as a profession and its exercise is regulated.

THE CONGRESS OF COLOMBIA,

DECRETA:

ARTICLE 1o. Industrial Design is recognized as a profession of university professional level.

ARTICLE 2o. It is understood by profession of Industrial Design the exercise of everything related to the design and projection of the use, operation, manufacture and distribution of industrial products, provided that this activity is on a path to improving the utilization and benefit of such products.

ARTICLE 3. They are valid for the exercise of the profession of Industrial Designer the titles issued with the full of the requirements laid down in the laws corresponding to the educational modalities Article 1 is dealt with. of this Law.

PARAGRAFO. The purely honorific titles will not be valid for the exercise of this profession.

ARTICLE 4. To exercise the profession of Industrial Designer, the following requirements will be required:

a) Poseer university degree duly obtained and registered in accordance with the applicable rules; and

b) The legal registration in the Ministry of Economic Development, which will grant the respective professional card.

PARAGRAFO. The professional titles in Industrial Design that have been granted prior to the current Law for educational institutions of the university professional level legally authorized for this purpose, will be valid to continue exercising the profession.

ARTICLE 5o. The exercise of the profession of Industrial Designer, without the full of the requirements listed in Article 4. it will be illegal and will result in relevant sanctions.

ARTICLE 6o. To perform charges that require the exercise of Industrial Design in public or private entities, the same requirements as set out in Article 4 (4) shall be required. of this Law.

ARTICLE 7o. Create the Colombian Professional Industrial Design Commission as an auxiliary government agency, which will depend on the Ministry of Economic Development for the control, surveillance and development of the exercise of this profession, which shall be integrated as follows:

(a) By the Minister of Economic Development or his delegate, who shall preside over it;

b) 64 of Law 962 of 2005 > By the Minister of National Education or his delegate;

c) By a representative of the Industrial Design faculties, legally recognized in the country who must hold the title of Industrial Designer. This representation will be rotating each year in the form established by the Ministry of National Education;

d) Two Industrial Designers elected and delegated for one year, to this commission by the Colombian agremiations of Industrial Design professionals duly constituted and recognized before the State, if any.

ARTICLE 8o. The following are the functions of the Colombian Professional Design Professional Commission:

1. Collaborate with the National Government in the implementation of this Law and the regulatory decrees.

2. To issue, approve and amend its own rules.

3. Raise with the Ministry of Education, initiatives and observations on the approval of new study programmes, related to this profession.

4. To issue the statute on professional ethics for the exercise of the Industrial Design profession.

5. To transfer to the competent authorities the violation of this Law, and the rules on professional ethics for the imposition of the penalties to be imposed.

6. To promote the research and development of Industrial Design, either directly or in collaboration with public or private law entities.

7. Sponsor the formation of the Colombian Confederation of Industrial Designers ' Agremiations and monitor its operation.

ARTICLE 9o. Industrial Design has the primary function of helping society, natural and legal persons to solve the problems and needs that one and others have in any area of their competence.

ARTICLE 10. The National Government shall regulate this Law, in a term of six (6) months from the date of its promulgation.

ARTICLE 11. This Law governs from the date of publication and repeals any provisions that are contrary to it.
