Statistical management approach in the city of New York

(Summit No. 44th ordinary meeting of the People's Government of New York, 28 November 2008 to consider the adoption of Decree No. 161 of 4 January 2009 by the People's Government Order No. 161 of 4 January 2009, effective 10 February 2009)

Chapter I General

Article 1 ensures the accuracy, timeliness and effectiveness of statistical information and plays an important role in the development of services, the economic and social development of service nationals and services for harmonious social development, in accordance with the relevant legal provisions of the People's Republic of China Statistics Act, and develops this approach in the light of the practicality of this city.

Article 2 addresses statistical surveys such as national organs, social groups, business organizations, self-employed persons and businesses in this city's administration (hereinafter referred to as statistical survey targets), professional social statistical survey organizations, grass-roots self-government organizations and citizens should be subject to this approach.

Article 3: The Statistical Office of the People's Government (hereinafter referred to as the Government Statistics Agency) is the competent authority for statistical work in the present administration, organizes the leadership and coordination of statistical work in the present administration, harmonizes professional social statistics surveys and conducts social statistical survey activities in accordance with the law.

Article IV requires that statistical work be carried out in accordance with the principle of merit and that scientific and technical means be used to guarantee the accuracy and timeliness of statistical information.

Statistical institutions and statistical personnel should provide objective, real statistics, accurate, timely completion of statistical work, conservative national secrets, commercial secrets and single survey information for private households, in accordance with the provisions of the legal, regulatory and statistical systems.

Chapter II Statistics organizations and personnel

Article 5

The Government of the Town People's Government (Rob Street Office) has set up a dedicated or part-time statistical officer, in accordance with the relevant legal provisions and statistical needs.

The grass-roots community self-government organizations should designate specialized persons responsible for statistical work.

The professional social statistical survey established by non-governmental organizations can receive outsourced services and carry out corresponding statistical investigations under the law.

Statistical surveys by professional social statistical survey organizations should be carried out in accordance with the relevant legal provisions to refrain from using statistical investigations to steal State secrets, to violate the commercial secrets of others, personal privacy and from undermining the public interest of society or conducting fraudulent activities.

Article 7. The professional social statistical survey organization receives out of service under the law and conducts a corresponding statistical survey, which should be supported, encouraged and regulated by law.

Article 8.

Chapter III Administrative services and regulation

Article 9 Government statistical institutions should strengthen the statistical operational guidance of sectoral, industrial management, professional social statistical survey organizations, statistical staff and continue to educate and improve the quality of their statistical operations.

The Government's statistical institutions should study in a timely manner the problems arising from statistical work.

Article 10 Government statistical institutions should strengthen scientific research on statistical indicators systems, improve statistical survey methods, strengthen technical building, such as statistical information processing, and increase the scientific, real and timely character of statistics.

Article 11 Government statistical institutions should make use of statistical data in accordance with the law, regularly publish comprehensive statistical data to society, provide comprehensive statistical data to Governments, departments and industry authorities in a timely manner, and continuously enhance the capacity of statistical services for local economic development.

Statistics that are secret in the State should be provided and made public in accordance with the provisions of the conservative National Secret Act of the People's Republic of China; single statistics that are private, family and are not disclosed without their consent.

Article 12 Government statistical institutions should establish a system of statistical work inspections, conduct regular inspections of statistical work in the present administration and organize specific inspections in accordance with actual circumstances.

The Government's statistical agencies should strengthen monitoring inspections with regard to the outsourcing of services by professional social statistical surveys.

The professional social statistical survey organization has committed violations in the process of receiving out of services and conducting statistical investigations, and the Government's statistical institutions should be accountable in a timely manner and in accordance with the law; the unit may require it to assume the corresponding responsibility in accordance with the outsource agreement of services.

Chapter IV Statistics business management

Article 14. Basic statistical units, such as national organs, social groups, business organizations and other organizations within the city's administration, shall, within 30 days of the establishment or modification of the law, be registered or modified by statistical offices at the local district level.

Sectors such as business, civil affairs, institution-building, quality, etc. and industry administrations should provide statistical information such as the establishment, change, cancellation, preparation and organization of institutional codes to the same-level government statistical bodies on a regular basis, and assist the Government's statistical institutions in the identification, registration of basic statistical units.

