Hydrology management approach in the sea

(It was considered at the 141st ordinary meeting of the Government of the Shanghai City on 15 May 2012 for the publication of the Government Order No. 84 of 24 May 2012 on 1 July 2012.

Chapter I General

Article 1

In order to strengthen the hydrological management of the city, to regulate hydrological work, to promote sustainable development in the economic community, in the light of the People's Republic of China Hydrographic Regulations, and to develop this approach in conjunction with the current city.

Article 2

This approach applies to the planning and construction of hydrology sites in the city's administration, hydrological monitoring and forecasting, the transfer, maintenance and use of hydrological monitoring materials, the assessment of water resources surveys, and activities such as hydrological facilities and the protection of the hydrological monitoring environment.

The water administration authorities of the Department of State have been implemented in accordance with the relevant national provisions, in accordance with the State's relevant provisions, in accordance with the water activities of the watershed management body established in the main rivers, lakes (hereinafter referred to as watershed management).

Article 3 (Management)

The Shanghai City Water Authority (hereinafter referred to as the Municipal Water Authority) is responsible for organizing the management of hydrology within the city's administration. The municipal water service can commission administrative sanctions under the laws, regulations and regulations governing hydrological management by the General Directorate of Water Administration in Shanghai.

In accordance with its responsibilities, the authorities of the tropolitan area and charging, treasury, chargé, gold, ventilation, etc. (hereinafter referred to as the relevant districts) are responsible for the hydrological work within this administrative area, and the hydrological institutions attached to them (hereinafter referred to as the relevant zonal hydrological institutions) can accept the implementation of specific hydrological management of the municipal hydrology station.

The city's development reforms, the planning of the land, environmental protection, transport ports, maritime, meteorology, public safety, and the management of the command institutions in the tropolitan areas, within their respective responsibilities, implement this approach.

Article IV

Governments of the urban and related districts should strengthen their leadership in hydrological work and take positive measures to accelerate the construction of hydrological modernization and to ensure the development of hydrological and economic societies. The requirements for hydrology should be included in the financial budget, which is guaranteed by the same level of finance.

Chapter II

Article 5

The Government of the people of the city and the relevant districts should incorporate the cause of hydrology into the planning for economic and social development of the current national population.

The Urban Water Bureau should organize development planning for the current city's hydrological cause in accordance with national hydrological development planning, development planning for watershed hydrology, development planning for national economic and social development, and report on the implementation of the city's government after consultation with the relevant administrative sectors of the city.

The relevant district water administration authorities should organize the development planning of the current administrative regional hydrological cause in accordance with the needs of the hydrological cause of the city and the economic and social development needs, to report on the implementation by the Government of the people at this level and to report to the municipal water service.

Article 6

The construction of the hydrology network has been integrated. The Urban Water Bureau should organize the planning of the current city hydrology network, in line with the National Hydrographic Network planning and development planning for the current city's hydrological cause, in line with the principles of integrated balance, near integration, rationalization, resource sharing, prevention and repetitiveness, the development of the current city's hydrology network, integrated balance in the planning of the land sector and the approval of the city's government, with the integration of the corresponding rural and urban planning.

In the course of the organization of the planning of the network of hydrology stations in the city, advice from the executive branch, such as environmental protection, transport ports, maritime, meteorological, etc., should be consulted by the watershed management body.

Adjustments to the hydro network are required for economic development needs or changes in the river lake bank, and should be submitted in accordance with the previous set of procedures.

The construction of the hydro-station network for the integrated planning of the city should be integrated into the annual plan for the investment of fixed assets, and the municipal water administration authorities, municipal hydrology terminals and relevant district hydrological institutions (hereinafter referred to as hydrological institutions) should be organized in accordance with the national fixed asset investment project.

The new construction, alteration, expansion of the hydro-facilitation project needs to be accompanied by the construction or updating of the hydrology network, and requirements should be included in the construction budget estimates.

Article 7

The hydrology stations are subject to classification management.

The hydrological stations in the city are divided into national basic hydrology stations and specialized hydrology stations.

The State's basic hydrological stations are divided into major national hydrological stations and general hydrology stations.

The municipal water service can determine, on the basis of actual circumstances, the city-level critical hydrology stations in the general hydrology stations.

Article 8

The establishment and adaptation of the State's major hydrology stations are presented by the Municipal Water Bureau in accordance with the planning of the current city's hydrology network, which is approved by the Department of State Water Administration. The establishment and adaptation of the General Hydrographic Station is proposed by the Urban Hydrographic General station in accordance with the planning of the hydro network of the city and, with the approval of the municipal water service, is presented to the Department of State Water Administration for the sole hydrological institution.

