Radioactive materials transportation regulations
(October 27, 2010 Ministry of transport [2010] the 6th release come into force on January 1, 2011) Chapter I General provisions
First in order to regulate the road transport of radioactive goods activities, protect people's lives and property safety, protect the environment, according to the road transport regulations and the safety of transport of radioactive materials regulations, this provision is enacted.
Second radioactive goods road transport activities shall abide by these provisions.
Article III radioactive material in these rules refers to radioactive nuclides, and its activity and specific activity items are higher than the exemption value set by the State.
Special vehicles for road transport of radioactive goods mentioned in these regulations (hereinafter referred to as special-purpose vehicles), refers to meet specific technical requirements and requirements for radioactive goods road transport truck.
Road transport of radioactive goods mentioned in these regulations, refers to the use of private vehicles through the process of road transport of radioactive substances.
Article fourth, based on radioactive materials, characteristics and its effects on human health and the potential environmental hazard, radioactive substances are classified into first class, second class and third class.
A kind of radioactive materials, refers to the type of radiation source, high-level radioactive waste, spent fuel released into the environment, such as on human health and the environment have a major radiation of radioactive materials.
Two types of radioactive materials, refers to class II and class III radioactive source and medium level radioactive waste released into the environment, such as on human health and the effects of environmental radiation of radioactive materials.
Three types of radioactive materials, refers to type ⅳ and ⅴ-type radiation sources and low-level radioactive waste, radioactive drugs after release into the environment, such as on human health and environmental effects of small radiation of radioactive materials.
Radioactive substances is classified and directories, nuclear safety supervision Department under the State Council in conjunction with the public security, health, customs, transport, railways, civil aviation, nuclear industry administrative departments of the radioactive materials, specific categories and list implementation.
Fifth radioactive substances shall guarantee the safety of road transport routes, transport according to law, good faith.
Sixth transport departments of the State Council the national road transport of radioactive goods management.
Local people's Governments at or above the county level transportation departments in charge of organization and leadership of the administrative area of radioactive materials, road transport management.
Road transport authorities above county level shall be responsible for the implementation of this administrative area of radioactive materials, road transport management.
Chapter II transport permit qualification
Seventh application for radioactive goods road transport operations, subject to the following conditions:
(A) meet the requirements of special-purpose vehicles and equipment.
1. technical requirements for special vehicles.

2. special vehicles of other requirements.
(1) vehicles owned, and a quantity of 5 or more;
(2) the authorized load of 1 ton van and following vehicles or closed truck;
(3) the vehicle is equipped with online monitoring meets requirements of satellite positioning system and drive recorder function.
3. equipment requirements.
(1) is equipped with effective means of communication;
(2) with the necessary radiation protection standards and adopt regular monitoring instruments.
(B) meet the requirements of the employees.
1. special purpose vehicle drivers to obtain the appropriate license, age less than 60 years of age;
2. drivers engaged in road transport of radioactive goods, handling management and escorts through the seat area of the municipal people's Government Transport Department examinations obtained indicate the qualification categories for the "road transport of radioactive goods" qualification for road transport (hereinafter referred to as qualification for road transport);

Eighth production, distribution, use or disposal of radioactive substances (including radioactive waste shouzhu engaged in the transport of radioactive materials in the process of provinces, autonomous regions and municipalities directly under the urban radioactive waste repository operating unit), subject to the following conditions, you can use the-owned special-purpose vehicles for units not operating road transport activity of radioactive materials:
(A) a department concerned with the approval of the production, sale, use, disposal of radioactive substances is valid proof;
(B) the transport of radioactive goods container that complies with the requirements prescribed by the State;
(C) has knowledge of radiation protection and safety of professional and technical personnel;
(D) meet the conditions of article seventh driver, special-purpose vehicles, equipment, and safety management system, but the number of private vehicles less than 5 units.
The Nineth State encourages strong technical force, equipment and transportation conditions of production, sales, use or disposal of radioactive items in accordance with the conditions laid down in article eighth application for engaging in non-commercial road transport of radioactive goods.

(C) proof of special-purpose vehicles, equipment materials, including: 1. acquisition of vehicles, shall submit the proposed investment vehicle commitment.

2. acquisition of vehicles, shall provide vehicle permit, vehicle technical certificate or copy of vehicle technical inspection certificate and related materials;
3. radiation protection products, illustrative material for monitoring equipment and other equipment.
(D) the driver, handling management and escorts of road transport qualification certificate and copy of driver's license and a copy of safety management certificate;
(E) business programmes and related texts of the safety management system.
Section 11th for units engaged in non-commercial road transport of radioactive goods, to the seat of the municipal administration of road transportation agency upon application, subject to submission to the tenth section (c), (e) provision of material, shall also submit the following documents:
(A) the application form for the road transport of radioactive goods, including basic information, to apply for the transport of radioactive goods (category or name) and so on;
(B) head of unit and a copy of proof of identity, agent and a copy of proof of identity and the power of Attorney;
(C) the law to allow production, sales, use or disposal of radioactive substances is valid;
(D) the transport of radioactive goods containers, monitor inspection qualified certificate;
(E) description of the demand for transport of radioactive goods material;
(Vi) relating to driver's license, qualification certificate and a copy of on road transport;
(G) the work related to professional and technical personnel to prove, shall obtain the relevant qualification certificates in accordance with law, shall also submit the valid qualification documents and copies.
Municipal Road 12th District Transport Authority shall, in accordance with the regulations on road transport and the transport implementation of administrative license procedure, as well as the standardized procedures for the implementation of administrative licensing. Chapter III special vehicle and equipment management

19th prohibits private vehicles for non-transport of radioactive goods, container transport vehicle (including tractors, trailers), and the new transport except tractors and special vehicles for transportation of radioactive drugs.

