By which the profession of Bacteriologist is regulated and other provisions are dictated

THE CONGRESS OF COLOMBIA,

DECRETA:

ARTICLE 1o. THE BACTERIOLOGIST PROFESSION. The Bacteriologist is a university professional with a scientific and research training, whose field of action is mainly developed in the areas related to the diagnosis and quality control, the biotechnological development, basic and applied research, management and teaching related to the career and scientific direction of the clinical and industrial laboratory, of your exclusive competence.

ARTICLE 2o. REQUIREMENTS FOR EXERCISING THE PROFESSION. To exercise the profession of Bacteriologist the following requirements must be met:

a. Obtain the academic diploma of Bacteriologist in university institutions that are legally functioning in the country, and are recognized by the Colombian Institute for the Promotion of Higher Education "Icfes", or in countries with which Colombia has concluded treaties or conventions on equivalence or validation of university degrees.

b. Have complied with the compulsory social service.

c. Obtain through the health services the professional card that accredits him as a Bacteriologist.

TRANSIENT PARAGRAPH. Similarly, professionals in bacteriology who comply with the regulations of this Law may be exercised by the profession of Bacteriologists.

ARTICLE 3o. BACTERIOLOGIST DUTIES AND OBLIGATIONS. The following are the duties and obligations of the bacteriologist:

a. Keeping professional secrecy;

b. Perform strict quality control;

c. Require the supply of reagents with certified quality, which ensure the reliability of the results;

d. Deliver clear, accurate and timely delivery of results without causing delay to patients;

e. Certify with your signature and registration number each of the analyses performed;

f. Do not participate in programmes that mean the manufacture of bacteriological weapons or any other biological element that is against Community health;

g. It shall not refuse to treat patients with infectious diseases or the use of toxic substances and chemical reagents necessary to carry out their profession. Therefore, the bacteriologist shall enjoy special occupational protection to ensure his physical and mental integrity, as well as rest benefits that compensate for the possible risks he assumes in his work;

h. You will not undertake to perform tasks inherent in the profession that exceed your physical and mental capacity and involve deterioration in your health and that of the patient.

ARTICLE 4. NATIONAL COLLEGE OF BACTERIOLOGY.

ARTICLE 8o. OPERATION OF CLINICAL LABORATORIES. The Ministry of Public Health or the competent authority of the Government shall be the only authority responsible for approving the operation of the clinical laboratories.

At the sectional level, health services will annually do quality control over bacteriology laboratories for the purpose of reliable and adequate service delivery.

PARAGRAFO. By regulatory pathand hearing the concept of the National College of Bacteriology, the Government will periodically update the conditions which must be assembled by the laboratories for operation.

ARTICLE 9o. Those who come to the profession of bacteriologist with a professional card issued by the Ministry of Public Health or the Secretaries of Health Service, prior to the validity of this Law, shall have the same prerogatives and obligations enshrined in the present article for bacteriologists.

ARTICLE 10. VALIDITY. This Law governs from the date of its issue, repeals all provisions that are contrary to it and especially those contained in Law 44 of 1971.
