Article 1
In order to guarantee the lives of the people and the security of State property, to preserve social public order and economic order, to regulate the acquisition of old metals, to prevent criminal offences and to establish this provision in accordance with the relevant laws, regulations and regulations.
Article 2
This provision applies to the operation of the production of obsolete metals in the city's administration, non-productive waste metals and the use of old-age metals in the municipalities and their associated management activities.
Article 3
This provision refers to the production of old-age metals as described in the present provision, which are the result of the destruction of steel generated in the production of the operation, the distributive metals, the use of obsolete electrical equipment and the submission of waste vessels and their components, and the distribution of spare parts.
The non-productive old metal referred to in this provision refers to the various old metals generated by the inhabitants in their daily lives.
This provision refers to the use of old-age metals in the municipalities, which are caused by natural damage or man-made damage, as well as to public utilities, equipment, instruments, simulation and other supplies containing metals.
Article IV (Management responsibilities)
The Shanghai Economic Commission is responsible for the planning, integrated coordination and industrial management of the former metal purchase industry in the city.
The Public Security Bureau of the Shanghai City and its subsectors (hereinafter referred to as the public security sector) are responsible for the management of the security of the purchase of old metals, and the acquisition, disposal, transport of the communal use of old metals without the licence to buy, dispose of, and transport of activities such as the acquisition, disposal, transport of obsolete metals.
The Business Administration of the Shanghai City and its subsectors (hereinafter referred to as the business administration sector) are responsible for the registration of obsolete metal purchaser enterprises and individual businessmen, with no reference to a fixed place in accordance with the law or beyond the operation of the acquisition of older metals.
In the cities of the Shanghai City, the Administrative Enforcement Bureau and various districts, district urban administration integrated law enforcement units (hereinafter referred to as the urban administration) are responsible for the operation of the free acquisition of obsolete metals by law.
The sectors such as construction, transport, planning, premises resources, quality technics, environmental protection, urban congestion and sanitation should be managed in accordance with their respective responsibilities.
Article 5
Regional, district and local governments should incorporate obsolete metal purchases into the area of community integrated management and organize, coordinate relevant management and street offices, communes (communes) the day-to-day management of obsolete metal acquisition activities within the jurisdiction.
Article 6
The Shanghai City Economic Commission should prepare technical standards for the planning and acquisition of enterprises in line with the overall urban planning of the relevant functional sector and the relevant industry associations, in accordance with the overall planning of the current city.
Regions, zonal governments should determine the entry points for the production of old metals for the acquisition of businesses, based on the Buddd Authority developed by the Shanghai Economic Commission.
Article 7 (registration)
The establishment of a movable metal acquisition enterprise or an individual business worker shall be governed by the law and shall operate within the meaning of the term “production of the acquisition of old-age metals” or “non-productive metal purchase”. Enterprises engaged in the acquisition of productive old metals should be licensed by the public security sector prior to the start of the production of the old metal.
The registered location of the dried metal purchaser and the individual business occupants should be consistent with their actual operating places. Business registration procedures should be carried out by businesses outside their registration sites, with the acquisition of productive obsolete metals, and prior permission from the public security sector.
Article 8
An application for the establishment of an enterprise for the acquisition of older metals should have the following conditions:
(i) In line with the technical criteria for the planning and acquisition of businesses in the production of the former metal purchase industry;
(ii) In line with regulatory provisions such as security, firefighting, premises resources, environmental protection and urban care;
(iii) The statutory representative (head) is a resident of the city or has a residence permit and has a fixed residence;
(iv) The statutory representative (head) has no negative record within five years;
(v) The area of operation is far greater than 500 metres along the railway, airport, ports, metallurgy processing enterprises, and the military ban area.
Article 9
The public security sector should make a licence or a decision not to permit, within 20 days of the date of receipt of a licence for the production of the old metal. After review of the licence, a licence for the acquisition of the old-age metal was granted; no licence should be given in writing to the applicant and for reasons.
The licences for the acquisition of productive old metals are regulated by the Public Security Bureau of the Shanghai City.
Article 10
The dried metal purchaser should be established and the deposit period should not be less than two years.
In the acquisition of productive old metals, a certificate and checklist from the sale unit should be checked and registered in practice. The registration includes the name of the sale unit and the name of the custodian, the number of identification cards and the name, quantity, specifications and the extent of the goods.
