Broaden Province Water Supply Movement

(Adopted at the 46th ordinary meeting of the Eleventh People's Government, held on 24 February 2011, by Decree No. 254 of 4 March 2011, by the Popular Government Order No. 254 of 4 March 2011)

Article I, in order to strengthen the management of water supply chains and to ensure the safe and ecological environment of water for flood and water, sets this provision in line with the Water Act of the People's Republic of China and other relevant laws, regulations and regulations.

Article 2 provides for the movement of water in the water pool as a central hub in the water treasury and, according to the undeniable changes in water resources, the systematic control of water storage, leading water for the achievement of functions such as water storage, flood protection and ecological protection.

Article 3. This provision applies to the movement of water in large-scale water banks within the territorial administration.

The movement of water pools that must be taken in the context of drought is implemented in accordance with the relevant provisions of the People's Republic of China Act on the Prevention of Hunger and the People's Republic of China's drought regulations.

(vi) Eco-environmental environmental conservation plans developed by relevant sectors such as environmental protection, urban construction.

The annual water use plan for water management units should be based on water contracts with water units.

The development of environmentally sound water plans in the relevant sectors should be based on scientific technical data and basic information.

The annual water control programme prepared by the municipal and district water administration authorities is presented in the top-level water administration.

Article 7. Water administrative authorities prepare annual water control plans to meet first and foremost water for rural and urban residents and to meet water needs such as industrial, agricultural, ecological environment. The development of eco-environmental water movement control programmes should take fully into account the minimum water and ecological environmental water flows of the river basin.

Water administrative authorities can adjust the annual water control plan based on changes in water use.

Article 8. The watershed management unit shall prepare a programme for the implementation of the irrigation water supply period, the period of turmoil and the dry water storage period, which shall be approved by the competent water administration authorities, in accordance with the annual water control programme.

The watershed management unit should prepare for the water storage movement, in accordance with the approved water storage movement control programme.

Article 9. The provincial, municipal and district water administration authorities, in accordance with the annual water control plan and the implementation programme and the actual situation of water supply, fire prevention, drought control, etc., order the real-time movement of water in the water pool. In violation of this provision, the water administration authorities have not prepared, under the law, the annual water control plan for the water treasury, orders for real-time movement in accordance with the annual movement control plan and the implementation programme, failure to disclose water releases to affected areas, release of the water period or other abuse of authority, sterilization, provocative fraud, administrative disposition by the competent and other direct responsible personnel responsible under the authority of personnel management; criminal responsibility; and liability for loss, in accordance with the law.

In violation of this provision, the water management unit does not carry out a real-time movement control order or release of water previously reported to the water administration authorities in the affected areas for the release of water, the leading period, which is modified by a competent administrative authority responsible for the administrative disposition of the responsible manager and other direct responsibilities by law; constitutes a crime, criminal liability under the law; resulting in loss and liability under the law.