Article 9

The establishment of a dedicated hydrology station should be approved in accordance with the relevant provisions of the State. Of these, the management of the management, such as transport, shipping, environmental protection, requires the establishment of a dedicated hydrological metric station, which is approved by the relevant administration, should seek the advice of the municipal hydrology chiefs before approval.

Article 10

The establishment of a dedicated hydrology station should have the following conditions:

(i) Monitoring data at national basic hydrological stations cannot meet their specific needs;

(ii) In line with the relevant standards and norms for hydrological monitoring.

Article 11

Applications for the establishment of a dedicated hydrology station should be made available to the commune hydrology station and submitted the following materials:

(i) Applications;

(ii) A survey report on the establishment of specialized hydrology stations.

The applicant should be treated in full, in accordance with the statutory form and within the scope of the application; the submissions are incomplete or incompatible with the provision and should be communicated to the applicant within three working days. It was not later informed that it would be admissible from the date of receipt of the request.

Article 12

Upon receipt of the request for the establishment of a dedicated hydrological metric station, the application shall be reviewed and the approval shall be decided within 15 working days from the date of receipt of the application. The decision should be approved by the establishment of a dedicated hydrological metric station for approval; the reasons for the applicant should be communicated in writing. For special reasons, no decision could be taken within 15 working days, with the approval of the head of the municipal hydrology station, 10 working days could be extended and the applicant should be informed of the reasons for the extension period.

Article 13

As a result of the administration, such as transport, shipping, environmental protection, the establishment of a dedicated hydrological metric station, with respect to the administration sector seeking advice from the commune hydrology station, should be made within 10 working days from the date of receipt of the material.

The relevant administrations, such as transport ports, maritime and environmental protection, have approved the decision to establish a dedicated hydrological metric station, which should be replicated within 10 working days of the date of ratification.

Article 14.

The dedicated hydrological stations are constructed and operated by the establishment of units, or are also entrusted with the construction and operation of hydrological institutions.

Article 15

There is a need to withdraw specialized hydrology stations, which should be communicated to the city's General hydrology station in advance of the withdrawal of 30 days to seek the views of the city's hydrology station. The commune hydrological station considers that there is a need for a reservation that may be taken over by consensus with the establishment of the dedicated hydrological station.

Chapter III

Article 16

The present city's hydrological monitoring includes monitoring, analysis and calculations of rivers, lakes, channels, water treasures, water quality, water temperature, cement, water terrain and groundwater resources, as well as rainfall, vapour, water condition, storm surges.

The units or individuals involved in hydrological monitoring activities should comply with national hydrological technical norms, guarantee quality of monitoring and refrain from countering hydrological monitoring information.

The State's basic hydrological stations should not be allowed to suspend hydrological monitoring. Monitoring activities for objective reasons should be reported to hydrological institutions in a timely manner. Hydrographic institutions should take immediate and effective measures to ensure continuous monitoring activities. In the absence of measures, the commune of the city was of the view that there was a need for suspension of monitoring and that it should be submitted to the State's General Hydrographies for approval by the Municipal Water Authority; and that, with the consent of the National Authority, it should be reported that the Department of State Water Administration was invited to approve by the immediate hydrological agency.

Article 17

Hydrographic institutions should maintain continuity in hydro-monitoring and strengthen dynamic monitoring of water resources, with a focus on strengthening water functional areas, rural and urban drinking water sources, critical water access and dynamic monitoring and evaluation of the water quality situation, the regular production of water functional areas and water-water water-water water-saving water quality, water quality monitoring reports, and the delivery of water-related administrative authorities to the Government.

Article 18

Hydrographic institutions should establish systems for monitoring emergency monitoring of sudden-onset changes in water or water pollution.

It is possible to detect changes in water quality, which may occur as a result of sudden-on-scale water contamination or to identify changes in water volumes that may endanger the prevention of water, water security, and hydrological institutions should initiate emergency monitoring and investigation and, in a timely manner, report on monitoring, investigation reports to the same level of government water administration, environmental protection, maritime and other relevant administration sectors.

Article 19

Hydrographic institutions can entrust other units or individuals with hydrological monitoring operations by purchasing services. The units or individuals entrusted should be engaged in hydrological monitoring activities in accordance with the authorization.

The commissioning projects under the preceding paragraph fall within the scope of government procurement and should be implemented in accordance with the relevant provisions of the State and the city.

Article 20

In the relevant districts, hydrological institutions should report hydrological information such as rivers, lakes, channels, water banks and other water bodies on time and accurately to the municipalities and district people's government command agencies, the relevant district water administration authorities, and the municipal hydrology station, without reporting, delay, misstatement, concealment.

Hydrographic institutions that undertake hydrological forecasting missions should report to the same-level people's government in the area of command and water administration in accordance with hydrological information.

