Chapter I General
In order to strengthen the management of local reserves, protect the interests of farmers, preserve the stability of the food market and effectively play the role of reserve food in macro-controlled regulation, this approach is developed in the light of the Central Reserve Food Management Regulations.
Article II of this approach refers to local reserves that are used by the Government of the self-government reserves to regulate the total food supply and demand for the self-government area, stabilize the food market, and deal with food and food oils, such as major natural disasters or other emergencies.
Article 3 units and individuals involved in the management of local reserves in the administrative areas of the self-government area must be respected.
Article IV governs the management of local reserves of food should be rigorous, strict management, strict responsibility and ensure the real, quality and storage of local reserves, ensure that local reserves are made accessible, resilient, resilient and cost-saving.
No units and individuals may automatically use local reserves without the approval of the Government of the self-government.
Article 5 Development Reforms in the self-government area and the food administration sector are responsible for the development of a total size of local reserves, the overall BB and the macro-controlled views used to guide and coordinate local reserve food management.
The food administration in the self-governing area is responsible for the administration of local reserves, monitoring of the food stocks, quantity, quality and storage safety of local reserves, and, if necessary, can also be entrusted to the State, the city (terrior) food administration to assist in the management of local reserves.
The financial sector of the self-government area is responsible for the arrangement of financial subsidies such as loan interest, management costs and rotation costs for local reserves, ensuring that payments are made in full and monitoring the financial performance of local reserves.
China's agricultural development banks are responsible for the implementation of credit funds required for local reserves and for credit regulation for the granting of loans.
No units or individuals shall destroy the storage facilities for local reserves without stealing, rushing or destroying local reserves.
The Government of the people of the local reserve food storage area shall organize, in a timely manner, the destruction of land storage facilities, theft, looting or damage to local reserves.
Chapter II
Article 7. The development reform sector and the food administration sector of the self-government zone will be prepared with the financial sector of the self-government area, based on macro-controlled needs and financial capacities, to develop the size, species, and the overall programme of local reserves, to be approved by the Government.
Article 8. The food administration sector in the self-governing area should be developed in accordance with the local reserve size, variety and overall programme approved by the Government of the people of the self-government, the acquisition, sale plan for local reserves, the implementation of the reform of the self-government sector, the food administration sector, in conjunction with the new frontiers of the financial sector and the China Bank for Agricultural Development, to enterprises that are responsible for the storage of local reserves (hereinafter referred to as reserves).
The State, the city (land) food administration sector is responsible for organizing the acquisition, sale and sale of local reserves by the depositor in this administrative area, in accordance with the acquisition, sale of food in local reserves.
Article 9 provides for a balanced rotation system for local reserves, which is generally 20 to 30 per cent of total local reserves.
The State, the city (land) food administration sector should develop an annual rotation plan for local reserves, based on the quality of food stocks and the threshold of entry into the bank, to be approved by the self-government sector in the food administration sector, with the financial sector, the China Agriculture Development Bank.
Reservation enterprises shall carry out the rotation of local reserves in accordance with market supply and demand within the annual rotation plan.
Article 10 Reservations shall report annually on the implementation of local reserves acquisition, sale and annual rotation plans to the development reforms, food and financial sectors of the self-government area and to transmit to the China Bank for Agricultural Development.
Chapter III Storage of local reserves
Article 11. The food administration sector of the self-governing area shall select the storage enterprise in accordance with the principles conducive to the rational laydown of local reserves, centralized management, cost reduction and costs, and, in conditions, may be determined by tendering.
Following the determination of the depositor, the food administration in the self-government area should enter into a contract with them to clarify the rights, obligations and default responsibilities of both parties.
Article 12
(i) The size of the warehouse capacity, which meets the requirements of national standards and technical norms;
(ii) Storage equipment that is adapted to food storage functions, warehousing, access to and from food, food varieties, storage of food cycles;
(iii) The conditions for the testing of instruments and places of the quality of local reserves in line with national standards, and the testing of temperatures, water subsidiaries, pest density, with mechanical systems and other food means suitable for local storage conditions;
(iv) Managing technicians with professional training for food custody, testing, prevention and control;
(v) Structural management and credibility, low rate of asset liabilities and non-violent business records;
(vi) Transport facilitation and control facilitation.
Article 13
(i) Strict implementation of regulations, regulations, national standards, technical norms and operational management systems for local reserve food management;
(ii) To ensure that local reserves in the bank meet the quality levels set out in the acquisition, rotation plan, in accordance with the quality standards set by the State, the introduction of specialized stores, exclusive custodial, specialized records, and the compliance of local reserve food accounts, the integrity, quality and storage security;
(iii) The establishment of a security management system, such as fire, flood prevention, fire protection and piracy, and the provision of necessary security protection measures;
(iv) Recurrent inspections of the state of storage of food in local reserves, problems such as the identification of varieties, quantity, quality and storage safety, should be addressed in a timely manner, and the food administration in the self-government area should be reported in a timely manner.
Article 14.
(i) Restatements, seizures of the number of foods reported in local reserves, with mixed breaks, recuperations in local reserve foods, or spoilers of local reserves, changes in storage sites for local reserves, or sterilization of local reserves due to delays in rotation, mismanagement;
(ii) A set of instruments such as low-cost purchases, high-cost selling of low-cost credits, the replacement of new foods, staggering bank costs, decepting local reserve food loans and loan interest, management costs and rotation costs;
(iii) The automatic use of local reserves and the rotation of local reserves and other operations;
(iv) Provision of security or external liquidation obligations on local reserves.
Article 15. Reservation enterprises have been withdrawn by law, dissolved, bankruptated or otherwise authorized for the deposit of local reserves, and the food administration in the self-government area can redeploy local reserves.
