CONGRESS OF COLOMBIA DECREES
ARTICLE 1o. The family is the fundamental core and basic institution of society, it is formed through natural or legal ties, by the free decision of a man and a woman to marry or will conform responsible.
. FEMALE HEADED HOME. For the purposes of this Act, the Women's headship is a social category of households, derived from socio-demographic, economic, cultural and gender relations changes that have occurred in the family structure, subjectivities, representations and identities of women who redefine their position and status in the processes of reproduction and social production, which is the subject of public policies in the participating state, private sectors and civil society institutions.
In accordance with the above, is Female Head of Household, who being single or married, holds the female head of household and has under his charge, affectionate, economically or socially, permanently own young children or other incompetent persons or unable to work, either by absence or permanent physical, sensory, psychological or moral spouse or life partner or substantial impairment of help from the other members of the family disability.
PARÁGRAFO. The condition of Female Head of Household and cessation thereof, from the time when the respective event occurs, must be declared before a notary for each of them, expressing the basic circumstances of the respective case and without this concept cause emoluments notarial charge. ARTICLE 3. SPECIAL PROTECTION. The National Government will establish effective mechanisms to provide special protection to women heads of households, promote the strengthening of its economic, social and cultural rights, seeking to establish decent living conditions, promoting equity and social participation with the purpose of expanding coverage health care and sexual and reproductive health; access to welfare services, housing, access to basic, secondary and higher education by increasing its coverage, quality and relevance; access to science and technology, special credit lines and decent and stable jobs. ARTICLE 4. The State shall define by regulation the entry of women heads of household and family in charge of the social security system, looking for comprehensive protection, whose services they render effectively, either with prepaid systems, credit and except for free. Effective Notes
The 5th ITEM. SUPPORT education. Educational institutions will have textbooks to lend to children who need them and especially to the dependents of female heads of households, without diminishing the right to equality has other children, allowing exchange service between libraries in order to ensure compliance with this obligation. Disclosure and territorial support for these programs and educational projects will be a priority of the Ministry of Education.
To support libraries establishments so hicieren, and those who supply or donate texts beneficiaries of this article, the Government may create a Special Fund in the manner prescribed in Article 4th of this law.
PARÁGRAFO. The Ministry of Education will develop efforts to promote the signing of agreements to facilitate the donation of educational materials for children of women heads of household. ARTICLE 6o. In no event may refuse access to services and health education to children or other dependents of female heads of household with exclusive basis in this circumstance people. Effective Jurisprudence
ARTICLE 7. Preferential treatment for ACCESS TO EDUCATIONAL SERVICES AND MANAGEMENT OF INTERNATIONAL COOPERATION. Public institutions of primary, secondary and higher education attend preference applications for admission of children or dependents of female heads of household, provided they meet the requirements and that the results of entrance exams and other tests are at least equal to those of the other candidates.
The Ministry of Education will promote the formulation and presentation of projects that may be subject to international cooperation aimed at creating, developing and implementing educational processes aimed especially at strengthening early childhood education for children or dependent children of women head of the family. Article 8. BUILDING FOR BUSINESS DEVELOPMENT. The national government plans and programs provide free training and development of industrial, commercial and artisanal micro-enterprises; family enterprises, solidarity economy enterprises and entrepreneurial projects, with which the female head of household can make an economically profitable activity.
To this end, the National Planning Department (DNP), the National Apprenticeship Service, SENA, the National Administrative Department of Economic Solidarity, Dansocial, or his substitute, and the Ministries of Planning departmental, district and municipal, and other bodies of a similar nature existing or those that become created design and implement plans and programs aimed specifically at women heads of households, to achieve the rating of its core performance and competency. Such entities must:
a) Generate gender statistics through the competent bodies that build and develop plans, programs, projects and policies suited to the needs of women heads of household;
B) Generate free training programs, flexible in duration and adapted to time the availability of female heads of household;
C) Create entrepreneurial and productive regional networks linking women heads of family in sustainable and profitable economic activities. The National Government will determine which entities that exercise inspection, oversight and control in compliance and execution of plans, programs and policies aimed at women are heads of households. . The Ministry of Social Protection will set the parameters for the evaluation of these government actions, through management indicators and results. PARAGRAPH 2.

Article 9. Within the cultural field of development, the National Government will establish and Departments, Municipalities and the Capital District of Bogota may establish in favor of the female head of household or whom it is responsible:
a. preferential access to educational aid.

