Metropolitan Safety Monitoring Approach (The 8th ordinary meeting of the Metropolitan Government of 25 June 2013 considered the adoption of Decree No. 179 of 29 July 2013 by the Government of the Metropolitan People, effective 1 January 2014)
Chapter I General Article 1 (Up of purpose) In order to strengthen the management of ladder security, implement the ladder's safety responsibilities, prevent and reduce gradient security accidents, and develop this approach in line with laws, regulations, such as the People's Republic of China Product Quality Act, the People's Republic of China Security Production Act and the People's Republic of China Special Equipment Safety Act. Article 2 (As applicable) This approach should be adhered to in the ladder production (which includes manufacture, installation, rehabilitation, repair, repair, etc.), sale, use, maintenance, testing and inspection. The method does not apply to the construction of the ladder used by the home building site or by the municipal engineering site, as well as the ladder used by individuals or individual families. Article 3 (Designation of duties) The municipal quality technical supervision sector is responsible for the safety monitoring of gradients throughout the city, and the quality technical supervision of the districts (communes) is responsible for the safety inspection of ITU within this jurisdiction. The Governments of the districts (markets) should strengthen the leadership of the ladder's safety monitoring, monitoring and management, establish a coordination mechanism for the management of the ladder's emergency response, promote and support the implementation of the ladder safety monitoring, oversight and management responsibilities under the law, and coordinate and address critical issues in the ladder use and safety monitoring within the present administration, monitoring management. The street offices, the communes' governments should assist the relevant departments in the monitoring, supervision and management of ITUs within their territories, in collaboration with the relevant sector in the safe inspection of the ladder use units. Article 4 (Education) Governments at all levels, schools, the media, social groups, grass-roots self-government organizations and ITU use units should conduct advocacy, universal work on ladder safety knowledge and legal regulations, advocate for civilization multipliers and enhance public safety awareness and self-protection capacities. Article 5 (New technologies applications and insurance) The use of advanced technologies and advanced management methods is encouraged to increase the safety and management levels of ITU. The ladder security responsibility insurance system was encouraged. Chapter II Article 6. The units engaged in gradient manufacturing, installation, rehabilitation and repair shall be subject to the appropriate administrative licence by law and shall not be forged, altered, rented, transferred licences or monitored inspection reports. The ladder manufacturing unit assumes the primary responsibility for the production, maintenance and maintenance of the ladder and is responsible for the safety of the ladder. The installation, rehabilitation, repair and repair of the ladder must be carried out by the ladder manufacturing unit or the units entrusted by it to obtain the corresponding administrative licence. The construction unit shall not subcontract or reproduce the operation. Article 7. The operational personnel employed by the ladder manufacture, installation, rehabilitation and repair units should be obtained by the Special Equipment Operations Officer. Operational personnel should be given evidence. Article 8. The quality of production of ITU, including the entire machine and spare parts, should be consistent with national mandatory standards and safety technical norms. In the ladder, documents such as the design document required for safety technical norms, the quality of products, the installation and use of maintenance statements should be accompanied. The ladder test body should monitor the installation, adaptation and major repair processes, as required by the safety technology norm. Article 11 (Percentage) Construction units should perform the following responsibilities for ITU safety management: (i) Authorize units with corresponding qualifications to carry out construction map designs related to ladder-related construction structures, such as elective configurations, to ensure that the construction structure is in line with the special requirements for ITU installation, to ensure that ITU adapts to the use needs of buildings and to ensure that the design documents are reviewed by law through the construction of administrative authorities; (ii) Ensure that the ladder of the procurement complies with the design documents and contract requirements and assumes its associated responsibility for quality assurance in the procurement ladder and promote the coordination of the ladder manufacture, installation units in compliance with the relevant laws, regulations and contracts; (iii) When gradient inputs are used, construction units are inconsistent with the use units, and construction units should ensure that gradients transferred to the user units meet the requirements for safety-technical norms, while transferring complete security technical files, warning signs and ITU use symbols. Article 12 (Recommendation requirements) The owner of the ladder shall select the ladder manufacturing unit or the units entrusted by it to obtain the corresponding administrative licence. The former ladder manufacturing units have been cancelled or no longer have the corresponding ladder manufacturing licence, and the owner of the ladder's property can choose to