Hydrographic stations and hydrological institutions that are responsible for the reporting of hydrological information forecasts to the water administration authorities of the Department of State or to the watershed management body should be sent in accordance with the relevant national provisions.

For the production of hydrological forecasts, the establishment of specialized hydrology stations should be synchronized.

Article 21

The city's hydrological information forecasts are published by the Municipal People's Government's Commander, the Municipal Water Authority or the municipal hydrology station in accordance with the terms of reference.

The day-to-day hydrological information forecasts were made available to the community by the city's hydrology station, and the Municipal Water Bureau should issue the corresponding warnings to the community in accordance with hydrological forecasts; the hydro information forecasts related to the prevention of roughs during the period of the town; and the town's Government's command.

Any other unit or person is prohibited to issue hydrological information forecasts to society.

The media, such as radio, television, newspapers and networks, should be broadcast, published and published in a timely manner, in accordance with the relevant national provisions and the drought prevention requirements, and indicate the time for the issuance of institutions and issuance.

Chapter IV

Article 2 (Transmission of hydrological monitoring information)

The information on hydrological monitoring in the city is implemented in a harmonized system of referrals.

The commune hydrology station is responsible for the management of hydrological monitoring information in the city.

In the relevant districts, hydrological institutions should be integrated into the original hydrological monitoring information for their management hydrology stations, in accordance with national hydrological technical standards, and, by the end of March of each year, to transmit to the city's hydrological stations information for the previous year.

The establishment of specialized hydrological stations and other units engaged in hydrological monitoring activities such as surface water and groundwater resources, water quality and water quality (hereinafter referred to as other hydrological monitoring units) shall be communicated to the city's hydrological monitoring information at the end of March, in accordance with the information management authority.

Article 23 (Review and preservation of hydrological monitoring information)

The commune hydrology station should review the shipment of hydrological monitoring information and ensure the integrity, reliability and consistency of the information delivered.

The commune hydrology station should be transferred to the watershed management body designated by the National Water Administration authorities in accordance with the relevant national provisions.

The commune hydrological station should establish the hydrological monitoring information file, properly store and maintain the original hydrological monitoring information and integration results, and take effective measures, such as geodetic backup.

Article 24

The commune hydrology station should strengthen its analytical studies on the integration of results and provide services to government policymaking, economic and social development and the public.

The commune hydrology station should compile results in accordance with national hydro-technical standards and make them available on a regular basis, in accordance with national economic and social development needs. The establishment of units and other hydrological monitoring units to deal with hydrological monitoring information needs to be compiled, and the city's hydrology station should be provided.

Article 25

Information on hydrological monitoring, other than national secrets, should be made public by law. The commune hydrology station should prepare and publish public inventories to facilitate public access.

The information on hydrological monitoring is secret in the State and is carried out in accordance with the relevant provisions of the State.

Article 26

The city's hydrological monitoring information used in the preparation of a variety of important integrated planning, specific planning and water management or major construction work feasibility studies should be reviewed by the State Department's Water Administration, Watershed management or municipal hydrology stations to ensure their integrity, reliability and consistency.

Article 27

The decision-making and defence, public safety and environmental protection of public goods, such as disaster mitigation, defence, public safety and environmental protection, require the use of hydrological monitoring information and results, can be presented to the city's hydrological station and provided free of charge, as confirmed by the municipal hydrology station.

Article 28 (Review of requests and receipt of hydrological monitoring information)

Hydrographic monitoring material obtained from the immediate hydrological institutions, watershed management bodies, municipal hydrology stations or relevant zonal hydrological institutions needs to be reviewed by the State Department's Water Administration, and the following materials should be made available:

(i) Review of the application form for hydrological monitoring;

(ii) The applicant's legal status certificate;

(iii) The information and sources used by the applicant.

The commune hydrological station should make written review conclusions within 15 working days of the date of receipt of the application.

Article 29

Citizens, legal persons or other organizations are required to provide specialized hydrological advisory services to hydrological institutions for business activities, and the parties should enter into paid service contracts to clarify the rights and obligations of both parties.

The income and expenditure generated by the former provision of advisory services should be reflected in budgetary management in accordance with the relevant national provisions.

Article 33 (Information-sharing system)

The commune hydrological station should strengthen administrative communication with the executive branch of the environment, transport ports, maritime, meteorological, etc., establish a system for sharing information on hydrological monitoring and related operational information, conclude agreements for sharing clear information on the rights and obligations of the parties.

Chapter V

Article 31

The present city's hydrology, water resource survey evaluation includes specialized activities such as monitoring of surface water, water quantity and water quality projects, hydrological surveys, hydrology measurements, water accessibility surveys, hydro-hydro information forecasts, design and implementation of hydrology system works, hydrological analysis and calculations, and water resource surveys and water quality evaluation.

