Chapter I General

Article 1, in order to strengthen the planning, construction, conservation and management of rural roads, secure access to rural roads and promote rural economic and social development, develop this approach in line with the relevant legislation such as the People's Republic of China Highway Law, the Road Safety Protection Regulations.

Article 2 Planning, construction, conservation and management of rural roads in the current administration area and the application of this approach.

The approach refers to rural roads that are included in rural road planning, where roads, communes, villages and their subsidiary facilities are constructed in accordance with road engineering technical standards, including rural roads identified and incorporated in the statistical reporting period by the Government's transport authorities. Roads include road bridges, tunnels and crossings.

Article 3. Rural road development should be guided by government ownership, social participation, ranking, district ownership, comprehensive planning, rationalization and re-engineering, ensuring quality, protecting the environment and guaranteeing the principles of accessibility.

Article IV. The Government of the people at the district level should integrate rural road development into local national economic and social development planning, step up financial inputs to rural roads, strengthen organizational leadership and oversight inspections for rural roads and promote sustained health development of rural roads.

The provincial-level people's Government is the subject of responsibility for rural roads in the current administration. The commune government, the street offices are responsible for communes, the construction of village roads, conservation efforts and the management, protection of rural roads identified by the communes.

Article 5

Relevant sectors such as the development of reform, finance, land resources, rural and urban planning should be based on the division of responsibilities and on the work of rural roads.

Article 6. Villagers' Committee organizes villagers in collaboration with the construction, conservation and management of rural roads in the village area, in line with the principle of voluntary and democratic decision-making by villagers.

Article 7. Rural roads and their subsidiary facilities are protected by law. Any units and individuals have the obligation to escort rural roads, highway sites and highway subsidiary facilities.

Any unit and person are prohibited from illegally placing cards, fees, fines and intercepting vehicles on rural roads.

Any units and individuals have the right to report and prosecute violations of the safety of rural roads, damage to rural roads or the unlawful occupation of rural roads, highway land and illegal cards, fees, fines, interception of vehicles, etc.

Article 9 encourages social funding to participate in rural road construction and conservation.

Chapter II Planning

Article 10. Rural road planning should be based on national economic and social development planning, rural and urban planning, land-use master planning and local economic and social development needs and be aligned with national, provincial and intermodal planning and other transport development planning.

The preparation of district and commune planning is governed by the People's Republic of China Highway Act.

Village planning has been prepared by the commune government, the street offices, approved by the communes' government and reported on the Government's transport authorities.

The approved rural road planning needs to be modified by the original preparation body, which proposes a revised programme to report on the approval of the original approval authority and to report back to the Government's transport authorities at the highest level.

Article 12. The designation and number of rural roads are determined in accordance with national standards.

Article 18 Rural road construction should apply tendering systems and government procurement systems in accordance with the relevant provisions.

Article 19 Highway or medium-sized bridges, tunnel engineering projects shall be subject to construction permits by law; other rural road construction projects shall be reported to the local or district government transport authorities in the area where the project is located.

Article 20 Rural Highway construction projects introduce a safe production accountability system and a quality accountability system. The construction, survey, design, construction and treasury units of rural road construction projects should clarify the responsibility for safe production and quality management and implement safety production and quality assurance measures.

Rural Highway construction projects implement the contract management system. Construction units should enter into contracts with units such as survey, design, construction and administration, with clear rights and obligations.

Article 21 Rural Highway construction projects implement the construction system. The construction of a technical hierarchy is four and more rural highway and should select engineering institutions with corresponding qualifications.

Article 23. Article 25 Rural road construction should be made available in public construction plans, subsidies policies, tenders, construction management, quality management, funds use, engineering tests.

Chapter III Highway conservation

Article 26 People's Government at the district level should establish an effective organizational system and operational mechanism consistent with rural road conservation.

Article 27 provides guidance, supervision for rural road conservation, and transport authorities are responsible for minor maintenance in rural road conservation, upgrading and district roads; minor maintenance work in communes, village routes and villages are vested with the Government of the Town and the street offices.

The minor maintenance of rural roads can be carried out through the establishment of mass, professional conservation organizations or by individual (agriculture). In terms of conditions, preference should be given to the conservation operation units or individuals, including through open tendering, government procurement services.

Article 29 Conservation units of rural roads should strengthen the conservation of rural roads and ensure that rural roads are integrated, trajectory and slope, and facilities are completed.

Article 33 Governmental transport authorities should conduct regular inspections of rural road bridges in accordance with the relevant provisions. There is a need for testing and institutions with national qualifications should be delegated.

