For which a Development Fee is created and the Cerealist Development Fund is modified.
THE CONGRESS OF COLOMBIA,
DECRETA:
ARTICLE 1o. Create the Fomento Fee on the National Production of Grano Leguminosas.
ARTICLE 2o. The Grano Leguminosas Fomento Fee will be half percent (0.5%) of the sale price of each kilogram.
ARTICLE 3o. The causation, collection, nature, and administration of the Grano Leguminous Development Fee will be governed by Law 67 of 1983 and the rules that add it.
PARAGRAFO 1o. The administration of the Leguminous Development Quota of Grano different from the soy bean will be contracted by the National Government through the Ministry of Agriculture with the National Federation of Growers of Cereals, Fenalce, who will do so in a separate account, called "The Grain of Grano Leguminosas". The administration of the quota corresponding to the soy bean will be contracted by the National Government through the Ministry of Agriculture with the Agricultural Cooperative of Geneva Limited, Coagro.
PARAGRAFO 2o. The consideration for the administration and collection of the quotas for the production of cereals, leguminous crops other than soy beans, and soy beans, will be up to 15 percent (15 percent) in all cases.
ARTICLE 4. THE COMMITTEE ON THE PROMOTION OF CEREALS AND LEGUMINOUS PLANTS. The Commission on Cerealist Promotion created by Law 67 of 1983, will be called the Commission for the Cerealist and Leguminous Development of Grano, and will be integrated as follows:
1. The Minister of Agriculture or his delegate, who will chair it.
2. The Minister for Economic Development or his delegate.
3. Three (3) members elected by the Board of Directors of the National Federation of Grain Growers, Fenalce.
4. One (1) representative of the growers of grain legumes other than soya beans, chosen by the Ministry of Agriculture, submitted by the associations and cooperatives of producers of the aforementioned leguminous plants or, failing that, a (1) representative of the National Federation of Grain Growers, Fenalce, which is cultivator of grain legumes other than soybean.
ARTICLE 5o. The Soy Bean Development Fund, which is made up of the proceeds from the soy promotion quota, will be headed by a commission composed of:
The Minister of Agriculture or his delegate, who will preside over it.
The Minister of Economic Development or his delegate.
Three (3) members elected by the Board of Directors of the Agricultural Corporation of Geneva, Coagro, corresponding to soybean growers in different regions of the country.
ARTICLE 6o. The Grano Cerealist and Leguminous Development Commission and the Commission on the Promotion of Soy Beans will be able to hire or subcontract plans, programs and projects with other agremations and cooperatives. of the subsector, present to you by the administration or any of the members of the respective Commissions.
ARTICLE 7o. ASSETS OF THE FUNDS. The assets that are acquired with resources from the quota of grain legumes, must be incorporated into special accounts called "Cuota de Leguminosas de Grano" and "Cuota de Fomento del Bean Soy". In each transaction, it must be established that the goods acquired are part of one of those accounts in such a way that, in the event that the funds are settled or a specific or single Fund is established for legal persons, all the goods including the Money from accounts that are in cash or in banks, once the liabilities are cancelled, are made available to the National Government or the Fund created, as the case may be.
ARTICLE 8o. This Law governs from the date of your issue.
