Article 1
To adapt to the need to build socialist rural and urban integration, to strengthen rural road construction, conservation and management, to promote sustainable and stable development of rural roads, and to develop this approach in line with the laws and regulations such as the People's Republic of China Highway Act.
Article 2
This approach refers to rural roads, communes, communes and villages constructed according to State-mandated road engineering technical standards.
Article 3
The construction, conservation and management of rural roads within the city's administration is applicable.
Article IV
Rural roads include rural roads, highway land and highway subsidiaries. The destruction, damage or the unlawful occupation of rural roads are prohibited from violating the right to rural roads.
Article 5
The district (market) government is the subject of responsibility for the construction, conservation and management of rural roads within the current administration.
Transport administrative authorities are responsible for the management of rural road work, with specific work being carried out by road management agencies.
Sectors such as public safety, land, construction, planning, and business should be aligned with the management of rural roads by transport administration authorities.
Article 6 (planning management)
District planning is prepared by the municipal transport administration authorities with the relevant municipal and district (market) authorities and is approved by the municipal government.
commune planning, village planning, transit road planning for the focus town, external corridor planning is prepared by the Regional (Central) Regional Transport Administration authorities in conjunction with the relevant departments and communes (communes) government, after consulting with the municipal transport administration authorities, the provincial government of the district (market) has been approved and the municipal transport administrative authorities are presented.
Article 7
The provincial capital funds are raised by the district (market) government and included in the annual financial budget.
communes, village wing funds are financed by the commune (communes) government, and municipalities and districts (markets) are subsidized.
Emphasis is placed on the establishment of road networks in the urban areas, financed by the district (commune) government, for the planned rural road projects and by the municipal transport administration authorities.
To encourage the use of candidacy, the development of the roadside resources, the greening power, to attract social forces to invest in building rural roads; and encourage units and individuals to contribute to the construction of rural roads.
Article 8
The municipalities and districts (markets) governments should, in accordance with the actual needs of rural roads, integrate the current financial budget and arrange the necessary financial resources to ensure the normal conservation of rural roads.
Rural road conservation funds are divided by provincial, municipal grants, municipal financial subsidies, district (market) district fiscal budgetary arrangements, district (market) district transport administration fees for tua and motor vehicle feeding and the payment of the road transport compensation.
The municipal transport administrative authorities have established the criteria for the division of feeding fees for rural road conservation, as prescribed by the Department of State.
The freight administration authorities in the district (communes) are charged with cranes, motor vehicle feeds, and the payment for road transport (removal) payments are fully used for the conservation of rural roads.
The conservation of the district-level financial budget arrangements shall not be lower than the conservation funds granted by the municipal transport administration authorities, and the growth of local financial resources over the rural road.
Regional (market) transport administration authorities are organized and implemented under the actual management of road governance funds, which are not less than 10 per cent of the rural road conservation funds in the current administrative area.
Article 9 (Financing management)
Rural Highway conservation funds are integrated, integrated and dedicated by district transport administration authorities in accordance with the Rural Highway Conservation Plan. Provincial, municipal grants are divided into funds, municipal-level fiscal grants are consolidated by the municipal transport administration authorities in accordance with the Rural Highway Conservation Plan and the territorial transport administration authorities in accordance with the rural Highway conservation plan and the progress made; the district (market) county financial funds are allocated by the same level of finance.
Rural road construction, conservation and management funds should be regulated by transport administrative authorities and the financial sector; the auditing sector should conduct regular audits of the use of funds.
Rural road construction, conservation and management funds are subject to pre- and de-administrative management, dedicated to any unit and individual may not be crowded or diverted.
Article 10 (Education standards)
Districts and communes should be constructed in accordance with the Highway Engineering Technical Standards of the Ministry of Transport, where they are not less than the three highway technical standards; communes are not less than the four highway technical standards; and construction standards in the village should be determined in accordance with local transport and socio-economic development needs and economic conditions.
Article 11 (Designment)
The design units, construction units for rural road construction projects shall be designed, constructed in accordance with the relevant laws, regulations, regulations and regulations, as well as road engineering technical standards and contractual agreements.
As a result of the need for the design of changes, the approval of the pre-approval units must be reported and the top-level transport administrative authorities are required.
Article 12
The quality supervision of the construction of the district is the responsibility of the municipal transport administration authorities for the quality of the transport works; the quality supervision of the communes, the village tunnels is the responsibility of the district (market) district transport administration authorities and the guidance of the quality supervision of the transport works.