obtain the corresponding administrative licence in accordance with the law. The ladder use units should conduct registration procedures to the municipal quality technical oversight sector within thirty days prior to their use or after their use. Article 15 (Security responsibility for the use of units) The ladder use units should perform the following safety responsibilities: (i) Establish and strictly implement the ladder's use and operation security management system, establish a ladder safety management body or a ladder safety manager with the acquisition of the Special Equipment Operations Manual, establish a full gradient security technical file and maintain a long-term record, prepare pre-emptions for gradient emergencies and safe accident response, and organize at least one emergency relief exercise per year; (ii) placing ITU safety concerns, warning signs and the necessary information at a visible place where the passengers are prone to attention, and posting effective ITU use symbols within or from the entrance; (iii) To ensure that conditions such as ventilation, temperature, humidity, electric pressure are in compliance with the relevant standards and technical norms and to ensure reliable and effective linkages between ITUPS and value classes; (iv) In the event of a failure by the ladder, timely measures were taken to secure passengers and organize relief. In cases where serious accidents affecting the use of the ladder are hidden, the immediate cessation of the operation of the ladder, the organization of a comprehensive inspection and the elimination of accidents may be redirected; (v) The ladder repair contract with the ladder manufacturing unit or units entrusted by it by law, and the ladder maintenance contract with the ladder maintenance unit, the organization, supervision and cooperation with the ladder's repair, maintenance and maintenance; (vi) The immediate organization of emergency relief, drainage and rescue, protection of accident sites and timely reporting to the local people's Governments and relevant sectors when gradient security accidents occur; (vii) Other responsibilities under legal, regulatory and security technical norms. Article 16 (Management of the safe use of cigarettes in small residential areas) The management of the safe use of the ladder in the residential small area should also be in line with the following rules: (i) The statute of the management of the owners should provide for the mobilization and use of specific funds such as ladder use, management, maintenance, repair, rehabilitation, updating, and the preparation of emergency maintenance clearance cases; (ii) The Commission shall expressly agree upon the rights, obligations and responsibilities of the ladder in the management of the use of the ladder in accordance with the regulations governing the operation. Businessless service providers should continue to assume the responsibility for the management of safety in the ladder, with the consent of the owners or the main congresses to the street offices of the city, the communes' government, and with the consent of the owners, the owners' Congress or the local street offices, the commune government's temporary designated industry service providers to assume responsibility for the management of safety. Article 17 (Strategic test) The ladder test cycle is one year. The ladder use unit shall submit a ladder test application to the ladder test body within the previous month of the ladder use mark. Article 18 (Financing of funds) The ladder use units should raise the necessary and full funding by law. Chapter IV Article 20 (Service requirements for maintenance units) The maintenance of the ladder shall be carried out by the installation, rehabilitation, repair and repair units of the ladder manufacture unit or by the appropriate administrative licence under the law. The ladder maintenance unit shall not be forged, altered, rented, transfer of licences or related inspection reports, nor shall it be subcontracted or transferred. Article 21 (Reservation of eligibility requirements for maintenance) The operational personnel employed by the ladder Maintenance Unit should obtain the Special Equipment Operations Certificate. Operational personnel should be given evidence. Article 22 (Assessment and confirmation of maintenance capacity) Prior to the conclusion of the ladder maintenance contract by the ladder maintenance unit, a comprehensive assessment and recognition of the personnel, technology, equipment and spare parts that are required to maintain the ladder's safety, reliability and maintenance should be undertaken to ensure that they are able to secure the safe operation of the ladder. Article 23. Maintenance of contract content The ladder maintenance unit shall enter into a maintenance contract with the ladder's use unit in accordance with the state of safety technology for the maintenance of the ladder. Maintenance contracts should include, but not limited to, the following: (i) The rights, obligations and responsibilities of both parties in the maintenance of ITU; (ii) The nature, content and implementation criteria for the maintenance of ITU; (iii) The ladder maintenance date and maintenance frequency; (iv) To assist the ladder in the development of the ladder's obligation to prepare pre-empt cases of ladder emergencies and safe accident response; (v) Time of failure to report and emergency relief. Article 24 (Service of maintenance units) The ladder maintenance unit should be responsible for its maintenance of the safety of the ladder and perform the following safety responsibilities: (i) Strict implementation of the safety technical norms and the installation of maintenance statements by the ladder, the development of