Quick-road management approach to cities in the main city

(Adopted by the 57th Standing Committee of the Government of the People of the Republic of China on 14 December 2009, No. 232 of 21 December 2009, to be published as from 1 January 2010)

Article 1, in order to strengthen urban rapid road management in the main urban areas, fully performs the urban fast-track function, ensures the good, safe and unhindered access of cities, develops this approach in line with the provisions of the Law on Road Traffic Safety of the People's Republic of China, the State Department's Urban Road Management Regulations.

Article 2 Planning, construction, conservation, maintenance, road governance and transport safety management for cities in the main urban areas are applicable.

This approach refers to urban rapid roads in urban areas, central segregation, control of access, control of the intervals and forms of access, with single-way or more vehicles, and the provision of transport safety and management facilities for motor vehicles for urban roads and their subsidiary facilities.

This approach refers to drainage facilities, protective construction, security facilities, lighting facilities, facilities, facilities for the conservation, services, monitoring facilities, detection facilities, community sizes, slots, surfaces, markers, swing trees and dedicated homes.

Article 3. The municipal administration authorities are responsible for policy development and monitoring of urban rapid road conservation, maintenance and governance management, as well as for the direct management of the city's fast-track road in the main urban areas determined by the Government of the city.

The municipal administration authorities are responsible for the rapid management of cities other than the city's direct management in this administrative area.

The transport management of the public safety authority is responsible for the safe management of road traffic in urban areas in line with its responsibilities.

The administrative authorities and relevant units, such as planning, building, land, parking and forestry, are responsible for the management of cities' rapid roads in line with their responsibilities.

Article IV. Urban rapid road management should insist on the harmonization of planning, building, coordinating development and efficient popular principles and efforts to improve the level of management modernization.

Article 5 Rapid urban road management should establish an open and public participation system to fully listen to and respect public opinion.

Any unit and individual have the obligation under the law to protect the city's rapid road and have the right to investigate and prosecute violations of this approach.

Article 6. Rapid urban planning and construction should be consistent with urban and rural planning and transport planning, consistent with relevant technical standards and design protocols, technological advanced, safe and coordinated with urban environments.

Urban rapid road construction works should be completed in accordance with the relevant national provisions. The construction units should provide technical material and engineering tests, engineering insurance, etc., after clearance by the municipal administration authorities.

Building the city's fast-track road in the already-speaking regions, which may cause environmental noise contamination, should create a voice or other effective measures to control environmental noise pollution.

Article 7. The opening of the city's fastway with other urban roads and roads should be in line with design protocols. The handover should be strictly followed by the entry of the new urban fastway and other urban roads and roads. There is a need for additional approval by the Government of the People of the city, following the approval of the Planning Authority with the municipalities, public security, construction, parking, etc.

Article 8. The scope of the security protected area for all 30 metres on the side of the Quick Road, 20 metres on the side side of the airport rapid route, and the scope of security protected areas for other cities are determined in accordance with their technical standards and design protocols.

In the area of rapid road safety protection in cities, there is no need to construct buildings for permanent non-road facilities. The construction of temporary buildings or the laying of cables, cables due to special circumstances should be governed by the relevant provisions such as the reform of the administrative approval system in the area of construction.

Article 9. Transport signs of rapid urban roads, mark line management, are carried out in accordance with the management system of existing urban roads in the main urban areas. The setting of transport symbols, mark lines should be in line with national standards and road traffic safety, accessibility requirements and clear, awakening, accuracy and integrity.

The city's fast-track route is in line with other urban road management or the subsidiaries of the roads, which are determined by the municipal administration authorities with the relevant sectors and units, and the municipal administration authorities should set a clear subregional mark and a city's rapid road symbol.

Article 10 provides an integrated management of the municipal administrations, which are responsible for the management of their municipal facilities, through the Quick Roads, the Linteral and Sanitation of the Airport, the greening management of parks.

Article 12 strictly controls on the occupation and excavation of roads in the urban context. The municipal administrations should be organized in conjunction with the relevant sectors and avoiding the exhumation of cities.

Article 13

(i) When a fixed operation, the construction unit shall arrange for the evacuation of a person to establish a transport that is in line with national technical norms, standard safety protection facilities, construction marks and changing vehicle directives, notice of dangerous warning signs, etc., to open a warning light at night; and, in the course of the movement operation, a mobile operational mark should be installed at the road level;

(ii) Mobile operating vehicles, machinery should be sprayed with a clear anti-satellite map, which opened a warning light and dangerous alert light;

(iii) The operators should focus on the avoidance of vehicles, in accordance with the provision of anti-ray security uniforms consistent with the relevant standards.

