Identification and classification of physical hazards of chemicals management

    (Released July 10, 2013, the State administration of work safety, the 60th since as of September 1, 2013) Chapter I General provisions

    First in order to standardize the identification and classification of physical hazards of chemicals, according to the safety management of dangerous chemicals Ordinance, these measures are formulated.

    Article on dangerous chemicals physical characteristics have not been established hazard identification and classification, as well as the identification and classification of production safety supervision and management departments to supervise the work, these measures shall apply.

    Article III the chemicals in these measures refers to various types of simple substances, compounds and mixtures.

    Identification of physical hazards of chemicals, is in accordance with the relevant national standards or industry standards for testing and judging, determine the chemical combustion, explosion, corrosion, combustion, self-reactive and reacting with water and so on hazard characteristics.

    Classification of physical hazards of chemicals, is in accordance with the relevant national standards or industry standards, physical hazard identification of chemicals or relevant data to evaluate and determine the physical hazards of chemicals category.

    Fourth the following physical hazard identification and classification of chemicals should be carried out:

    (A) contain a and above include the composition of the list of dangerous chemicals, but the physical dangerous chemicals has not been determined;

    (B) not included in the catalog of dangerous chemicals, and physically dangerous chemicals has not been determined;

    (C) for the purpose of scientific research or product development, production or use of more than 1 ton, and physically dangerous chemicals has not been determined.

    Fifth, the State administration of work safety is responsible for directing and supervising national identification and classification of physical hazards of chemicals, notice chemical physical hazard identification of bodies (hereinafter referred to as an accreditation body) list as well as list of exempted from physical hazard identification and classification of chemicals, set up technical Committee on hazard identification and classification of Chemical Physics (hereinafter referred to as the Technical Committee).

    Local people's Governments at or above the county level production safety supervision and management departments are responsible for supervision and inspection of physical hazard identification and classification of chemicals within their respective administrative areas.

    Chapter II risk identification

    Seventh accreditation bodies shall, in accordance with the relevant laws and regulations and the provisions of the State standards or industrial standards, scientific, fair and honest identification work to assure truthful, accurate, objective results, and take responsibility for results.

    (I) explosives, flammable gases, aerosols, oxidizing gases, pressurized gases, flammable liquids, flammable solids, self-reactive substances, spontaneous combustion, spontaneous combustion of liquid solids, self-heating substances, substances in contact with water, emit flammable gases, oxidizing liquids, oxidizing solids, organic peroxides, metal corrosion, and other related physical dangers;

    11th chemicals physical hazard identification report should include the following:

    (A) the chemical name;

    (B) the application identification organization name;

    (C) identification of projects, and the standards and methods used;

    (D) the instruments and equipment information;

    (E) the results;

    (Vi) other content under the relevant national standards or trade standards. Article 12th chemical physical units for identification of chemicals for hazard identification of any objection, within 15 working days from the date of receipt of the report to the accreditation bodies apply for recertification, or to the Technical Committee for arbitration.

    Technical Committee shall, within 20 working days of receipt of the application for arbitration decisions.

    13th chemicals should be based on the appraisal report as well as other physical hazard data, preparation of the report of the classification of physical hazards of chemicals.

    Classification of physical hazards of chemicals reports should include the following:

    (A) the chemical name;

    (B) important information;

    (C) physical hazard identification report or other relevant data and sources;

    (D) the classification of physical hazards of chemicals results. 14th chemicals unit shall report to the registration centre for classification of physical hazards of chemicals.

    Central Registry should be comprehensive assessments of the classified report and audit opinion issued by the chemicals unit within 30 working days. 15th chemicals unit disagrees with the audit observations on the classification of physical hazards of chemicals, and can be received within 15 working days from the date of the audit opinion Technical Committee for arbitration.

    Technical Committee shall, within 20 working days of receipt of the application for arbitration decisions.

    16th chemicals unit identification and classification of physical hazards of chemicals management should be established and should include:

    (A) the hazardous properties of the known physical hazards of chemicals and other information;

    (B) identification and classification of the physical hazards of chemicals have appraisal report, classified information such as the reports and audit opinions;

    (C) not for identification and classification of chemicals by name, number, and other information.

    17th chemicals unit to identify dangerous chemicals, chemicals as well as the State administration of work safety notice from the physical risk identification and classification of hazardous chemicals, shall prepare a chemical safety data sheet and safety labels pursuant to the hazardous chemicals registration measures on administration of registration of hazardous chemicals, in accordance with the requirements of the relevant laws, regulations and standards for hazardous chemicals, and enhanced security management.

    18th accreditation body should be before January 31 of each year to the State administration of work safety reported the previous year, the identification of chemical name and summary.

    Chapter III liability

    19th chemicals unit, one of the following circumstances, rectification by production safety supervision and management departments, and may be fined not more than 10,000 yuan; it refuses, fines of between 10,000 yuan and 30,000 Yuan:

    (A) is not in accordance with this regulation identification or classification of physical hazards of chemicals;

    (B) is not in accordance with this regulation to establish physical hazards of chemicals identified and classified management of archives;

    20th in physical risk identification process, the accreditation body shall have one of the following acts, fines of between 10,000 yuan and 30,000 yuan in serious cases, from the identification by the State administration of work safety agency list and announcements:

    (A) falsifying or tampering with data or if there are other falsifications;

    (B) has not been checked by the supervision of production safety supervision and management departments, still working in the forensic work;

    (Iii) trade secrets leaking chemicals units.

    The fourth chapter by-laws