Chapter fourth transport of radioactive goods

Radioactive materials, road transport operations not radioactive goods road transport units shall not engage in business activities.
23rd the carrier prior to road transport of radioactive goods contracts with shippers, inspection, storage should be submitted by the shipper the following materials:
(A) specifications for transport, including radioactive materials, the name, quantity, physical and chemical forms, risk and so on;
(B) the radiation monitoring reports, one type of radioactive radiation monitoring reports commissioned by the shipper of the goods issued by accredited radiation monitoring bodies, two or three types of radioactive materials, radiation monitoring of reports issued by the shipper;
(C) the nuclear and radiological emergency response guide;
(D) guidance on their loading and unloading operations;
(E) safety guidelines.

Shipper's submission is not complete, or shipment of goods by monitoring does not meet national safety standards for radioactive materials transport, the carrier may not road transport of radioactive goods contracts with shippers.

31st radioactive substances occurring in the transport of nuclear and radiation accidents, the carrier, the shipper shall, in accordance with the nuclear and radiological emergency response guidelines for, combined with the safety in the contents of the emergency plan, emergency work and immediately report the accident to the people's Governments above the county level environmental protection authorities.
32nd article radioactive items road transport enterprise or units should hired has corresponding road transport practitioners qualification card of driving personnel, and handling management personnel and escort personnel, and regularly on driving personnel, and handling management personnel and escort personnel for transport security production and basic emergency knowledge, aspects of training, ensure driving personnel, and handling management personnel and escort personnel familiar about safety regulations, and standard and related operation, business knowledge and skills.
Radioactive goods road transport enterprises or units drivers, loading and unloading should be managers and escorts for transportation safety production knowledge and basic emergency assessment; failed to pass the examination shall not be engaged in related work.
33rd article of radioactive goods road transport enterprises or units shall, in accordance with the provisions of the occupational-disease-prevention, driver, handling personal dose monitoring management and escort personnel, establish individual dose record and occupational health surveillance archives.
34th article of radioactive goods road transport enterprises or units shall cover the dangerous cargo carrier liability insurance.
35th article of radioactive goods road transport enterprises or units may not be transferred, leased, lent radioactive materials licensing for road transport.
36th road transport authorities above the county level shall supervise radioactive goods road transport enterprises or units of special-purpose vehicles, equipment and safety systems and security conditions to establish the corresponding self test system, and strengthen supervision and inspection.
Road transportation management staff in institutions above the county level shall conduct supervision and inspection of radioactive goods road transport activities, should be equipped with necessary safety equipment in accordance with labour protection.
The fifth chapter legal liability

40th article violates these provisions, radioactive goods road transport enterprises or unauthorized modifications have been made to the road transport certificates of special-purpose vehicles, the road transport authorities above the county level shall order rectification, fined not more than 5000 Yuan and 20,000 yuan.
41st article violates these provisions, no onboard of the road transport permits, the road transport authorities above the county level shall order rectification of radioactive goods road transport enterprises or units warned or fined not more than 20 Yuan and 200 Yuan.
42nd article of radioactive goods road transport activities, does not comply with the provisions of article seventh, eighth rules conditions of personnel of special-purpose vehicles, the road transport authorities above the county level shall order rectification, between of less than 2000 Yuan and 200 Yuan fines constitute a crime, criminal responsibility shall be investigated according to law.
43rd article violates these provisions, radioactive goods road transport enterprises or units of any of the following acts, covered by the road transport authorities above the county level ordered; refusing to insure, the original license revoked by the district, the municipal administration of road transportation authority in the road transport operators permit or radioactive materials, road transport license, log the appropriate license or license scope:
(A) does not cover the dangerous cargo carrier liability insurance;
(B) the insured risk of cargo carrier liability insurance has expired, do not continue to insure.
44th article violates these provisions, radioactive goods road transport enterprises or units of an illegal transfer, lease of radioactive goods road transport certificates, the road transport authorities above the county level shall order to stop the illegal practice, collection of relevant documents of less than 2000 Yuan and 10,000 yuan fine has illegally obtained, confiscation of illicit proceeds.

46th above the county level transportation management staff in the implementation of the road transport inspection process, radioactive goods road transport enterprises or units there is a violation, and in accordance with the transport of radioactive goods provisions of security control and other relevant laws and regulations, should be monitored by the public security departments, the nuclear safety department or the Environmental Protection Department penalties, and shall inform the relevant departments according to law.
The sixth chapter supplementary articles