Article 16
The rotation of local reserves should be guided by the principles of cost savings and efficiency that are conducive to guaranteeing the availability, quantity, quality and storage of food stocks, maintaining stability in the food market, preventing the volatility of market food prices.
Specific approaches to the management of food rotation in local reserves are developed by the food administration in the self-governing area with the financial sector and the China Bank for Agricultural Development.
Article 17 The financial sector of the self-government area should be paid to the depository in a timely and full manner with the food administration in the self-government area, the management costs of the local reserve, rotation costs and loan interest, and the use of the local reserve food-considence benefits, through the provision of funds earmarked for food-risk funds at all levels of the financial sector in the agricultural development banks, on a case-by-step basis, and the poor income from using local reserves should be paid to the self-government area.
Any unit or individual shall not in any way exclude, interdiction and misappropriation of the financial subsidies provided for in the preceding paragraph.
Article 18
A reserve enterprise shall open a basic account and receive credit regulation at the new China Bank for Agricultural Development.
Article 19 Currency costs for local reserves are approved by the financial sector of the self-government area with the food administration sector, the China Bank for Agricultural Development. The crediting costs of local reserves have been approved and the depositor must be implemented.
No unit or individual shall be allowed to change the costs of the local reserve.
Article 20 states, municipalities (territory) food administrations should provide regular statistics, analyses of the management of storage of local reserves and send statistics, analyses to the food administration sector of the self-government sector, and transmit to the self-governing sector, the financial sector and the China Bank for Agricultural Development.
Chapter IV Use of local reserves
Article 21, the development reform sector and the food administration sector should improve the use of early warning mechanisms for local reserves, enhance monitoring of the need for the use of local reserve food, and make recommendations to the self-government on the use of local reserves for food.
Article 22 arises as follows:
(i) Significant natural disasters or other sudden events;
(ii) There is a marked need for food in all areas or parts of the region or a volatile market price;
(iii) Other circumstances considered necessary by the Government of the people of the autonomous region.
Article 23 uses local reserves, which are approved by the Government of the People of the Autonomous Region by the Food Administration of the Autonomous Region with the development reform, the financial sector.
The programmes should include the use of storage sites, species, quantity, quality, prices, use arrangements, transport security.
Article 24 Food administration in the self-government sector provides orders based on programmes approved by the Government of the People of the Autonomous Region; in emergencies, the Government of the people of the Autonomous Region may decide directly on the use of local reserves and orders for their use.
Support and collaboration should be provided to the relevant sectors of the self-government and the relevant states, municipalities (territorials), and the Government of the people of the district (markets) to implement orders for the use of food in local reserves.
No unit or individual may refuse to implement or change orders for food use in local reserves.
Oversight inspection
Article 26, the food administration sector in the self-government area, the financial sector should enhance the inspection of the acquisition, sale, use and management of local reserves, identify problems related to local reserve food stocks, quantity, quality, storage and safety, and should be tasked with immediate redress by the depositor's enterprises; and identify that local reserves of food reserves are not subject to conditions of storage, and the food administration in the self-governing area should be tasked with renovating its deadlines.
Article 27 states, municipalities (territory) food administrations should enhance surveillance of local reserves, identify major issues that endanger the safety of local reserves and should be addressed immediately and report on the new boundaries of food, financial and Chinese agricultural development banks.
In accordance with its statutory mandate, the IIEA auditor conducted an audit oversight of the financial and cost-of-payments of local reserves.
Article 29 Inspections carried out by the depositor with respect to the food administration sector, the financial sector, the auditing authority under the law should be synergized and not denied, obstructed or interfered.
Any unit and individual offences in the management of local reserves are entitled to report to the relevant sectors such as food, finance. The sectors reported should be checked in a timely manner; reporting matters are managed by other departments and should be transferred in a timely manner.
Chapter VI Legal responsibility
Article 31 Staff of the State organ violates the provisions of this approach, with one of the following acts to be administratively disposed of by their units or by the competent authorities; constitutes an offence and criminally liable by law:
(i) No timely acquisition, sale and annual rotation plans for local reserves;
(ii) The discovery of local reserves for food storage enterprises that do not have the conditions for storage and are not dealt with in a timely manner;
(iii) Authorized automatic reserve food;
(iv) Reports received and found violations in a timely manner.
Article 32 of this scheme is in violation of article 14 of this scheme by the food administration in the self-governance area to be responsibly corrected by the food administration sector of the self-governing area; by a fine of up to 300,000 dollars; in the event of a serious dismissal of its reserves mandate; and by virtue of the law.
In violation of article 14, subparagraph (b), of this approach, the financial sector of the self-government is responsible for its refunding of the price, decepting local reserve food loans and loan interest, management costs and rotation costs, in addition to processing under the preceding paragraph.
Article 33 violates the provisions of this approach by crowding, intercepting, misappropriation of interest in loans and loans, management costs and rotation costs for local reserves, or by unauthorized changes in the cost of arsenal of local reserves, by the financial sector of the self-government, the new line of the China Bank for Agricultural Development, in accordance with their respective responsibilities; by assigning administrative or disciplinary action to the competent and other direct responsible personnel directly responsible, by their units or the relevant authorities; and by providing criminal responsibility under the law.
In violation of the provisions of this approach, the staff of the third XIV organs of the State and the China Bank for Agricultural Development are responsible for the misuse of their functions, forcible fraud, forcible negligence, for administrative disposition or discipline by their units or relevant authorities, and for criminal liability.
In violation of this approach, the destruction of local reserves of food storage facilities, theft, looting and destruction of local reserves, constitutes a violation of security management, punishable by law; constitutes a criminal offence; and civil liability under the law, resulting in loss of property.
Chapter VII
Article 36 of this approach was implemented effective 1 November 2005.
