Beijing Public Security Image Information Systems Management Approach

Article 1, in order to regulate the construction and management of public safety images information systems in the city, enhance the capacity to prevent and dispose of sudden public events, guarantee public safety, protect the legitimate rights and interests of citizens and develop this approach.
Article II applies to the construction and management of public safety image information systems within the city's administration.
Article 3. Public safety image information systems referred to in this approach refer to video systems using image-gathering equipment and other related equipment to record information in areas involving public safety.
Article IV. The relevant sectors and districts of the city's people's government are responsible for the implementation of the industry, the system, the organization of public safety image information systems in the region, and to assist in the management of public safety image information systems.
Municipal and district, district public security authorities are responsible for the construction, use and maintenance of daily monitoring systems for public safety images.
The following units and regions should be installed in public safety image information systems:
(i) Political organs, State bodies, radio stations, television stations, telecommunications, postal, financial, service units, museums, archives, priority material protection units, and key units such as the production, sale, storage of dangerous goods;
(ii) The hotels, restaurants, shops, hospitals, schools, kindergartens, cultural recreation sites, and the holding of public places in the sporting sites, sites, residential areas, parking places, etc.;
(iii) Emphasis on roads, road paragraphs and main transport corridors, corridors, street bridges, airfields, railway stations, ground iron and urban bars, and important traffic hubs for public electric vehicles;
(iv) Urban infrastructure such as drainage, electricity, fuel, heat facilities, urban river lakes and other important water works;
(v) Other locations and regions provided for in national laws, regulations.
The municipal authorities established by the Public Security Archives Information System can identify other areas where public safety images information systems should be installed, and the Government of the city approves.
In accordance with this approach, the unit provides for the construction of a public safety image information system, which should be consistent with the Government's uniform planning and requirements, without collecting information on images in public areas other than the scope of the unit.
Article 7. The construction of public safety image information systems in public places such as transport roads, square brackets is the responsibility of the Government and no other units and individuals may have a public safety image information system in the region.
The construction of public safety image information systems should be consistent with the technical norms and standards of the State and the city.
Public-quality technical supervision, information-making authorities and public security authorities are jointly developing technical norms and standards for the public safety image information system in the city, and public image information systems should be functional for collection, video, transmission.
Article 9 establishes a public safety image information system that does not violate the privacy of citizens; confidential measures should be taken with regard to the information of images concerning the privacy of citizens.
The construction of public safety image information systems involving State secrets and commercial secrets is carried out in accordance with the relevant national provisions.
The construction, alteration and expansion of construction projects should install public safety image information systems, and public safety image information systems should be synchronized with project subjects.
Article 11. The use of public safety images information systems should be completed within 30 days of the date of the system's completion of the receipt of qualifications, and the construction of public safety image information systems should be made available to the city or district, district public security authorities in accordance with the CNDP relationship; and the absence of a custodian relationship, and the filing of a case to the area at which the unit is located, the district public security authority.
The use of public safety image information systems that had been established prior to the operation of the scheme should be made available to the public security authorities within 30 days of the date of operation.
Article 12 Use units of the Public Security Archives Information System shall take the following measures to ensure the safe operation of public safety image information systems:
(i) Training in personnel who are closely contacted with public safety images information systems for skills and confidential knowledge;
(ii) Establish systems such as safety inspections, operation maintenance, emergency response;
(iii) Maintain a clear picture and ensure the proper functioning of the system;
(iv) No unauthorized change in the use and location of public safety image information systems.
The use of units entrusts other units with the operation, maintenance and management of public safety image information systems and the parties should clearly guarantee the responsibility for the safe operation of the system.
Article 13 Use units of public safety image information systems should be established, the sound information security management system should be followed by the following provisions:
(i) The establishment of a system of duty visits to detect suspicious information involving public safety to report promptly to public security authorities;
(ii) The establishment of a registration system for the use of image information, registration of photographers, time-consuming and user-friendly matters;
(iii) In accordance with the prescribed time period, information on images should not be retained without unauthorized deletion or removal of the original data records of the alteration and destruction of the information of the images within the time period.