Article 32 (Option of evaluation requirements)

Hydrographic, water resource surveys should be conducted in accordance with the relevant provisions of national and present municipalities and technical standards to collect the basic information relevant to the assessment of the quantity, quality and development of water resources through regional surveys, typical surveys, interim testing and analysis of estimates.

The assessment of hydrology, water resources should be based on objective, scientific, systematic principles, quantitative calculations of basic information on the survey of water resources, analysis of the supply-side relationship of water resources and forecasting their changing trends.

Article 33 (Organization of the evaluation)

The municipal water authorities and the relevant district water administrations should conduct an evaluation of hydrology, water resources survey with relevant sector organizations, in accordance with the needs of the current city's economic and social development.

The assessment of hydrology, water resources in the administrative areas of the relevant districts is organized by the relevant district water administration authorities; the cross-zone, municipal-wide hydrology, water resource survey evaluation, organized by the Urban Water Services Authority.

The municipal water authorities and the relevant district water administration authorities can entrust the hydrological, water resource survey evaluation to the appropriate quality of hydrology, water resource survey evaluation units.

Article 34 (Option and publication)

The results of the assessment of hydrology, water resources survey units conducted by the trusted hydrology, water resources survey units, and the municipal water authorities or the relevant district water administrations should be reviewed with the relevant sectors.

The municipal water service or the relevant district territorial water administration authorities should incorporate the findings of the certified hydrology, water resources survey into the water resource bulletin and make it available to society on a regular basis.

Article XV (Support of surveys by other units and individuals)

Civil, legal or other organizations are required to carry out an assessment of hydrology, water resources survey and should be entrusted with the corresponding qualifications of hydrology, water resource survey evaluation units.

The units that are entrusted shall, after the contract is delegated, be charged to the Municipal Water Authority or to the relevant territorial water administration authorities. The Municipal Water Authority or the relevant district water administration authorities should provide administrative guidance to strengthen administrative regulation.

Chapter VI

Article XVI (protection obligations)

No unit or individual shall be intrusive, destroyed, forcibly moved or unauthorized to use hydrological monitoring facilities without disrupting hydrological monitoring.

Any unit and individual found damage to hydrological monitoring facilities and monitoring the environment and was entitled to report to the water administrative authorities or to hydrological institutions. The reported water administration authorities and hydrological institutions should be surveyed in a timely manner, and the survey is conducted in real condition and can give appropriate incentives to the reporting units or individuals.

Article 37 (Transport of the National Basic Hydrographic Observatory)

No unit or individual may be relocated to the basic hydrological stations of the country without approval. As a result of the relocation of major engineering construction requires, construction units should apply to the Urban Water Authority prior to the construction of the project, approved by the Municipal Water Services Agency or transferred to the Department of State Water's immediate hydrological agency. The cost of relocation of hydrology stations is borne by construction units.

The commune hydrological station should justify the location, location, monitoring of the environment, measuring function, and determine the location of the relocation according to the results of the argument.

The relocation of basic hydrological stations in the country should take measures to ensure that hydrological monitoring is carried out normally during the relocation period.

Article 338 (Simplication of the National Basic Hydrographic Observatory)

The construction of work affecting hydrological monitoring at the national basic hydrology stations should take appropriate measures to build upon the agreement of the water administration authorities with the management competence of the station.

Hydrographic institutions have found that the construction of work affecting hydrological monitoring at the national basic hydrology stations should be reported to the same-level administrative authorities. The reported water administration authorities should be responsible for taking appropriate measures by the construction units to fill the relevant procedures and to ensure the normal conduct of hydrological monitoring during the work.

As a result of the construction of the work, the cost was borne by the construction unit.

Article 39 (Status and symbols of monitoring environmental protection)

The scope of hydrological monitoring of environmental protection should be determined in accordance with the relevant national provisions.

The planning of the commune hydrology network should clearly monitor the scope of environmental protection.

The People's Government of the District should delineate the scope of hydrological monitoring of environmental protection in accordance with the city's hydrology network and establish groundmarks on the scope of protection borders, with specific work being carried out by the Municipal Water Authority and the relevant district water administration authorities.

No unit or individual shall be in violation of national provisions to engage in activities that affect hydrological monitoring within the context of hydrological monitoring.

Article 40 (monitoring protection)

Hydrographic monitoring operations need to be occupied by road or bridges, with the consent of the relevant administrations, such as public safety, transport ports, maritime. In the context of hydrological monitoring operations, warning signs should be established, and transport tools such as vehicles, vessels should be synchronized and the relevant administrations, such as public safety, transport ports, maritime.

Chapter VII Legal responsibility

Article 40

Article 42
