Archives management in rural and urban areas in Kymin City

(Adopted at the 14th ordinary meeting of the Government of the Turkmen Republic of 15 August 2011, No. 110, of 21 November 2011, by the Order No. 110 of the Government of the Turkmen Republic of 21 November 2012)

Article I, in order to strengthen the management of archives in rural and urban areas, has a full role to play in rural and urban construction archives in urban planning, construction, management, in accordance with the laws, regulations and regulations of the People's Republic of China, the People's Republic of China Rural and Rural Planning Act, the Quett City Archives Regulations, which are in effect in the city.

Article 2

This provision refers to documentation materials that are directly developed in urban and rural planning, construction and management activities that have the preservation and use of values, books, maps, voices, electronic files, etc.

Article 3. The construction of archives in urban and rural areas is guided by the principles of harmonization of leadership, sub-management, the maintenance of the integrity and security of the archives and the functioning of the archives and the facilitation of social use.

Article IV provides for the construction of archives in rural and urban areas and is responsible for the management of rural and urban construction archives in the central urban areas.

Districts other than the urban areas (communes), district rural and urban Archives are responsible for the management of rural and urban-rural archives within the Territory and are subject to operational guidance and oversight in the management of the archives at the top-level rural and urban areas.

Rural and urban-rural-building archives led by the Rural and Rural Archives Administration are responsible for the day-to-day management of rural and urban construction files.

Article 5

Article 6 provides oversight and guidance to the administrative authorities of the same archives in the construction of archives in rural and urban areas.

Article 7. Rural and urban-rural-building archives management funds are included in sector budgets of the same-level rural and urban-rural Archives management, in accordance with all levels of financial management.

The following urban and rural construction files should be included in the collection:

(i) Construction of engineering archives: industrial, civilian construction works archives; municipal facilities engineering files; engineer engineering files; public utility works files; public transport infrastructure engineering files; park construction, wind landscape construction works files; environmental sanitation construction works files; urban protection, resistance, human engineering files; military engineering files; and military engineering files containing information on the movement of underground routes beyond military clearance areas and military management areas to hidden works;

(ii) Operational management and operational technical archives developed by specialized management in the construction system;

(iii) Based information on rural and urban planning, construction and management approaches, policies, regulations, plans, scientific research results and urban history, natural, economic aspects;

(iv) Rural residential construction files, information;

(v) Other land and rural-rural construction files with conservation values.

The collection and management approach of the former paragraph (iv) of the Rural Housing Archives, Information, was developed by the Urban and Rural Archives Administration in conjunction with the construction, territorial administration sector, which was approved by the municipality.

Article 9. When a permit for nuclear construction planning, housing and the construction of a nuclear construction licence by the executive authorities in rural and urban areas, construction units should be informed in writing, as required, of the transfer of construction works files to urban and rural construction archives and the collection, collation and inspection of construction project components.

The rural and urban planning authorities, when conducting the construction engineering planning verification process, should be identified for the construction of engineering archives from rural and urban construction archives.

Article 10. The construction units shall prepare engineering files in a timely manner, in accordance with the relevant provisions of the management of the rural and urban construction archives, to collect and collate the various components of construction projects and to transfer them to rural and urban-rural Archives in accordance with the prescribed time frame.

The operational management and operational technical files developed by the various professional management of the construction system with permanent value are transferred to the rural and urban development archives, as required.

Article 11. The transfer of rural and urban construction files should be in compliance with the following criteria:

(i) The original document;

(ii) The full, complete, accurate, systematic archival documents; the clear, graphical integrity and standardization of specifications; and the collation of the archiving documents is consistent with national rules for the construction of archives in rural and urban areas;

(iii) The completion of the work map is in line with the engineering entity and is added to the completion of the work map and is in due process, and the revisions to the completion map are consistent with the normative requirements;

(iv) graphs, videos, voice documents, electronic archives are in compliance with relevant standards.

