Article 1
In order to strengthen the management of motor vehicle parking service charges, the regulation of the charges for motor vehicle parking services, the protection of the legitimate rights and interests of motor vehicle parkers and motor car park operators, and the development of this approach in line with the People's Republic of China price laws and regulations.
Article 2
This approach should be followed by units, individuals and motor vehicle parkers operating under the law in the administration of the city.
Article 3
The municipal and district government price authorities are responsible for overseeing the management of all types of mobile parking service charges in the administration.
Article IV
The city's motor vehicle parking service charges are subject to market adjustments, government guidance and government pricing, respectively, in the parking area.
Article 5
The following mobile vehicle parking service charges are subject to market adjustments:
(i) Indoor parking parks in the room operated by the specialized industry (provisional);
(ii) Indoor parking facilities for buildings such as chambers, restaurants, tea buildings, recreational places, hotels, scription buildings and business units.
Article 6
The royalties for the parking of mobile car parks (including homes and unit accommodations), along with the home area, are subject to government guidance. The Government's benchmarking and buoyages are made available to society after the establishment of the municipal government price authorities. Specific charges are agreed upon by the construction unit or by the property administration in the Government's guidance for the purchaser or the vehicle user in the acquisition of the property contract or the property management contract.
The scheme was preceded by the Government-appointed residential area, which, with the consent of more than two thirds of households, could be subject to government guidance as provided in this approach.
The housing area does not meet the conditions set out in the preceding paragraphs and is implementing government pricing.
Article 7 (Government pricing)
The following mobile car parking parking service charges are subject to government pricing:
(i) An open parking area for buildings such as chambers, restaurants, tea buildings, recreational places, hotels, scripts and entrepreneurship units;
(ii) Accompanied parking spaces such as airports, vehicle stations, terminals, landscape areas (points), hospitals, museums, libraries, sports sites (consultations), educational schools, burial services (doors and opens);
(iii) Open parks operated by professional operators;
(iv) Temporary parking;
(v) Parks using special parking methods such as mechanical parking.
Article 8
The number of residential cars, as required by the planning sector, should be given priority to the residential residential parking needs, as required by the planning sector. Residential vehicles have stopped using government guidance or government pricing; other vehicle parks have been discontinued, market premiums have been put in place indoor parks, and government pricing at open parks.
Article 9
The cost of motor vehicle parking services is occupied by parking sites, the acquisition, maintenance of parking facilities equipment, the salaries, benefits, tax payments for parking service personnel, and the cost of utilities required for the normal operation of parking parks owing to the poor maintenance of the parking lots.
Article 10 (Percentage)
Government pricing parks are governed by a hierarchy of fees, sub-prime parks and general parks. Specific classification criteria and the standard of tier charges are published to society after the establishment of the municipal government price authorities.
Article 11
Subregional and temporal pricing principles are applied to all types of mobile parking service charges in urban areas. The municipalities' prices, urban management, public safety, transport, planning and other sectors, depending on transport flows and management needs, define different regional and time-bound rates for mobile parking services.
Article 12
The town's mobile vehicle parking service takes a temporary halt and standstill. The temporary suspension of the payment period or the payment of the charges was discontinued on a monthly basis.
Residential residential areas are not allowed to go to their homes for months.
Article 13
The accident vehicle, the administrative law enforcement sector, temporarily deducting vehicle parks, is subject to charges for the parking parking lots, and the other costs are strictly charged for any reason.
Article 14.
In one of the following cases, no mobile vehicle parking service is charged:
(i) Military vehicles and police vehicles carrying out official functions;
(ii) Special vehicles being carried out;
(iii) Vehicles that are normalized on the road to closed municipalities;
(iv) A vehicle parking for less than 15 minutes in temporary duty parks;
(v) The temporary suspension of 15 minutes of vehicles entering the residential area;
(vi) Rental vehicles at various parking sites on a temporary basis.
Article 15
The Government's pricing and the Government's fees for the garage of the motor vehicle are applied to the approval system.
The Government pricing occupants submit written requests to the local government price authorities in the area (communes) after approval of the Government's bill for approval of royalties for a motor vehicle parking service, in accordance with the fees set out in the approved book. The Government directs the garage operators to receive the Government's fee approval for the garage for the garage parking parking parking parks agreed and signed with the owners (householdings).
The mobile parking spaces, such as airports, fire stations and sites (points), require higher charges than the generic standard of fee charges, should be submitted to the municipal government price authorities for written requests, and the municipal price authorities have been able to process the fee-for-relevant procedures in accordance with the conditions of parking facilities and the level of service.
Article 16
The market regulation of the royalties for the parking of the motor vehicle parks was introduced. The garage operators receive a book of fees for the market price parking parking lots, in accordance with the advice and schedules of the management parking parking lots, the nature of the use of buildings proved to be the property certificate, the construction of engineering planning licences, and the self-determined charges for the district price authorities.
Article 17
The vehicle parker purchases the vehicle title, and the parking manager is entrusted with the provision of the related services by the owner, and shall consult with the owner on the content of the services, the fees and their respective rights, obligations, and enter into written agreements.
The vehicle parker calls for the rental of fixed cars at the parking plant, which can be charged on the basis of the approved monthly parking fees. The specialization criteria are determined by the vehicle parkers in consultation with the parking owners.
Article 18
All types of motor vehicle parks must regulate charges, be at the entrance and at the expense of the hiding of mobile vehicles, specifying the criteria for fees, the manner of fees and the use of parking invoices for the levies of the tax sector.
The motor vehicle parking service fee sheets are harmonized by the municipal government price authorities. The parking lots may be required to produce themselves by a prison system or by the local government price authorities at the expense of the production.
Article 19
One of the acts of motor car parking operators is warned by the Government's price authorities to correct orders, which can be fined by more than 5,000 dollars.
(i) Execution of parking parks with market price;
(ii) The fees for vehicles not charged;
(iii) The residential residential area has refused to carry out the garage for the inhabitants.
Article 20
One of the acts of motor car parking operators has been converted by government price authorities in accordance with the Price Act of the People's Republic of China, the administrative penalties for price violations, which can be confiscated for the proceeds of the offence and may be fined up to five times the proceeds of the violation; without the proceeds of the offence, a fine of more than 200,000 dollars could be paid; in the event of a serious circumstance, the suspension of the business:
(i) Establish mobile vehicle parking service charges beyond the Government's guidance premium;
(ii) Recurrently develop a standard of fees for motor vehicle parking services that fall within Government pricing;
(iii) Be higher than the fees set out in the Government's Mortgage Cardage Approval.
Article 21
One of the acts of motor car parking operators is to be converted by the Government price authorities in accordance with the provisions on a minimum price for goods and services, forfeiture of proceeds of the conflict, with a fine of up to 5,000 dollars, without the proceeds of the offence, and a fine of up to 5,000 dollars may be paid:
(i) No indication of price;
(ii) Not to specify the minimum tender price in terms of the content and manner specified;
(iii) To collect unmarked costs outside the mark price.
Article 2 (Review proceedings)
The parties should apply for administrative review in accordance with the law; decisions on administrative review are not uniform and can be brought to the People's Court by law.
Article 23.
The specific application of this approach is explained by the Office of the Rule of Law of the Metropolitan Government.
Article 24
This approach was implemented effective 1 January 2007. Previous provisions concerning the management of motor vehicle parking service charges in this city are implemented in accordance with the provisions of this approach.
