By which the Law 136 of 1994 is amended and other provisions are dictated.
THE CONGRESS OF COLOMBIA,
DECRETA:
ARTICLE 1o. 96 of Law 617 of 2000 >
ARTICLE 2o. Modify the article 9o. of Law 136 of 1994, which will remain so:
" ARTICLE 9o. EXCEPTION. Without the full of the requirements set out in the previous article, the departmental assemblies will be able to create municipalities when, prior to the presentation of the draft ordinance, the President of the Republic considers its creation as a national convenience, because it is a border area or a zone of colonization or for reasons of national defense, provided that it is not an indigenous territory, except that I will mediate prior agreement with the indigenous authorities. "

ARTICLE 4. Article 79 of Law 136 of 1994, will remain so:
ARTICLE 79. OBJECTIONS TO INCONVENIENCE. If the Plenary of the Council rejects objections for inconvenience, the Mayor must sanction the project in a term not greater than eight (8) days. If it is not sanctioned, the President of the Corporation will sanction and publish it.

ARTICLE 7o. Add article 112 of Law 136 of 1994, with the following third indent:
" 3. If the City Council is not in session, it will be up to the Governor to grant authorization to leave the country. "
ARTICLE 8o. 96 of Law 617 of 2000 >
ARTICLE 9o. Article 163 of Law 136 of 1994, will remain so:
" ARTICLE 163. SKILLS. Comptroller may not be elected, who:
(a) You have been Comptroller or Auditor of the Municipal Comptroller's Office at all or part of the period immediately before, as a holder or in charge;
b) Have been a member of the courts that make the or the Council's choice to make the choice, within the previous three years;
c) This course within the inabilities outlined in article 95 and paragraph of this Law, as far as applicable. "
ARTICLE 10. The deadline for adopting the urban stratification of the article 101 of Law 142 of 1994, in the Capital District of Santafe of Bogota and the districts of Santa Marta, Cartagena and Barranquilla the other municipalities of the country, is extended until 31 December 1996.
ARTICLE 11. COUNCILORS ' INABILITY. 96 of Act 617 of 2000 >
ARTICLE 12. The payments made by the National Government, such as reimbursement or replacement for the expenses incurred or incurred by candidates for positions of popular choice, do not constitute taxable income for those who have received them.
ARTICLE 13. VALIDITY. This Law governs from the date of its sanction and repeals the provisions that are contrary to it.