The detection of the rural highway bridge is less than the design requirement and should be marked in a marked location and be repaired and solid in a timely manner; the detection of serious road bridge damage, affecting the security of movement, should be followed in a timely manner and the prohibition of movement and circumscription in a visible place.

Article 31 states and communes' governments, street offices should, in line with the requirements of road conservation techniques, be able to work on the greening of rural roads in the light of the realities of rural roads.

In cases where rural roads are disrupted or severely damaged by natural disasters or other sudden events, the communes' governments should promptly inform and organize rehabilitation; where necessary, organ agencies, groups, business units, urban and rural residents can be organized and, if necessary, can be requested, local military presences, the civilian police support and, as soon as possible, recovery.

In accordance with the characteristics of rural road conservation, the authorities of the communes should establish a sound conservation and safe production management system, and promote the strict implementation of the conservation operation by the constituency units and conserving operators.

Article 34 of the rural Highway conservation operation, sandals, and the need for exhumation, logging, extraction and water for conservation operations should be governed by the law.

Chapter IV

Article XV of the Government's transport authorities at the district level are responsible for the management of communes and communes in the present administration.

The commune government, the street offices are responsible for the management of the village's roads in accordance with the responsibilities established by the communes.

Article XVI prohibits the following acts on rural roads and on the road.

(i) Obstacles, exhumation, storage points, residues, dumping of garbage and the use of nutrients;

(ii) The cereal, irrigation, crop cultivation, burning, fertilization, subsoil;

(iii) Vehicles are moving in the area of transport;

(iv) Damage, unauthorized movement and the relocation of rural highway facilities;

(vi) Other damage and damage affecting the availability of rural roads.

Article 37 prohibits the use of rural road bridges to carry out construction activities such as cables, arsenals and loads;

Prohibition of the establishment of high-quality electric power lines that are not in compliance with the standards on rural road bridges and flammable trajectory lines;

It is prohibited to release flammable items within the rural Highway Bridge or to identify fire operations and other facilities.

Article 338 The scope of the rural highway construction area ranges from the highway area to the distance criterion:

(i) The district is not less than 10 metres;

(ii) The commune is not less than 5 metres;

In rural highway construction areas, buildings or constructions may not be constructed except for road protection, conservation.

Article 39 provides for the following road construction activities, which shall be approved by the road management body in accordance with the provisions of the State Department's Road Safety Protection Regulations:

(i) Construction of works such as railways, airports, electricity, water, communications, etc. require the occupation, excavation of rural roads, roads or the transformation of rural roads;

(ii) Construction of bridges, tanks or structures across rural roads, pipelines, cables, etc.;

(iii) The construction, laying of pipelines and cable facilities within rural roads;

(iv) Use of facilities such as rural road bridges, tunnels, holes and cables;

(v) The establishment of non-road signs within rural roads or the use of facilities that cut across rural roads;

(vi) To add or rehabilitate crossroads on rural roads;

(vii) Facilities such as pipelines and cables in rural highway construction areas.

Article 40 Governments of the town, street offices should arrange for the regular conduct of communes, village trajectorys; the conduct of inspections of violations of article 36, article 33, article 38, article 39 and article 39 of this approach should be stopped in a timely manner. Failure to stop is a timely report on the authorities for the transport of the provincial-level people, which are dealt with by law by the authorities of the communes.

Chapter V Financial management

Article 40

More than the people at the district level may, in accordance with the relevant provisions of the national and self-government zones, adopt government procurement services and lead social funding to integrate rural road construction, conservation and management.

Article 42 should strengthen the management of rural road construction, management, conservation of funds, rigorous implementation of the budget, dedicated funds and the prevention of diversion.

Chapter VI Legal responsibility

Article 42, in violation of the provisions of this approach, stipulates that the provisions of the law are sanctioned and are in accordance with their provisions.

Article 46, in violation of article 36 of this approach, is responsible for the cessation of the violation by the authorities of transport at the district level, with a fine of 5,000, resulting in damage to the rural roads, which is legally liable.

Article 47, in violation of this approach, provides that one of the following acts shall be criticized by the Government of the people at the district level for the duration of the period of time to be renovated; in serious circumstances, the responsible person shall be treated in accordance with the law.

(i) The rural roads delivered are not experienced or are not eligible;

(ii) Assessing or countering the mobilization of funds for rural road construction.

Chapter VII

Article 48 is implemented effective 1 March 2017.