No work that has not been carried out for quality of the work shall be completed.
Article 13
Rural Highway workers, completed tests are organized by the owners responsible for supervision by the transport administration authorities. Unless experienced receipt or inspection of rural roads is not carried out or may not be included in the conservation plan. The rural road construction materials and related technical files are maintained by district (market) transport administration authorities or road management authorities.
Article 14.
The day-to-day conservation of rural roads should be carried out in accordance with the Highway Conservation Technical Guidelines of the Ministry of Transport, to maintain a clean-up of the road; to the extent that the road base, slope stability; to the drainage; and to the maintenance of the building blocks such as the bridge. As a result of natural disasters such as hungry, cement, earthquakes, rural roads have been damaged, and district (market) governments should organize rehabilitation in a timely manner.
Article 15
Rural Highway conservation is governed by measurement management or promotion packages by the district (communes) highway management authorities, which are based on engineering fees, and tenders are gradually being applied. Districts should be implemented by professional conservation units, and other rural roads are maintained on a daily basis, at the request of the transport administration authorities.
Article 16
Rural roads should be subject to significant (in the middle) renovations in proportion to the flow of vehicles, the use of annual and road conditions. (b) The renovation work should be gradually introduced into competition mechanisms and tenders were made in road conservation units with corresponding construction capacity.
Article 17 (Security mark)
Rural roads should be maintained on a regular basis, taking into account the provisions of the People's Republic of China Road Trafficmarks and Marks. The two sides of the road should have a reasonable setting of emergency police facilities, announcements of relief calls.
Article 18 (Migration management)
Regional (market) transport administration authorities should sound bridge conservation management systems and establish permanent archives of the basic condition of the bridge. Regional (market) road management should be equipped with dedicated bridge conservation engineers responsible for the safety and conservation management of rural roads and the organization of bridge safety inspections.
It is prohibited to carry out acts that endanger the safety of rural roads, such as the use of sands from the rural road bridges, and from 200 metres down.
Article 19
The greening of rural roads should be integrated into the greening planning of district (market) governments. An update of the logging shall be governed by the relevant legislation.
Article 20 (quality assessment)
The inspection of the quality of rural road conservation is rated to be carried out in accordance with the Road Conservation Quality Approval Standards of the Ministry of Transport.
Article 21
The village area is not less than 1 m from the side of the road, and the area of construction control on both sides of the village has no land of less than 5 metres.
Planning and construction of small towns along village routes should be made available on the road side, and the building (construction) on the verge of the building of the ground with the area of the village cannot be less than 10 metres.
Article 2 (Preventional provisions)
Overloaded vehicles are prohibited from moving in the village. It is prohibited to illegally establish cards, fees, fines and intercept vehicles in the village.
Article 23
For construction or other acts, damage to villages and subsidiary facilities shall be paid either on the basis of the road technology standard or in accordance with the actual award (removal).
Article 24
In violation of article 21 of this approach, the closure of the period of time by the authorities of the district (communes) and the restoration of the status quo was carried out. The cost is borne by the management relative.
In violation of article 22 of this approach, the public security, the transport administration is governed by the relevant laws, regulations.
Article 25
The officers of the transport administration or the road management body play a role in the neglect of their duties, in favour of private fraud and abuse of their functions, and are subject to administrative disposition by law, which constitutes a crime and are held criminally by law.
Article 26
District (market) governments can report municipal government clearances, in conjunction with local practical rules for implementation.
Article 27
The meaning of the following terms of this approach:
(i) “Parea” means the main communes (communes), major commodity production and catchment roads, as well as inter-zonal roads that are not part of national spaces and provinces.
(ii) “communication” means the highway for economic, cultural, administrative services, mainly in the town, as well as between communes and communes that are not part of the district's roads and communes.
(iii) “Waters” means the roads connected with the closure of one or more administrative villages and with the above-mentioned roads.
(iv) Road conservation means recovery of road damage, in accordance with road conservation technical norms and operating protocols. The scope of road conservation includes road blocks, bridges, tunnels, security facilities, greenization and other facilities.
(v) The “highway subsidiary facility” means the holes of the road, drainage facilities, protective construction, milestones, pillars, measurements, roadboards, safety facilities, conservation facilities, swing forests, dedicated homes, etc.
Article 28 (Option of organs)
The specific application of this approach is explained by the Office of the Rule of Law of the Metropolitan Government.
Article 29
This approach has been implemented effective 10 August 2006.
