Releasing of aquatic organisms regulations (March 24, 2009, the Ministry of Agriculture announced as of May 1, 2009, 20th)

     Releasing first to standardize the aquatic activities, science to the conservation of living aquatic resources, maintaining biodiversity and ecological security, promote sustainable and healthy development of fisheries, in accordance with the People's Republic of China fisheries law and the People's Republic of China wild animal protection law and other laws and regulations, this provision is enacted.

     Second releasing of aquatic organisms in these rules refers to release, at the end of sowing, transplanting and other artificial ways to the sea, rivers, lakes, reservoirs, and other public waters, seeds and other living aquatic activities.

     Article in the People's Republic of China for releasing aquatic activities in the waters under the jurisdiction of, and shall comply with these requirements.

     Local fishery administrative departments of the people's Government at or above the county level shall be responsible for the releasing of aquatic organisms within the administrative area of organization, coordination and supervision.

     Article fishery administrative departments at all levels should increase investment in releasing of aquatic organisms, and actively guide and encourage financial support of living aquatic resources conservation and releasing. Special funds should be earmarked for releasing aquatic and comply with the relevant regulations.

     Fishery administrative departments using Community funds for releasing shall be made to the community, the use of the public funds of the investors.

     Sixth fishery administrative departments of the people's Governments above the county level shall actively carry out aquatic living resources and releasing propaganda and education, enhance their civic awareness of conservation of living aquatic resources, protecting the ecological environment. Seventh fishery administrative departments of the people's Governments above the county level shall encourage units, individuals and the community through subscription release seeds, donor funding, volunteer and other ways and means of participation, releasing aquatic events.

     Units and individuals for outstanding contributions, should be given publicity and encouragement in an appropriate manner.

     Eighth local fishery administrative departments of the people's Government at or above the county level shall, within their respective administrative areas releasing planning of aquatic organisms, and fishery administrative departments at a higher level for the record. Nineth for releasing captive-bred species of aquatic organisms should be from a qualified production units.     Among them, an economic species, should come from the holdings of the seed production of aquatic seed production license units are a rare and endangered species, should come from the holdings of the seed production of aquatic animal domestication and breeding licenses.

     Fishery administrative departments shall, in accordance with the "open, fair and just" principles of procurement through bidding or bidding for restocking of aquatic organisms or establishing seed production unit. Tenth for releasing of broodstock should be native species, seed and other aquatic organisms.

     Seed should be the original native species or generations, really necessary to release other seed should be adopted by the fishery administration departments at or above the provincial level organizations experts.

     Prohibiting the use of exotic species, hybrid and genetically modified species and other aquatic species ecological requirements are not met for releasing.

     11th for releasing shall be subject to inspection and quarantine of aquatic organisms to ensure healthy disease-free, no residues of banned drugs.

     12th fishery administrative departments of organizations releasing activities should be conducted in public, invited fishermen, research units and social groups represented and subject to public supervision.

     Releasing the aquatic species, quantity, specifications, should open to the public.

     13th units and individual self releasing scale aquatic activities, 15th in advance to the local people's Governments at or above the county level in the local fishery administrative departments of releasing the report type, quantity, size, time, and location matter, accept supervision and inspection.

     Reviewed in accordance with the provisions of releasing activity, local fishery administrative departments of the people's Government at or above the county level should be given the necessary support and assistance.

     Shall report to and accept the supervision and inspection of the releasing of scale standards, local fishery administrative departments under the people's Governments at or above the county level aquatic releasing plans in the region.

     14th releasing shall abide by the people's Governments above provincial level departments of fishery Administration develop aquatic releasing specifications, appropriate ways of releasing to prevent or minimize damage to the release of aquatic organisms.

     15th fishery administrative departments should be taken in releasing waters delineated area, determine the protective measures such as closed seasons, strengthening the proliferation of resource protection, make sure that releasing results.

     16th fishery administrative departments should organize its work on releasing of scientific research and technical guidance, and tagging, tracking, monitoring and social surveys to evaluate the effect of releasing such measures.

     17th local fishery administrative departments of the people's Governments above the county level should be releasing this year's aquatic organisms within the area type, quantity, size, time, location, tagging of quantities and methods, sources of funding and the number and restocking activities statistical summary, at the end of November before the fishery administrative departments at a higher level for the record.

     18th violate the provisions of this article, in accordance with the People's Republic of China fisheries law and the People's Republic of China wildlife conservation law and other relevant laws and regulations are punishable.        The 19th article of the regulations come into force on May 1, 2009.
