Unions-Fensuagro-.

-A representative of the Society of Agronomists and Veterinarians.

PARAGRAFO 1o. Assistance to the National Agricultural and Agro-Industrial Council is inselectable, except for the Presidency of the Republic.

PARAGRAFO 2o. Council members will make their recommendations based on criteria of democracy, equality, justice, equity, solidarity, efficiency and effectiveness.

ARTICLE 4. COUNCIL FUNTIONS. The functions of the National Agricultural and Agro-Industrial Council are as follows:

a) Advising the National Government in research, analysis, preparation, planning, formulation, adoption, implementation and development of agricultural and agro-industrial policy;

b) Conceptuating on the general lines of agricultural and agro-industrial policy; studying the programming of agricultural and agro-industrial policy in the short, medium and long term, drawing up a draft budget for the sector Agriculture and agroindustrial, propose alternatives for their improvement; conceptualize on the necessity and appropriateness of legislative reforms, evaluate the level of preparedness of officials working in the agricultural sector and recommend theoretical academic programs that contribute to their improvement; establish a system of incentives and penalties for such officials;

c) Examine the periodic evolution of the agricultural and livestock sector and each of the subsectors that integrate it;

d) Evaluate the degree of social welfare achieved by the peasant population and small fish farmers and propose the appropriate measures to improve it;

e) Consider the state of international trade in agricultural goods and suggest measures to increase Colombia's participation in it;

f) Conceptuating on social investment programs in the field that the State performs or intends to perform;

g) Propose measures aimed at increasing physical, economic and agricultural productivity;

h) Recommend a modernization plan that uses computer and cyber tools as instruments, in such a way as to enable and facilitate understanding, communication and computing among the various sectors of the agricultural system;

i) Will recommend a plan of pedagogy of agricultural policy for the officials of the agricultural system;

j) Strengthen the necessary degree of coordination among all state institutions in order to unify efforts for the development and growth of the agricultural and agroindustrial sector;

k) Integrate and link previous functions with aspects of the agro-industrial sector;

l) Propose security formulas for the field and mechanisms to reduce violence.

PARAGRAFO. The National Government will provide what is necessary for the operation of the National Agricultural and Agro-Industrial Council, through their respective agents.

ARTICLE 5o. PUBLIC HEARINGS. The National Agricultural and Agricultural Council will hold public hearings when requested by four (4) of its members.

In order to receive information and criteria useful for the performance of its functions, the Council may require verbal or written reports to public bodies and agencies and to the agremations of the agricultural sector.

It is mandatory for the servers of the State to provide them, except for matters submitted to the legal reserve.

ARTICLE 6o. FREQUENCY OF MEETINGS. The National Agricultural and Agro-Industrial Council will hold the meetings as necessary within the first four months at the beginning of each government. It will be ordinarily four times a year. It will also do so in an extraordinary manner when circumstances warrant it, by calling on its Presidency or four (4) of its members.

ARTICLE 7o. This Law governs from its enactment and repeals Chapter 12 of Law 101 of 1993 and the provisions that are contrary to it.