Article 11
Enterprises should transfer obsolete metals generated during the production process to the productive matrimonial purchaser, with the exception of the re-production of other businesses for the purpose of recycling.
Article 12 (Designation of disposal)
The use of old metals in the municipality shall be subject to the acquisition and uniform disposal of the designated industrially distributive metal purchaser (hereinafter referred to as “the designated disposal enterprise”).
The designation of disposal enterprises is determined by the Shanghai City Economic Commission, ibid., the Public Security Bureau of the Shanghai City, the relevant industry associations in the production of obsolete metal purchases and is made public to society.
Designation of a disposal enterprise shall enter into a commissioning contract with a public-private enterprise and its affiliated municipal construction and maintenance unit.
Article 13 (c)
The Shanghai Municipal Council for Construction of Transport, together with the relevant departments such as the Shanghai Economic Commission, the Shanghai Municipal Public Security Agency, has developed the List of Old Metals for the Municipal Equitable Metals, which determines the types of use of old-age metals in the city's municipalities and has written notices of the acquisition of businesses of raw materials in the city.
Article 14 (Transport management)
The document should be signed by the designation of the shipment of enterprises or the commission of the transport of obsolete metals in the municipality. The documents should contain matters such as the type, quantity, transport destination. The public security sector should test vehicles and vessels carrying out old metals in the municipality by law.
The management of the city's land, waterways, railway transport has found that the transporters of the old metals used by the municipality are unable to provide proof and should report on the local public security sector in a timely manner.
Article 15
Individuals and businesses that do not have access to a licence for the acquisition of older metals shall not be engaged in the production of obsolete metal purchases.
The owner of the productive metal purchaser shall not purchase the unaccounted production of the old metal.
In addition to the designation of businesses, no unit or individual shall be able to purchase and dispose of the old metals used by the municipality.
Article 16 (Report and report)
The productive matrimonial purchaser found that the products of old-age metals with a suspect or belonging to the municipality of unknown origin should be reported in a timely manner to the local public security sector.
Any unit and individual found guilty of the acquisition, disposal of productive and obsolete metals and the use of old-age metals in the municipality should be reported on time to the public security sector and the business administration.
Article 17
The failure to obtain a licence for the acquisition of raw metals for productive use is subject to administrative sanctions by the public security sector in accordance with the relevant laws, regulations and regulations governing the administration of State security; and, in serious circumstances, the business administration has revoked the licence of business by law.
The source of unaccounted production of old-age metal acquisitions by the productive metal purchaser is fined by the public security sector for more than 30,000 dollars and revoked its licence for the acquisition of productive old metals and advised the business administration to remove the scope of its operation “Established metal purchase”.
The acquisition of municipal arable metals by law is subject to administrative sanctions by the public security sector in accordance with the relevant laws, regulations and regulations governing the administration of sanctions. Of these, it is a productive mammal acquisition enterprise that revokes its licences for the acquisition of older metals, informs the business administration of the removal of the scope of its “Established metal purchases” and, in the event of serious circumstances, the business administration sector revokes the licence by law.
The production of the old metal acquisition company has not established a purchase order or has not been registered, and the public security sector imposes a fine of more than 5,000 yen in 2000 to impose a period of time; in exceptional circumstances, to revoke its licences for the acquisition of raw metals for productive use, and to inform the business administration of the removal of the scope of the operation of its “Established metal purchase”.
Municipal public-owned enterprises and their affiliated municipal construction, maintenance units are in conflict with the disposal of municipal materiad materials and are processed by their superior authorities for the heads of units and those directly responsible; and are criminally criminalized by law.
Article 18
Unless engaged in the operation of the production of obsolete metal purchases, administrative penalties are granted under article 14 of the Act No.
It is known or should be aware that conditions such as the provision of a place of production, transport, custody, warehousing, etc. are provided for by the business administration in accordance with the provisions of article 15 of the Non-Operational Arrangement.
Article 19
Enterprises engaged in the production of obsolete metal purchases prior to the implementation of this provision shall, within a specified period of time, be subject to a licence for the production of obsolete metals in the public security sector. Specific implementation measures are provided by the Public Security Bureau of the Shanghai City.
The enterprise engaged in the acquisition of obsolete metals prior to the implementation of this provision shall, within a specified period of time, be subject to a licence for the business administration. Specific implementation options are provided by the Shanghai City Business Administration.
Article 20
This provision has been implemented since the date of publication.