Previous vehicles should pay attention to operating vehicles and personnel. Monitoring inspections should be strengthened by the competent authorities and by road maintenance units.

Article 14.

(i) Orientation and excavation of roads;

(ii) Enabling access to other urban roads and roads;

(iii) Urgent crossings, road presences and the establishment of additional line facilities;

(iv) Access to land, resourcing, crop cultivation and drainage within the area of use;

(v) Activities that endanger the safety of facilities in the context of the safe protected areas of bridges and tunnels, excavations, bulldozers and drilling;

(vi) Emissions of wastewater, dumping of garbage, soils and subsoil other solids, influenza substances;

(vii) Other damage and expropriation of the city's rapid road.

Article 15 prohibits the entry into the city's fast-track road, such as the rapid passage of airfields. The people should have access to a trajectory or tunnel at the time of the rapid passage of the airport.

Non-moile vehicles (including specialized cars for persons with disabilities), motor vehicles, trailers, low-flight cars, three vehicles, wheel-specific machine vehicles, vehicle fleets and pedagogical vehicles, and other road blocks designed at the highest rate of less than 70 kilometres of vehicles, have access to closed cities, such as rapid route, airport rapid route.

Article 18

At a time when the motor vehicle was not restricted to a quick roadway in closed cities, such as the route of the mark, the fast-track route of the airport, it was not possible to move at a minimum distance of 40 kilometres per hour; the maximum vehicle for small passenger vehicles must not exceed 100 kilometres per hour, and the maximum vehicle for large passenger vehicles and cargo vehicles must not exceed 80 kilometres per hour per hour.

Article 19

(i) Reuters, anti-warnings, central crossings or parking in the busy;

Article 20, when a motor vehicle occurs on a rapid road or a traffic accident, should be treated in accordance with the relevant provisions of road traffic safety. In these cases, rapid urban road failures, such as mobile vehicles, rapid roadways, or transport accidents, should be addressed in the light of provisions relating to high road traffic safety; they cannot be normalized and should be driven by rescue vehicles, car trailers and exposure.

The transport management of the public security authorities should be sent to the field for the purpose of re-entry.

The transport management of public security authorities and the municipal administrations should establish a quick-impact mechanism.

Article 21, in the event of natural disasters, harsh meteorology conditions and other sudden events, the transport management of the municipal administrations and public security authorities should be swiftly disposed of in accordance with the emergency response, relief advances. The relevant units and individuals should be subject to command, in conjunction with the implementation of the emergency response and relief advance.

In cases of severe traffic safety, such as rain, snow, cigarette, road construction operations, traffic accidents, other measures are difficult to guarantee transport safety, the transport management of the public security authority can be regulated by law.

Transport control measures should be followed by timely dissemination of information to society.

Article 2

Public safety authorities' transport management, municipal administrations, etc., should establish a law enforcement inter-agency mechanism in accordance with the relevant provisions of the Government of the city, to communicate information in a timely manner and to share information resources.

Article 23, in violation of the provisions of this approach relating to planning, construction, conservation, maintenance and road traffic safety management, provides for penalties, such as those provided for in the legislation.

In violation of the provisions of this approach, the municipal administrations are punished by the following provisions:

(i) In violation of the provisions of article 14, subparagraphs (i), (ii), (iii), of the present approach, ordering to put an end to the violation, restoring the status quo, and paying a fine of more than 6,000 dollars;

(ii) In violation of article 14, subparagraphs (iv), (vi), of this approach, the fine of more than 5,000 dollars;

(iii) In violation of article 14, subparagraph (v), of this approach, the fine of up to 4,000 yen;

(iv) In violation of article 17 of this approach, a fine of up to 5,000 dollars.

Article 24, in violation of the provisions of this approach or as a result of rapid urban road damage caused by traffic accidents, shall be liable under the law.

The urban rapid road damage compensation standards and the standard of fees for the services of the barrier are implemented in accordance with the relevant provisions of the municipal price and the financial sector.

Article 25 Its staff have been subjected to negligence, abuse of authority, provocative fraud, by law by the competent authority, and criminal responsibility is transferred to the judiciary.

The approach is being implemented in the context of the rapid road management of the cities in areas other than the main towns of 26.

Article 27 of this approach is implemented effective 1 January 2010.
