Facilities-building management approach in the city of Sichuan (as amended in 2012)

(Act No. 1 of 2 September 2010 of the Order of the People's Government of the city of Sichuan on 7 February 2012 No. 2 of the Order of the People's Government of the Grand Sichuan on the date of publication, as amended by the Decision of the Government of the People's Republic of the Great Britain and Northern Ireland to amend some Government regulations)

Article 1, in order to strengthen accessibility facilities and management, promote social civilization, build harmonious societies, develop this approach in line with the laws and regulations of the People's Republic of China Disability Guarantee Act.

The accessibility facilities referred to in Article 2 of this approach refer to the provision of services in construction projects to ensure the safety and accessibility of persons with disabilities, older persons, children and other actors.

The scope and criteria for the construction of accessibility facilities must be matched by the provisions of the Urban Roads and Building Access Design Guidelines issued by the Ministry of National Construction, the Ministry of Civil Affairs, the China Disability Federation (hereinafter referred to as the design norm).

Article 3 builds the supervision and management of the construction of accessibility facilities for the project.

The relevant administrative authorities, such as planning, urban management, housing security, public safety and transport, are responsible for the construction, rehabilitation, management and oversight of accessibility facilities in accordance with their respective responsibilities.

The Disabled People's Federation and other relevant social groups have contributed to the monitoring of the construction, use and management of accessibility facilities in the relevant sectors, finding that problems are reflected in the relevant sectors in a timely manner.

Article IV, municipalities, districts (markets), the people of the region should incorporate accessibility facilities into national economic and social development plans and ensure that accessibility facilities are constructed in line with economic and social development.

Article 5 new construction, expansion and alteration construction projects must be designed and built in accordance with the standards set out in the National Design Guidelines. Accompanied facilities must be designed in parallel with the main works, while at the same time being constructed.

The design units should design accessibility facilities in accordance with the design norms and strictly implement the mandatory standards of the design norm when designing project works.

Article 7. The construction map review body shall conduct a review of the construction map design document in strict compliance with the mandatory standards of the design norm and shall not be adopted.

Article 8. Construction units, treasury units shall be designed in accordance with the review of qualified construction maps and in accordance with national, self-government standards, norms for the construction and administration of accessibility facilities.

Article 9. Construction units shall not unauthorizedly remove or modify accessibility facilities during construction.

The construction units should be checked at the same time when the construction works are completed. Unless experienced receipts or tests are not qualified, they cannot be used.

Article 10 has already been established without matching the construction of accessibility facilities prior to the implementation of this approach, or construction projects that have been accompanied by the construction of accessibility facilities that are not in compliance with the standards and requirements set out in the Design Guidelines, and the construction of project owner or operators should develop rehabilitation plans to implement the rehabilitation of accessibility facilities.

Article 11. Public transport operators should gradually be equipped with accessible vehicles and Brailles on public transport routes. Publicly delivered vehicles should be equipped and maintained for normal use; operational markings for the installation of accessible vehicles, markings should be kept awakening and easy identification.

Article 12 The public security referral cell should be equipped with street audio signals in the streets of the urban road, and the safety of the chairs. Urgent call systems such as 119, 110, 120 and 122 should be equipped with a letter-of-the-call alert, a call function that guarantees the need for hearing, voice-based persons with disabilities for police and emergency assistance.

The information industry, the broad-based electricity sector should take measures to promote information accessibility; television news programmes should be translated by hand-handling; the media should increase awareness of the management of accessibility facilities, education for public maintenance, care and accessibility facilities and create a good social climate for accessibility.

Article 14. Maintenance of accessibility facilities within urban roads is the responsibility of the executive branch. The conservation of accessible facilities in other construction projects is supported by the owner of construction projects. The owner and the operator, or the owner themselves, agree to the responsibility for the maintenance and rehabilitation of the accessibility facility, which is the responsibility of the agreed holder for the maintenance and repair of the facilities.

Article 15 prohibits the destruction, unauthorized occupation of accessibility facilities or the modification of the use of accessibility facilities.

For reasons such as urban construction, major social public service activities, the temporary occupation of urban roads should be avoided; the need to be occupied should be made in accordance with the provisions of the Galichuan Municipal Facilities Management Regulations and the establishment of police signals or instructions devices. The functionality of accessibility facilities should be restored immediately after the temporary occupation.

Article 16 protects the management responsibilities of accessibility facilities from the fulfilment of their day-to-day conservation and maintenance responsibilities, resulting in the inadequacy of access to facilities, which are converted by the construction of administrative authorities or other relevant departments, in accordance with their jurisdictional responsibilities; and by fines of more than one million dollars.

Article 17 Construction of project design units violates the mandatory requirements of this provision and the design norms, without design of an accessible facility, which is addressed by the construction of administrative authorities in accordance with article 63 of the Construction Quality Management Regulations.

Article 18 Construction of project construction units violates the provisions of this provision and the Regulations on the Quality of Construction of Engineering, and does not address the quality of the construction of accessibility facilities in accordance with the design of maps, construction technology standards or accessibility facilities.

Article 19 Construction units, in violation of this provision, do not receive the inspection of construction-enabled facilities or access to self-administered delivery under the provisions of Article 58 of the Regulations on Quality Management of Engineering.

Article 20

(i) Removal of accessibility facilities in the area of residence, which are subject to a fine of up to one thousand dollars for the administrative authorities responsible for the housing sector;

(ii) Removal of facilities in the area of residence in violation of the law or the unauthorized change of use by the administrative authority of the property, which is the subject of an act of business, with a fine of more than one million yen;

(iii) Harmonization of accessibility facilities within urban roads, in accordance with the provisions of article 43, paragraph 3, of the Regulations on the Regulation of Municipal Facilities in Galichuan.

Article 21, concerning administrative authorities and their staff members, in violation of this provision, that do not perform statutory duties or abuse of their functions, be corrected by a superior administrative organ or by a relevant department order, and that the competent and other responsible persons directly responsible are treated in accordance with the law; and that criminal responsibility is brought in accordance with the law.

Article 2
