THE CONGRESS OF THE REPUBLIC DECREES
:
having regard to the text of the "Mandate of the International Study Group on Nickel", adopted on 2 May 1986 by the United Nations Conference on Nickel,
1985. MANDATE OF INTERNATIONAL STUDY GROUP ON NICKEL,
APPROVED ON 2 MAY 1986
UNITED NATIONS CONFERENCE ON NICKEL, 1985 Preamble

Parties in this Agreement have reached an understanding for the creation of an International Study Group on Nickel has the following mandate.

ESTABLISHMENT 1. the International Study Group on Nickel is established to implement the provisions and supervise the operation of this Mandate. OBJECTIVES

2. To ensure enhanced international cooperation on issues concerning Nickel, in particular by improving the information available on the international nickel economy and by providing a forum for intergovernmental consultations on Nickel. DEFINITIONS

3. By the "Group" means the International Study Group on Nickel constituted in these terms of reference;
B) "Nickel" means, in particular, scrap, waste and / or waste and nickel products determined by the Group.
C) "Members" means all States as prescribed in the 5th paragraph. they have notified their acceptance pursuant to paragraph 19. FUNCTIONS

B) to hold consultations and exchange of information among members on developments related to the production, stocks, trade and consumption of all forms of nickel;
C) To conduct relevant studies on a wide range of important issues concerning Nickel, in accordance with the decisions of the Group;
D) To consider special problems or difficulties which exist or may be expected to arise in the international economy "nickel". COMPOSITION

5. They may be members of the Group all States with an interest in the production, consumption and international trade in nickel.

POWERS GROUP 6. a) The Group shall exercise such powers and perform or arrange the functions necessary to comply with the provisions of this Mandate play;
B) The Group is not a trading organization and shall not be entitled to enter into any trading contract for nickel or any other commodity or product otherwise.
C) The Group shall adopt the regulations deemed necessary for the performance of their duties. HEADQUARTERS

7. Group headquarters will be located in the location selected in the territory of a member state. The group will negotiate a headquarters agreement with the host government. DECISION-MAKING

8. a) The highest authority of the Group established under this mandate to the General Meeting shall.
B) The Group, the Standing paragraph 9 and committees and subsidiary bodies established normally take decisions by consensus refers to the Committee. If necessary a vote, it will be held in the conditions set out in the regulations. STANDING COMMITTEE

9. a) The Group shall establish a Standing Committee which shall consist of the members of the Group which have indicated their desire to participate in its work;
B) The Standing Committee shall perform the tasks assigned by the Group and inform it on the outcome or progress of its work.

COMMITTEES AND SUBSIDIARY BODIES 10. The Group may, in addition to the Standing Committee, establish committees or other subsidiary bodies under the conditions laid down.

SECRETARIAT 11. a) The Group shall have a Secretariat consisting of a Secretary General and the staff necessary;
B) The Secretary General shall be the chief administrative officer of the Group and shall be responsible to it for the administration and operation of this mandate in accordance with the decisions of the Group.
Cooperation with other entities

12. a) The Group may make arrangements for consultation or cooperation with the United Nations, its bodies, its specialized agencies and other intergovernmental organizations, as appropriate;
B) The Group may also make arrangements for maintaining contact with interested non-participating Governments of the States that the 5th paragraph refers to., With other international non-governmental organizations or private sector institutions, as appropriate.

13 LEGAL STATUS. a) The Group shall have legal personality in the host country. In particular have the capacity to contract, to acquire and dispose of movable and immovable property and to institute legal proceedings;
B) The status of the Group in the territory of the host Government shall be governed by a headquarters agreement between the host Government and the Group, to be concluded as soon as possible after the entry into force of this Mandate. CONTRIBUTIONS TO THE BUDGET

14. The Group shall assess the contribution of each member in the currency of the host country for each fiscal year in accordance with the scale of contributions specified in the regulations. Payment of the contribution of each member shall be made in accordance with its constitutional procedures.