The time frame for the transfer of rural and urban construction files should be in line with the following provisions:

(i) The transfer of archives to rural and urban-rural-building institutions within six months of the completion of the construction work;

(ii) Refer to rural and urban-rural-building archives within six months of the census, the day-to-day maintenance of the land line file;

(iii) The road engineering archives are transferred by project legal persons to rural and urban-rural-building archives within six months of delivery through engineering and completion tests;

(iv) The business management and operational technical files developed by various professional management in the construction system have been transferred to the rural and urban development archives every five years.

The temporary construction authority established under Article 13 for special construction works, municipal works projects should be transferred to urban and rural-rural-building archives in accordance with the provisions for the preparation of construction works files, as scheduled.

Archives of construction, mitigation of construction work are temporarily maintained by construction units; construction units have been withdrawn and their maintenance of construction works files should be transferred to their superior administrative authorities or to the rural and urban development archives.

The construction of the engineering archives is incomplete, complemented by their authority units and transferred to urban and rural construction archives.

Article 14. Rural and urban-rural-building archives should establish and implement relevant systems of collection, custody, documentation, statistics, identification, destruction, research, confidentiality and access to information; improve the modernization of archival entities and archival information, introduction of a biackage of the entity's archives and electronic archives to ensure the safety and effective use of the archives.

Article 15. The custody and use of rural and urban construction archives shall be subject to the following provisions:

(i) To strictly adhere to the laws and regulations relating to archives, confidential work, to respect the prohibition of the transfer of archives, the donor, the licensor, or to limit the use of opinions to preserve their legitimate rights and interests;

(ii) Citizens, legal persons or other organizations may be validly certified, such as identity documents, pamphlets, using the archives, in accordance with the relevant provisions of the archives;

(iii) The use of the archives shall not be construed, distorted, redirected or forged, dressed and extractive.

Article 16 replicates in rural and urban construction archives are equal to the original value and proven effectiveness of the archives.

Article 17 The construction units shall, prior to the application of a licence for the construction of engineering planning, be directed to the rural and urban construction of archives to search the ground-based engineering files in the construction area and obtain information on the status of the construction line.

The urban and rural-urban Archives Administration should organize the development of archival information-making planning for rural and urban development and the development of a unified information resource-sharing platform.

Article 19 provides for the development of the archives administration in rural and urban areas in violation of the provisions of the management of the archives in rural and urban areas, the establishment of complaints, reporting mechanisms, social oversight, and the timely processing of complaints or reportingers.

In violation of this provision, within six months of the completion of the construction work, construction units have not been transferred to the construction of the engineering archives by providing for the transfer of the construction of the Archives to rural and urban-rural-building Archives, which is due to the impoverishment of the Archives Administration; fines of more than 3,000 dollars; severe circumstances impose a fine of over 30,000 dollars.

Article 21, in violation of this provision, contains one of the following acts, which is fined by the rural and urban construction of the archives administration, in accordance with the value and quantity of the archives, for the unit of more than 20,000 dollars; fines for managers and other direct responsible personnel of up to 5,000 dollars, respectively; confiscation of proceeds of the conflict; liability for losses; liability for the commission of an offence; and criminal liability under the law:

(i) Damages, loss and theft of rural and urban construction files;

(ii) The absence of effective management measures that result in loss of rural and urban archives;

(iii) The unauthorized destruction of rural and urban construction files;

(iv) Identification, severing, redirecting or falsifying, sing and extracting rural and urban construction files.

Article 2 violates other offences under this provision and is punished by the relevant administration in accordance with the relevant laws, regulations and regulations.

Article 23 provides administrative treatment under the law with respect to the administration of the administration, the management body and its staff who play negligence, abuse of authority, provocative fraud during the construction of archives in rural and urban areas, and constitutes criminal liability under the law.

Article 24 The Basic Archives Management of the Kymin City, issued on 21 June 1999 by the Government of the people of Know City, was repealed at the same time.