maintenance plans, the conduct of maintenance at least 15 days of maintenance, such as completion of the maintenance records and failures of the ladder, and the filing of a record; (ii) In the process of ladder maintenance, the supervision of the ladder and ladder use units found that accidents should be informed in a timely manner of the ladder's use units and that serious accidents should also be reported in a timely manner to the local quality technical oversight sector; (iii) In maintaining the maintenance of the ladder of small-scale residential areas, information such as the ladder's security, maintenance, etc., should be communicated to the owners in small zones on a monthly basis; (iv) The establishment of a 24-hour maintenance service telephone to ensure that the notice of failure is promptly excluded. Upon receipt of the ladder's failure report or an accident notification, the maintenance staff must arrive within thirty minutes for their maintenance of the ladder and carry out on-site rescue; (v) The development of ladder emergency response measures and relief prestiges, and the conduct of an emergency response exercise at least half a year against different categories (types) of maintenance of this unit and, in writing, a record; (vi) When gradient maintenance is terminated, it should be ensured that the transferee meets the requirements of the safety-technical norms and that it shall not interfere with the normal operation and security of the ladder; (vii) Other responsibilities under legal, regulatory and security technical norms. Chapter V Article 25 (Requiring requirements) The ladder test test should be conducted by a security-technical test body authorized by law. Persons engaged in the ladder test should be eligible by law. The ladder test body and its practitioners shall not engage in gradient production, sale, shall not be recommended in their name, custodial, gradient, or recommend maintenance units. Article 26 (Option of testing duties) The ladder test body and its test personnel should perform the following duties: (i) To provide safe, reliable, accessible and good-faith testing services for the ladder's use units to perform confidentiality obligations for known commercial secrets; (ii) Timely screening reports and the collection of inspection fees in accordance with the relevant provisions; (iii) In carrying out the ladder's monitoring test, the local quality technical oversight component should be informed and monitored by the local quality technical oversight component on the implementation of the responsibilities of the ITU use units. Article 27 (Expressive notification and reporting) The ladder test body and its test steachers have found that the ladder has a safety concealment or accident hidden in the testing tests, and should be informed in writing about the timely measures taken by the ladder's use units. When the ladder test body and its test sensor found a severe accident in the test, the ladder use units should be informed of the immediate cessation of the use of the ladder and immediate reporting to the quality technical oversight department of the ladder sites. Chapter VI Article 28 (Security inspection requirements) The quality technical supervision sector should establish a quality assurance appraisal system for the services of ladder manufacturing, installation, rehabilitation, maintenance and maintenance units, to strengthen the public's focus on the safety of ITUs and to conduct timely investigations into reports and complaints involving ITU safety. The construction of administrative authorities should monitor the quality of construction design units, construction units related to activities and works in construction. The business administration sector should conduct oversight inspections of the operation of the ladder market. Housing management should conduct oversight inspections of activities related to the business sector and incorporate the ladder safety management level into the credit regulation and evaluation management of the business sector. The management of safe production oversight should coordinate the work of the relevant sectors for the safety of ladder. Article 29 (Chiefing disposal) The quality-technical oversight department found that the ladder's production, use, maintenance units or inspection bodies had committed violations or had been concealed by accidents in the ladder, and should send a safety inspection directive on special equipment in writing to oblige the units concerned to take timely measures to correct or stop the use of the ladder of accidents. The quality technical supervision sector found that there were severe accidents in the ladder should be reported immediately on the local people's government and the secondary quality technical oversight sector; the need for sectoral support and collaboration should also be informed in a timely manner. Article 31 (Accident investigation) In the aftermath of the ladder security accident, the Government of the more than the population at the district level of the accident and the sectors with the security supervision function should be removed immediately after the receipt of the ladder safety accident report, to verify the accident and to report it in accordance with the law. Chapter VII Legal responsibility Article 32 (Responsibility of production units) In violation of this approach, there are one of the following subparagraphs (i) and (ii) in one of the following cases, which are converted by the quality technical supervision sector to a period of time and are fined by more than one thousand dollars; there are the following subparagraph (iii) cases in which the period of time is to be converted by the quality technical supervision sector, with a fine of more