STATISTICS AND INFORMATION 15. a) collect, collate and group members statistical information on production, trade, stocks, consumption and prices of nickel and internationally recognized published, it deems appropriate for the effective functioning of this Mandate;
B) The Group shall make such provisions as it deems appropriate for the exchange of information with interested non-participating Governments and relevant non-governmental and intergovernmental organizations in order to ensure the availability of recent and reliable data on production, consumption , stocks, international trade, internationally recognized published prices and other factors affecting supply and demand for nickel;
C) The Panel shall ensure that no information published shall prejudice the confidentiality of the operations of persons or companies producing, processing, marketing or consuming Nickel.

ANNUAL ASSESSMENT AND STUDIES 16. a) The Group shall prepare and distribute to Members an annual assessment of the world nickel situation and related, in the light of the information provided by Members and supplemented by information from all other relevant sources issues;
B) The Group, when it deems appropriate, take or trend studies are made short- and long-term international nickel economy, including the submission, once a year or, with the approval of the Group more than once a year, prospects for production, consumption and trade in nickel for the following calendar year, in order that this exchange of information will be a technical aid to members in their individual assessments of the evolution international nickel economy.

OBLIGATIONS OF MEMBERS 17. Members shall make every effort to cooperate and to promote the achievement of the objectives of the Group, particularly as regards the provision of data on the nickel economy referred to in paragraph 15. AMENDMENT
|| | 18. These terms of reference may be amended only by consensus of the Group and without a vote.

ENTRY INTO FORCE 19. a) These Terms of Reference shall enter into force when at least 15 States which in total represent more than 50% of world trade in nickel have communicated their notification to the Secretary General of the United Nations in accordance with paragraph c) of this paragraph. If the mandate goes into effect under this article with members will be invited to attend an inaugural meeting.
Whenever possible, members that meeting with at least one month in advance will be notified;
B) If the requirements for entry into force of this Mandate have not been met on 20 September 1986, the Secretary General of the United Nations shall invite Governments, in accordance with paragraph c) of this paragraph , they have notified their intention to become members of the Group to meet as soon as possible to decide whether or not to bring into force, in whole or in part, including these Terms of Reference;

C) Any State to which the 5th paragraph refers. you want to become a member of the Group shall give written notice that it intends to apply these terms of reference either provisionally, while its internal procedures, or definitively. Until the entry into force of this Mandate and the inauguration of office by the Secretary General of the Group, such notice shall be the Secretary General of the United Nations; thereafter, it will be the Secretary General of the Group. All State applying these Terms of Reference provisionally shall endeavor to complete the relevant procedures within six months from the date of notification and, in any event, within 12 months from that date, and shall notify the depositary accordingly. WITHDRAWAL

20. a) A member may withdraw from the Group at any time by giving written notice of withdrawal to the Secretary General of the Group;
B) Withdrawal shall not relieve the member of financial obligations already incurred and shall not entitle the withdrawing State to any rebate of its contribution for the year in which the withdrawal occurs;
C) Withdrawal shall become effective 60 days after the Secretary General of the notification;
D) The Secretary General shall notify each member of any notification received under this paragraph. DURATION OF GROUP

21. The Group will continue to exist as, in the opinion of the members, continue to serve a useful purpose, unless term is put to it in accordance with paragraph 22. COMPLETION

22. a) The Group may at any time decide by a majority vote of two-thirds of the members, terminate this mandate. This termination shall take effect on the date decided by the group;
B) Notwithstanding the termination of this Mandate, the Group will continue to exist as long as necessary to carry out its liquidation, including the settlement of accounts. RAMA

In accordance with article 1. 7a Act. 1944, the mandate of the International Study Group on Nickel, adopted on 2 May 1986 by the United Nations Conference on Nickel, 1985, that article 1. this law passed, will force the country from the date the international link about the same is perfected.
