Public security video information system management approach in the Uighur self-government area

(Summit 15th ordinary meeting of the Twelfth People's Government of the Autonomous Region of 17 April 2014 to discuss the adoption of the Decree No. 190 of 1 May 2005 No. 190 of the People's Government Order No. 190 of the New Boyur Self-Government Zone, effective 1 July 2014)

In order to regulate the construction and management of public safety video information systems, to maintain public safety, to raise public service and management levels, to guarantee the legitimate rights and interests of citizens, legal persons and other organizations, and to develop this approach in the light of relevant national legislation, legislation and regulations.

Article 2 Planning, construction, application, maintenance and management of public safety video information systems in the administrative areas of the self-government area apply.

Article 3. This approach refers to a public safety video information system (hereinafter referred to as a public video system) that uses image-gathering equipment and other related equipment to provide a video system for recording information in regions involving public safety.

Article IV

Article 5 The construction and management of public video systems should be integrated into the integrated governance objectives of social management.

Article 8 prohibits the installation of public video systems in places where personal privacy is concerned:

(i) hotels, guest houses and recreational accommodations;

(ii) Staff accommodation, public bathroom, public health, probationary, clothing, breastfeeding rooms;

(iii) The location of customer information may be disclosed within financial, insurance and securities institutions;

(iv) Regions where individual will be expressed or committed, such as electoral boxes, reporting boxes, voting points;

(v) Other places involving personal privacy and regions.

No unit or individual shall be authorized to establish and install a public video system within the scope set out in article VI of this approach.

Article 9. Public security authorities should integrate resources into public video systems, as required by law, security and norms, and achieve video-sharing.

Article 10 construction, alteration and expansion of construction projects should build public video systems in accordance with this approach and be designed in parallel with the project's main works.

Construction units should select public video systems that meet national standards and technical norms.

Article 11 builds a public video system that should be entrusted with the design, construction in accordance with national standards and technical norms.

Article 12 The public video system should be available to local (market) public security authorities within 30 days of the date of the use of inputs; the scheme has been completed before its operation and should be available from 60 days from the date of operation of the scheme.

The removal of public video systems or related facilities, equipment should be made available to local (market) public security authorities within 30 days of dismantlement due to objective changes.

Article 13 establishes outdoor advertisements, construction lines, vegetation or other facilities and does not obviate the collection of equipment for public video systems information.

Article 14.

(i) The establishment of a robust operation maintenance, security inspection and emergency response system;

(ii) Training in custodial and management skills and confidential knowledge;

(iii) Registration of recordings, distributors, time-consuming, user-relevant uses and referrals;

(iv) Identify suspicious information involving public safety and report promptly to public security authorities;

(v) The effective storage period for information is not less than 30 days, and important information on public safety is not less than two years.

No unit or individual shall commit the following acts:

(i) Removal of the use of public video systems;

(ii) Removal, concealment and destruction of the original records of the public video system for the period of storage;

(iii) Receive access, reproduction, provision and dissemination of information on public video systems;

(iv) To deny and impede the use of public video systems and information materials by the authorities concerned;

(v) Theft or intentional destruction of public video systems;

(vi) Other influences the use of public video systems by law.

Article 16, with the approval of the Head of the Authority, may use the public security authorities, the national security agencies listed in article VI of this approach, the public video system set out in Article 7, or access the system to a defined video system; and the management of the investigation, disposal of sudden events can access, replicate or redirect information on the public video system.

A unit other than the preceding paragraph or an individual is required to obtain, replicate or redirect information on the public video system, which should be approved by the local district (market) public security authorities.

Article 17 Access, reproduction or retrieval of information from public video systems should be subject to the following provisions:

(i) Submission of work cards, identity documents;

(ii) The presentation of a unit to substantiate the documentation and approval of documents by public security authorities;

(iii) On-site personnel are not less than two;

(iv) Compliance with the confidentiality regime.

No unit or individual shall be able to obtain, replicate or reliant information from the public video system.

Article 18, in violation of article 7 of this approach, has been established by the public security authorities in the district (market) for a period of time; there has been no construction and a fine of up to 3,000 dollars.

Article 19, in violation of articles 8, 12, 13 and 13 of this approach, has been corrected by the public security organs above the district (market) and by a fine of up to 1000 dollars over 200 million dollars.

Article 20, in violation of articles 14, 15, 17, paragraph 2, of this approach, has been corrected by a public security authority over the district (market) and a fine of up to $2 million.

Article 21, in violation of this approach, provides that other acts of legal responsibility should be carried out in accordance with the relevant laws, regulations.

Article 2 concerns management staff members who are in breach of this approach, toys negligence, abuse of authority, provocative fraud and administrative disposition by virtue of law by this sector or by administrative inspection bodies; and to hold criminal responsibility in accordance with the law.

Article 23 of this approach is implemented effective 1 July 2014.