ARTICLE 10. INCENTIVES. The National Government will establish special incentives for the private sector to create, promote or develop special programs for health, education, housing, social security, credit and employment for women heads of households. Effective Notes
ARTICLE 11. The Government, by regulation, introduce a weighting factor that benefits the proposals of the female head of household or legal persons in which she participates mainly in procurement processes and selling goods State and contracting services also with the state. This factor will allow the supply of the female head of household or the corresponding legal person is selected whenever at least equal to those of other bidders. Effective Jurisprudence
ARTICLE 12. SOCIAL SUPPORT FOR WOMEN ORGANIZATIONS ACCESS TO HOUSING. The Ministry of Environment, Housing and Territorial Development will promote the formation of social and community women's organizations to facilitate their access to social housing, guiding them in the process of qualification for the allocation of subsidies in cash or kind and will offer advice house purchases through various credit programs, granting of subsidies, improvement and basic sanitation, on-site construction and self-construction.
This policy shall also apply through the territorial institutions and other entities performing tasks for the processing of family allowances of social housing, that somehow receive resources for housing the General Budget of the Nation or the Fund national Housing. For the effect will lead preferably, registering women breadwinners in order to provide training for programs for them on an equal footing with all registered as applicants for subsidized social housing from the source before annotated resources.
The territorial entities whose housing plans receive funds from the national budget, will facilitate the full requirements for administrative contracting of service or execution of works, associations or popular housing organizations that are formed or within the solidarity economy sector, which are mainly composed of women heads of household. Condition for this treatment is that profits or surpluses obtained are intended for the acquisition or improvement of housing associated women who are heads of households. Effective Notes
ARTICLE 13. INSPECTION, MONITORING AND CONTROL. Inspection, monitoring and control policies and programs of the entities and institutions in the preceding article relates to correspond to the National Housing Fund or his substitute. The National Government will regulate the matter. Effective Notes
ARTICLE 14. INFORMATION AND TRAINING FOR ENSURING ACCESS TO HOUSING ALLOWANCE FAMILY. The National Government will provide information mechanisms and training of Family Head Women who do not have the opportunity to join or organize, to ensure access as candidates for the Family Housing Subsidy Social Interest, in its various forms. ARTICLE 15. CREDIT EASING AND SUPPORT. The National Government will design tools and strategies to facilitate and allow access to single mothers, financial services providing support and ongoing training, in order to reduce the feminization of poverty. Effective Notes

DEVELOPMENT ARTICLE 17. THE PRINCIPLE OF EQUAL. In implementing the principle of equal opportunities for female heads of household, national and regional public bodies to which appropriate for application of existing rules to the effect that offer social development programs should be set in the formulation and implementation of the same, a percentage budgets for projects aimed at women heads of households that include technical training according to supply and demand, support productive chains and organizational processes, as integral component in the implementation of social development projects that allow them to generate resources and decent and stable employment. ARTICLE 18. The benefits established in this law for women heads of household and who depend on them, do not preclude the obligations of various kinds in their favor must comply natural or legal persons or exempt of actions to demand them. Effective Jurisprudence
ARTICLE 19. Within the social development field right to demand justice is established and legally a percentage of salary, income or assets of whoever economic and civilly responsible for the female head of household or someone office, intended to serve them their basic needs.
PARAGRAFO. To authorize the National Government to within a period of one year from the publication of this law has adopted the provisions necessary for the effectiveness of this article. Effective Jurisprudence
ARTICLE 20. GUARANTEES FOR SUSTAINABLE DEVELOPMENT. To ensure sustainable development of social projects that are promoted by this law in favor of women heads of households, the following actions are available:
a) The National Administrative Department of Economic Solidarity, Dansocial, or whoever their times, direct, coordinate, promote, plan, protect, strengthen and develop projects entrepreneurial approach aimed at women heads of households, through the implementation of resources from the national budget, individuals or originating abroad, to promote establishment of organizations of solidarity economy without this endorsement associated labor cooperatives that outsource labor relations;
B) The Government will ensure access to credit programs in a timely and ongoing technical assistance for micro-enterprises, family businesses and the like that have been organized by women heads of households, in relation to the supply of raw materials, training in the areas of production, marketing and distribution of products and selling services. ARTICLE 21. The provisions of this law does not prevent women heads of family benefit in the same way and in the same cases as determined by the legal rules in favor of women in general. Effective Jurisprudence
ARTICLE 22. TRAINING OFFICIALS. It is the duty of the state to train public officials and community leaders in the defense of human rights, particularly economic, social and cultural rights of women heads of household.
PARÁGRAFO. Officials who violate or hindering the implementation of this law will be disqualified on grounds of misconduct, which is punishable in accordance with the special rules on the subject. Effective Notes
