Regulation on online transaction management in precious ties

(Adopted by Decree No. 7 of 30 July 2009 of the Government of the Honduran People)

Article 1 establishes a fair, fair, transparent and easily registered asset transaction management order that guarantees transaction security, preserves the legitimate rights and interests of the parties to the transaction and establishes this provision in the light of the actual circumstances of the city.

Article 2

The first paragraph refers to the publication, through the web-based operation system, of information on stock-based transactions, the deposit of the interest in the transaction by the parties to the transaction through the web-based operation system.

Article 3. The municipal housing administration is responsible for the supervision of the management of the online transactions in the present city's stores, with the specific responsibility of the communes, the Southern Mining Zone and the city's people's government to determine the region's stock online transactions.

The zones, districts (communes) management sector is responsible for the management of stock online transactions in the current administration area, with the specific work of the stock-based online transactions.

Article IV. The property brokering services are required to operate in the current city for the storage of property brokers and should apply to the host real estate transaction management to the users of the network operating system for the registration of stock-based transactions to obtain technical support from the network operating system.

The information of registered property brokering services should be changed from within 7 days of the date of the change in information to the registration user information by the real estate transaction management.

Article 5

The stock of the online transaction should be in line with the relevant provisions of the housing transaction.

Article 6. The property intermediary service is entrusted with the operation of the depository transaction and shall be preceded by a certificate of residence, a certificate of identity of the author and a search for and access to the house on-site surveys, verification of the status of housing rights and the natural situation of the home. The transaction is not subject to trading conditions.

Article 7. The property brokering service is entrusted with the depository transaction, and contracts should be signed with the author through the online operation system and communicated to the property transaction management after the contract is commissioned.

The commissioner and the property broker services are subject to change by consensus or to the award of the contract, and the property broker services should update the award contract in a timely manner through the online operation system and transmit the updated contract to the real estate transaction management.

Article 8. Housing rights may be delegated to the property transaction management to provide information, enter into transactions contracts and complete the online operation services for the application form.

Article 9

(i) The main natural situation and the associated status of the house, consistent with the home registry;

(ii) The conditions for housing transactions;

(iii) Names of property brokering services, qualifications, means of communication and hosting service providers;

(iv) Matters requiring clarification by property brokering services;

(v) Other information requested by the property transaction management authorities.

Article 10. The property brokering service institution is entrusted with the contract by the depository transaction to facilitate the transaction and shall provide the transaction contract and complete the application form (registered or leased registration application form, with the same) online services.

The terms of the transaction contract and the application form are confirmed by the parties to the transaction, and the property brokering service agencies should make the transaction contract and the application form available to the transaction party through the online operation system and transmit the transaction contract and application form to the property transaction management.

After the conclusion of the transaction contract, the parties to the transaction shall, within the period agreed upon by the contract, be subject to trade contracts, application forms and relevant information that are stored through the online operating system, to apply for the processing of the home rights to be registered in the form of a transfer registry or a home lease registration process.

When the transaction contract and the application form are transmitted, changes or cancellations are required, and the parties to the transaction agree that the processing of the property rights is registered or the home lease registration process shall be jointly updated or withdrawn by the property transaction management authorities. The parties to the transaction may, for the reason, be unable to update or withdraw the information transmitted by the property transaction management body, in writing entrust the other party with the process.

The transaction contract and the application form are subject to cancellation and no further information shall be issued before the withdrawal.

Article 13. The owner shall enter into a transaction with the parties concerned and operate online within three months of the commissioning of the contract and the expiration of the deadline of the commissioning of the contract, and the property transaction management shall give the transaction party's trading contract and the application of the information to the trusted property intermediary service through the online operation system.

Article 14. The parties to the transaction are reaching their own transactions by consensus, and the real estate transaction management shall provide information to the parties involved in the transaction, enter into a transaction contract and complete the online operation of the application form.

Article 15. The property brokering services should provide information on the authenticity, legitimacy and adherence to the operation of the web-based management of the stock-based transactions, as is the case for the delivery of contracts and requests.

The property brokering service institutions may not publish information that is not relevant to the operation of the stocking.

Article 16 Property brokering services should enhance the day-to-day management of brokering service providers in the operation of the depository online transaction agent.

The property intermediary service and the services are legally responsible for its brokering services.
