(Prelease No. 164 of the Order of the People's Government of the Southern Province of the Lake, 28 September 2002) Article 1, in order to regulate the use of special signs of reconnaissance and vehicle traffic by national security authorities, ensure that national security authorities and their staff carry out their national security tasks in accordance with the law, preserve the legitimate rights and interests of citizens, legal persons and other organizations, and develop this approach in line with the National Security Act of the People's Republic of China and other relevant provisions. Article II. National security authorities and their staff carry out national security tasks within the territorial administration, using special signs of reconnaissance and vehicle traffic, and apply this approach. This approach refers to the special signs of reconnaissance and vehicle traffic, which are published by the Ministry of National Security of the People's Republic of China (hereinafter referred to as the reconnaissance) and the special vehicle traffic symbol. Article III is limited to the use of reconnaissance personnel by national security authorities in carrying out their national security tasks in accordance with the law. The special vehicle traffic symbol is limited to the use of the following vehicles by national security authorities: (i) Command vehicles for the implementation of emergency missions; (ii) A vehicle carrying out reconnaissance and defence missions; (iii) Prisons. Article IV. National security authorities should designate special custodian signs of reconnaissance and vehicle traffic. Staff members of national security agencies need to use reconnaissance or special vehicle traffic symbols and should strictly perform the requisition, approval, registration procedures and return in a timely manner after the completion of their tasks. Article 5 When a national security authority reconnaissance officer performs its national security tasks under the law, the following functions may be exercised through a reconnaissance certificate: (i) The identification of Chinese citizens or persons outside the country; (ii) To investigate and enquire with relevant organizations and personnel on matters relating to national security; (iii) Examination of random items of persons suspected of endangering national security; (iv) Access to places related to the implementation of national security tasks (including places where the required payment is made) and areas; access to airports, rotary, shores and military restricted areas, transport control zones, ceasing areas, etc., is required to draw the assistance of the relevant authorities; (v) Inspection or access to archives, information, goods related to national security; (vi) Priority may be given to the purchase of vehicle tickets, ship tickets or post-entry tickets; priority purchase of aircraft tickets; priority options for classes (roubles); (vii) Where necessary, in accordance with the relevant provisions of the State, transport instruments, communications tools, sites and buildings that can be used by organs, groups, business units and individuals, provided that they should be returned in a timely manner and pay appropriate costs; and losses should be compensated; (viii) In the light of national security needs, inspection agencies, such as customs, border crossings, should be assisted by the relevant inspection bodies, in accordance with relevant national provisions. Article 6 provides for the implementation of urgent national security tasks and the placement of specially marked vehicles, which can be accessed in accordance with article 5, paragraph (iv), of this approach; in the context of ensuring the safety of transport, the restrictions on movement, route and direction signals can be stopped at a non-designated location; in the event of traffic obstruction, priority may be given to transportation; and in the event of a traffic accident may be released after the investigation by the police. Article 7 implements national security tasks and configures vehicles with special traffic symbols, exempts the payment of parking fees, the passage (bridge) fees. Article 8. Civil, legal and other organizations should support, assist and preserve the secret of known national security efforts when national security authorities use reconnaissance and vehicle traffic symbols to carry out their national security tasks. No organization or individual may unlawfully detain reconnaissance and vehicle traffic signs. Special signs of falsification, sale, unlawful use of reconnaissance and vehicle traffic are prohibited. Article 10 The National Security Agency and its staff shall use special signs of detection and vehicle traffic in accordance with this approach and relevant national provisions, and shall not exceed their functions, abuse of their functions, nor shall the use of reconnaissance and vehicle special symbols for personal gain or other violations shall not violate the legitimate rights and interests of citizens, legal persons and other organizations. Article 11 Civil, legal and other organizations violates the provisions of this approach by national security authorities and their staff, the right to inspect, prosecute and investigate promptly by national security agencies or relevant departments. Article 12. In violation of this approach, it is deliberately impeding the use of reconnaissance certificates by national security authorities or special vehicle traffic symbols to carry out national security tasks, unlawful seizure of reconnaissance, vehicle special traffic symbols or disclosure of secrets in national security, and penalties are imposed in accordance with national laws, regulations and regulations. Article 13, in violation of this approach, provides for the confiscation, sale, unlawful use of reconnaissance and vehicle special traffic symbols, forfeiture and warning by national security authorities, and the transfer of public security authorities in accordance with the relevant provisions of the Law on the Safety and Security of the People's Republic of China; and for the criminalization of criminal responsibility by law. Article 14. In violation of this approach, there is one of the following acts, to be administratively disposed of by the national security authorities or the relevant authorities to the person directly responsible, in accordance with the authority of management; to be criminalized by law; and to indemnice by law for the legitimate rights and interests of citizens, legal persons and other organizations: (i) Explanatory issuance or use of reconnaissance and vehicle traffic symbols without authorization; (ii) The timely return of special signs of reconnaissance and vehicle traffic after the completion of the mission; (iii) The transfer of special signs of detection and vehicle traffic to others; (iv) The use of reconnaissance and vehicle special traffic symbols for personal gain or other violations. Article 15. This approach has been implemented effective 1 January 2003. |