than three million yen, in the event of serious circumstances, with the release of its corresponding licence or qualifications: (i) The installation, rehabilitation, repair and repair of the ladder's installation, rehabilitation, repair and repair without the authorization of the ladder manufacturing unit; (ii) The ladder manufacture, installation, rehabilitation, repair and maintenance unit arrangements for personnel who do not have access to the Special Equipment Operations Manual for the installation, rehabilitation, repair or unauthorized induction of their operators; (iii) The ladder installed, rehabilitated, repaired units subcontracted or reproduced its operations. Article 33 (Responsibility of sales units and installation units) In violation of this approach, the ladder sales unit or the ladder's installation units sell or install the ladder technology material attached to the non- manufacturer unit, which is converted by the business administration sector, the quality technical supervision sector, and fines of over three million yen. Article 34 (Responsibility of construction units) In violation of this approach, construction units have not been transferred to the full security technical archives, warning signs and ladder use symbols by the quality-technical supervisory authority, which has been delayed by a fine of more than one thousand ktonnes. Article 35 (Responsibility of all property rights and rehabilitation units) In violation of this approach, there are the following subparagraph (i) cases in which a period of time is to be converted by the quality technical supervision sector to a period of time, which is not reformulated, with a fine of more than one thousand dollars, and one of the following subparagraphs (ii) and (iii) in one of the following cases, with a period of time being converted from the responsibility of the quality technical supervision sector and a fine of up to two thousand dollars: (i) The owner has chosen to renovate the ladder by units that have been authorized by the ladder manufacturing units in accordance with the law; (ii) The ladder owner chooses to renovate units that do not obtain the corresponding administrative licence by law; (iii) Upon completion of the ladder transformation, the ladder has not been tested and piloted in accordance with the requirements of the safety-technical norms or has not replaced its gradients, without identifying the name of the unit in the product motto, the quality certificate, the date of transformation, the manufacture of the unit's ladder and the renovation of administrative licences. Article 36 (Responsibility of using units) In violation of this approach, the ladder use unit consists of one of the following subparagraphs (i) to (iv) in one of the following subparagraphs: (i) to (iv) in one of the following cases, changes in the quality-technical supervisory authority period, discontinuation of the use of the relevant ladder, with a fine of more than one million dollars; one of the following subparagraphs (v) and (vi) cases, with a fine of one thousand dollars: (i) Failure to establish and strictly implement the ladder's security management system or to organize emergency relief exercises as prescribed; (ii) Conditions such as ventilation, temperature, humidity, electric pressure are not in accordance with the relevant standards and technical norms or are not in a position to achieve a reliable and effective link between the ladder's police units and the duty station; (iii) The ladder repair contract was not concluded with the ladder manufacture unit or the unit entrusted to it by law, or the ladder maintenance contract was not concluded with the ladder maintenance unit; (iv) No reasonable staffing of ladder security managers in accordance with the residential small-scale construction area or no relevant information is provided to the owners of the industry; (v) No measures taken to organize relief when a person suffers, or to continue to use severe accidents hidden ladder; (vi) No provision for the organization of gradient repairs, maintenance of maintenance, or an ladder repairs and maintenance of units that have not been authorized by law. Article 37 (Responsibility to maintain maintenance units) In violation of this approach, the ladder maintenance unit has one of the following subparagraphs (i), (ii) and one of the following subparagraphs (i) and (ii) of the quality-technical supervisory authority, which is subject to a fine of up to two thousand dollars; one of the following subparagraphs (iii), (iv) of subparagraph (iv) is subject to a reduction in the period of time period of time of responsibility of the quality technical supervision sector and a fine of more than three0,000 dollars, in the event of a serious dismissal of the licence of the relevant sector: (i) The personnel of their operations are not accredited; (ii) No provision is included in maintenance contracts; (iii) Constraints, conversions, borrowings, transfer of licences or related inspection reports, or subcontract or reproduce their operations; (iv) No corresponding security responsibilities are performed. Article 338 (other legal responsibility) In violation of other acts provided for in this approach, laws, regulations, regulations and regulations have been dealt with and are regulated by them. Article 39 (Central accountability) The executive organs and their staff abuse their functions in the performance of the ladder's safety regulatory responsibilities, play negligence, infrastructural fraud, are subject to administrative disposition by law; constitute crimes and hold criminal responsibility under the law. Chapter VIII Article 40 (Day of operation) This approach has been implemented effective 1 January 2014. |
