Government of the Shanghai City announcement on strengthening the management of advertising facilities in the city

In order to strengthen the management of the placement of outdoor advertising facilities, in accordance with the provisions of the Decision of the Standing Committee of the Shanghai City People's Congress on Promoting and Guaranteeing the Preparation and Organization of the Conference, the Government of the city decided to take the following management measures to establish outdoor advertising facilities in the city during the preparation and organization of the Shanghai Conference in 2010.

The application for the placement of outdoor advertising facilities in the city is governed by a position planning plan for the placement of out-of-court facilities in the Shanghai City, as described in the position planning below, the introduction of a position programme for outpatient advertising facilities (hereinafter referred to as “implementation programmes”).

The Municipal Greenization Authority should organize a “implementation programme” in the area of external advertising, based on the position planning. In the process of preparation, the “implementation programme” should seek the views of the relevant departments, such as the planning of the land, business, housing security management and advertising associations.

The application of the “implementation Programme” for an outdoor advertising demonstration area and for new outdoor advertising facilities in the area of control is inadmissible; extension requests for an outdoor advertising facility that has been approved and in compliance with the requirements set out in the position plan shall not exceed six months for each extension period.

Applications for the establishment of new outdoor advertising facilities in the area where expatriates are prohibited, as well as extension requests for outdoor advertising facilities have been established.

iii. Prohibition of the establishment of an independent, subsidiary and external advertising facility within the framework of the road dividends in the city, except for the advertisement of a subordinate occupier of public service facilities, such as the telecommunications gallery.

iv. Exclusive advertisement facilities for unauthorised owners were removed by the municipal law enforcement authorities for a period of time; undisplaced, forced dismantled by the urban administration and fined up to 50,000 yen.

V. Exclusive advertising facilities that have been approved but not in accordance with the position planning, the “implementation programme” or article 3 of the present notice shall be treated in accordance with the following provisions:

(i) The duration of the establishment should be removed within five days; the closure of the time limit by the city's law enforcement authorities was not removed; and the closure of the city's law enforcement services was still pending; and the closure of the city's law enforcement services was forced by over 5,000 yen.

(ii) No period of time has been set aside by a written notification by the urban sanitation management. The facility should be dismantled within 30 days of the date of receipt of the notice; the undisplaced and removed by the urban administration.

Between 1 January 2010 and 31 December 2010, the outside shoreline of this city prohibits the unauthorized establishment of expatriates, articles, pamphlets, posters and exclusive commercial advertisements. As a result of the significant activities in the city, the above-mentioned external commercial advertisements should be established, with the approval of the city's Greenhouse Municipal Correctional Service and the processing of external advertisements in the municipal business administration sector. In violation of the provisions, the urban administration can be forced to dismantle.

It is prohibited to establish, publish out-door advertisements in major roads and landscape areas outside the present trajectory line, and to publish elements that may have adverse effects, except where the operator has established, publishes products produced in the area of its operation, or engages outdoor advertisements related to its operating services. In violation of the provisions, the business administration is rectified and punishable by a fine of over 3,000 dollars.

The main roads and landscape areas referred to in this report are drawn up by the city-led sanitation management with the relevant sectors and are published after the approval of the Government of the city.

The scope of external advertisements that may have adverse effects is specified and published by the municipal and commercial administration.

The present notice was carried out from the date of publication to 31 December 2010.