Article 15. The subject of statistical surveys should be legally responsible for statistical investigations. Statistics from the organization should be self-criticized for statistical surveys carried out by various government statistical agencies, such as censuses, sample surveys, focus surveys, comprehensive periodic statistical statements, and timely receipt, delivery of statistical statements, such as real statistical information, non-representation, seizure, late reporting, non-feiture, alteration; outsourcing of statistical operational services should be carried out with responsibility to ensure their quality.

Article 16 State organs, business units with administrative functions, enterprise groups, groups and associations authorized to perform administrative functions may identify statistical survey projects that are adapted to their management functions (hereinafter referred to as sectoral statistical surveys).

The sectoral statistical survey identified statistical survey projects targeting entities outside the jurisdiction of the sector, which must be submitted to the same level of government statistical agencies for approval by setting up statistical survey projects targeting units within this sector's jurisdiction and must be presented to the same government statistical offices.

The Government's statistical institutions should review the questionnaires on the delivery of statistics. In order to meet the provisions, they should be approved in a timely manner.

In the absence of an audit questionnaire, a written case or a statistical questionnaire exceeding an effective period, the subject of the investigation was entitled to reject the investigation and the government statistical body was entitled to repeal.

Article 18 Statistical management introduces a system of geographical statistics, which is governed by the law by statistical agencies of the local government (market) for statistical surveys within the scope of this administrative area.

The subject of a statistical survey that is unknown or based on the location's statistical methodology, is designated by the municipal government statistical agencies.

The Government's statistical institutions should promote the development of a statistical computer networking system. The subject of the required statistical survey should be sent to statistical information in accordance with the content and timing of the statistical system.

Article 20 provides statistical surveys for regular reporting of statistical information, which are subject to statistical desks, original statistical records and relevant information, confirm the authenticity of the statistical information presented.

Statistics desks, original statistical records and relevant information are not destroyed within three years.

Article 21, relevant sectors of the Government and industry administrations, should be accompanied by the same government statistical bodies when submitting statistical information to the superior authorities as national economic and social development.

Article 2

Chapter V Legal responsibility

Article 23

The Government's statistical body could entrust the socio-economic survey body with statistical offences in the current administrative area under the law.

Article 24 provides that the basic statistical unit, in violation of article 14 of this scheme, does not process registration or change procedures as prescribed, is being reorganized by the Government's statistical agency, alerts to the enterprise organization and allows for fines up to 500,000 dollars; and critics are given to State organs, social groups and other organizations.

Article 25

(i) Arrogance, concealment, counterfeiting and adapting statistical data, which accounts for a fine of up to 10 per cent of the total amount of €10 million for entrepreneurship organizations and a fine of up to €100,000 for the self-employed business and business sector;

(ii) To refuse to report and report back to the end of the year, to fine more than 1000 dollars for the Enterprise Organization and to impose a fine of up to 1000 dollars for the Individual Chamber of Commerce and Industry;

Article 26 Business organizations, individual business and business owners, when accepting statistical inspections, refuse to provide information, provide false or transfer, conceal, destroy the original statistical records, statistic accounts, statistical statements and other statistical information, which are warned by government statistical agencies and fines up to 5,000 yen for corporate business organizations and fines up to 1000 dollars for individual businesses.

Article 27 provides that professional social statistical survey organizations take advantage of statistical investigations that undermine the public interest of the society or engage in fraudulent activities, which are redirected by the Government's statistical agency, confiscate proceeds of an offence and may afford more than three times the amount of the proceeds of the violation; and that there is no proceeds of an offence, a fine of up to $30,000 could be paid.

Article 28 contains one of the following cases, and shall be punished by law:

(i) Proclamation of other persons, authorization and refer to the existence of statistical offences;

(ii) Substantive performance of statistical offences in cooperation with law enforcement authorities;

(iii) To make a proactive presentation of the facts of violations and to rectify them in a timely manner;

(iv) The prompt written review and redress of the violation, upon notification of the penalties decision;

(v) Disclosure of statistical offences by others, which are valid;

(vi) Other penalties should be punished by law.

Article 29 Government statistical bodies and statistical law enforcement officials favour private fraud, abuse of authority, and neglect, are governed by the law by their units, which constitute crimes and are criminally criminalized by law.

The Government's statistical institutions and statistical law enforcement officials are responsible for violations of the legitimate rights and interests of citizens, legal persons or other organizations, resulting in losses and should be compensated by law.

Article 33, which is not consistent with administrative penalties, may apply to administrative review or administrative proceedings in accordance with the law.

Article 31 The “Strategic management approach in the city” (No. 123 of the People's Government Order No. 123) was repealed on 4 August 2004.