Article 14. Staff members who are responsible for the information of the images should be subject to the management system for the safety of the information of the images, the maintenance of positions, the care of the equipment and the conservative secret.
Persons who are not interested in the work of the MSPU shall not be allowed to access the places of worship. In addition to the use of image information under this approach, no one shall be consulted, replicated, provided and disseminated.
Article 15 sets public safety image information systems in public places and should be marked.
Article 16, when sudden public events such as social security, natural disasters, accidents and public health occur, the relevant authorities of the Government with the right to investigate, adapt and replicate information on images, should be synchronized.
Article 17 Governments should comply with the following provisions when the relevant authorities are consulted, consulted and replicated with the information on images:
(i) Staff members shall not be less than two;
(ii) Submission of work documents and documentation;
(iii) To complete the registration form of access, retrieval and reproduction of image information;
(iv) To comply with the use, confidentiality system of image information and to refrain from providing and disseminating information on images that involve State secret, commercial secret and personal privacy.
Public security authorities should monitor the day-to-day use of public safety images information systems, maintain the situation, identify problems that promote the timely rejuvenation of the relevant units, and, where necessary, quality technical oversight, information authorities should assist in technical testing.
Article 19, in violation of the provisions of this approach, should build public safety image information systems that are not constructed or are not built in accordance with norms and standards, be restructured and warned by public security authorities; be overhauled or restructured; fines of up to 3,000 dollars for units, with a fine of up to 500,000 dollars for heads of units, directly responsible personnel, respectively.
Article 20, in violation of article 6 of this approach, establishes a public safety image information system that allows for the collection of image information in public areas other than the scope of the unit, which is rectified by a public security authority and fines of more than 3,000 dollars in the unit's unit, which imposes a fine of up to 500,000 dollars, respectively, for the head of the unit, directly responsible.
Article 21, in violation of article 7 of this approach, authorizes the establishment of public safety image information systems in public places to be dismantled by public security authorities; the unit set up a fine of more than 30,000 dollars in the unit; fines for the principal head of the unit and the person responsible for the direct responsibility of more than 500 thousand dollars, respectively; and individuals set up a fine of up to 500,000 dollars for individuals.
In violation of article 11 of the present approach, the non-compliance with the succumbency system was restructured by public security authorities and fines for more than 1,000 units, with a fine of up to 500,000 heads of units, directly responsible.
Article 23, in violation of article 12 of this approach, does not take security management measures to secure the operation of the image information system, which affect the safe operation of the system, and is subject to a fine of up to 500,000 dollars for the principal head of the unit, directly responsible personnel, respectively, and a fine of up to 1000 dollars for the principal head of the unit, the principal responsible person of the unit, the head of the unit, the head of the unit, the responsible person of the direct responsibility.
Article 24, in violation of article 13, article 14, does not establish, maintain or violate the security management system of image information, as well as unauthorized access, reproduction, provision and dissemination of information on images, with a fine of up to 3,000 dollars for the unit and a fine of up to 1000 dollars for the principal head of the unit, the direct responsible person, respectively; constitutes a violation of the security administration, punishable by law by the public security authority; constitutes an offence punishable by law.
Article 25, in violation of article 16 of the present approach, rejects the provision of information on images, which is fined by the public security authorities for more than 3,000 dollars of units, and imposes a fine of up to 500,000 dollars for the principal head of the unit, the direct responsible person, respectively; constitutes a violation of the administration of the security sector, punishable by law by the public security authority; constitutes an offence punishable by law.
Article 26 violates the provisions of article 17 of this approach by the competent government officials in the process of obtaining, adapting and releasing information on images in violation of the relevant management system, which is held by the competent authorities. Crime constituted criminal liability by law.
Article 27 of this approach was implemented effective 1 April 2007.
