Having met in its twenty third session in Montreal on 6 October 1980. Noting
A21-22 and A22-28 of resolutions on lease, charter and interchange of aircraft in international operations.
Having noted the draft amendment to the Chicago Convention on International Civil Aviation prepared by the 23rd. session of the Legal Committee.
Having noted that it is general desire of Contracting States have a provision on the transfer of certain functions and duties of the State registration the State of the operator of the aircraft in case of lease, charter or interchange or any similar arrangement on that aircraft.
Having considered necessary to amend for the purposes stated, the Chicago Convention on International Civil Aviation done at Chicago on 7 December 1944.
1. Approved, in accordance with the provisions of Article 94 a) of the convention, the following proposed amendment thereto.
Insert after Article 83 the following new Article 83a.
"
Article 83a Transfer of certain functions and duties
a) Notwithstanding the provisions of Articles 12, 30, 31 and 32 a), when an aircraft registered in a Contracting State is operated pursuant to a lease, charter or interchange of the aircraft or any similar arrangement by an operator who has his principal place of business or, if no such place of business, its permanent residence in another Contracting State, the State of Registry, by agreement with such other State, transfer to it all or part of its functions and duties as State of registry in respect of that aircraft under articles 12, 30, 31 and 32 ). the State of registration shall be relieved of its responsibility for the functions and duties transferred.
b) the transfer does not take effect with respect to the other contracting States before the agreement between States on the transfer is registered to the Council and made public in accordance with Article 83 or a State party to that agreement has directly communicated the existence and scope of the agreement to the other contracting States concerned.
C) The provisions of paragraphs a) and b) above shall also apply in cases provided for by Article 77 ".
2. Prescribe, in accordance with the provisions of Article 94 a) of the said Convention, the number of States whose ratification the proposed amendment above enters into force, will be ninety-eight.
3. Resolves that the Secretary General of the International Civil Aviation Organization draw up a Protocol, in the Spanish, French, Russian and each text being equally authentic, in which the aforementioned amendment is incorporated, as well as set forth below:
a) the Protocol shall be signed by the President of the Assembly and its Secretary General.
b) the Protocol shall be open to ratification by any State that has ratified the said Convention on International Civil Aviation or acceded to it.
c) the instruments of ratification shall be deposited in the organization of Aviation International civil.
D) The Protocol will enter into force for States which have ratified it on the date the ninetieth eighth instrument of ratification is deposited.
E) The Secretary General shall immediately notify all Contracting States of the date of deposit of each ratification of the Protocol.
F) The Secretary General shall immediately notify all States Parties to the Convention the date of entry into force of the Protocol.
G) With respect to any State ratifying the Protocol after the date aforesaid, the Protocol will enter into force after the deposit of its instrument of ratification with the International Civil Aviation Organization
therefore under of the above decision of the Assembly.

This Protocol has been drawn up by the Secretary General of the Organization.
In witness whereof, the President and the Secretary of the aforementioned twenty-third session of the Assembly of the International Civil Aviation Organization, duly authorized by the Assembly, sign this Protocol.
Done at Montreal on 6 October 1980 in a single document in Spanish, French, English and Russian, each text being equally authentic. This Protocol shall be deposited in the archives of the International Civil Aviation Organization and the Secretary General of the Organization shall transmit certified true copies, thereof to all States Parties to the Convention on International Civil Aviation done at Chicago on the seventh December 1944. ...

Article 2.

In accordance with the provisions of article 1. 7a Act. 1944, Relating to an Amendment to the Chicago Convention on International Civil Aviation (Article 83 Bis), signed in Montreal on 6 October 1980 Protocol, that the first article of this law is approved, will force the country from the date that international link is perfected.

ARTICLE 3. This Law governs from the date of publication.
