The main responsibility for the safe production of business units in Gang Province

(The 41th ordinary meeting of the Government of Gangong Province, held on 18 November 2009, considered the adoption of Decree No. 61 of 27 November 2009, by the People's Government Order No. 61 of 27 November 2009, of 1 January 2010)

Chapter I General

Article 1 establishes this provision in the light of the laws and regulations of the People's Republic of China Act on Safety of Production, and the Southern Province Safety Production Regulations.

Article II performs the responsibility of the subject matter of safe production in units operating in the administration of this province (hereinafter referred to as the productive unit).

Article III assumes the primary responsibility for the safe production of this unit, with the primary responsibility to manage responsibilities, secure responsibilities, job responsibilities and oversight responsibilities.

Article IV Production operators and their practitioners are required to comply with national security production laws and regulations, implement safety production standards, operational protocols and safety technical measures, and receive the oversight management of all levels of government and their relevant sectors.

Chapter II

Article 5. The responsibility for the safe production of the productive units consists primarily of the responsibility for the management of the system, the responsibility for the management of the personnel, the responsibility for on-site management, the responsibility for accident reporting and other safety-productivity under the legal regulations.

Article 6 Mainly include:

(i) A safe production conference system;

(ii) Removal and use systems for safe production inputs and safe production costs;

(iii) Safe production education training systems;

(iv) Safe production inspection system;

(v) The safe production accountability system for the conduct of inspections, awards and accountability;

(vi) Standardized management systems for operating and posting;

(vii) The safe production accident hidden the regime of governance;

(viii) Major hazardous source testing, monitoring and management systems;

(ix) The staffing and management system of labour protection supplies;

(x) Security facilities, equipment management and inspection, maintenance systems;

(xi) The new construction, alteration, expansion of the project works “three parallel” system;

(xii) Management system for special operating personnel;

(xiii) Production of safety accidents reports, emergency relief, investigation and archives management systems;

(xiv) Other security production management systems consistent with the characteristics of the industry, the unit produced.

Article 7. Excluding unconstitutional command, unconstitutional operation and violation of labour discipline.

Article 8

Article 9. The productive business unit is required to conduct regular security inspections, seizing governance accidents in a timely manner, depending on the focus of security production, temporarily difficult to reproduce, and to develop rehabilitation plans, implement corrective measures and retrofitting deadlines. The contents of each security inspection, results, corrections are to be recorded in the desk and signed by the inspector and the reviewer.

Article 10 Safeguards in the vicinity of the production, operation, storage, use of dangerous goods are consistent with the relevant provisions of the State, and the production of the premises and the accommodation of the employee should have marked and meet the security exports required by the urgent discharge.

Article 11. After the production of a security accident by the productive business unit, the person on-site of the accident shall immediately report to the head of the unit. After having received reports from the head of the unit, it is not possible to conceal reports, late reports, false reports of production safety accidents, according to the regulations to the management and related sectors of the safe production of the population at the district level. At the same time, the heads of the productive units must be able to stay and immediately organize relief, cooperate with the accident survey team and properly deal with the work of the accident after the accident.

Chapter III Guarantees of responsibility

Article 12 These include, inter alia, the responsibility to be guaranteed by inputs, the responsibility to organize security, the responsibility for technical security, the responsibility for emergency relief and other guarantees under the law.

Article 13 Production operators are required to extract safe production costs, and to ensure that the unit's security inputs meet the requirements for safe production. Security production inputs must be included in the budget for this unit. Security production inputs are mainly used for the following:

(i) Construction, rehabilitation and maintenance of safe production facilities equipment;

(ii) Safety accidents are hidden by rehabilitation, improvement of occupational health conditions and standardization;

(iii) Technical services such as security production evaluation, testing, counselling;

(iv) The availability of labour protection supplies, emergency relief equipment;

(v) Safe inspection of the acquisition of transportation tools, equipment instruments, communications equipment;

(vi) Safe production of science and technology development and applications, advocacy and incentives;

(vii) Employer casualty investigation and rehabilitation;

(viii) Other costs required for security production security.

Article 14. More than 300 production units are due to the establishment of a security production management body, with the production of the following 300 producing units, with dedicated or part-time security production managers or to entrust and hire personnel with the State's registration security qualifications to provide security management services.

Article 15 Production operators are required to work on safety standardization in all aspects of the production operation, in accordance with the relevant provisions of the Safety Standardization DaO mark. The establishment of a continuous production unit for safety standardization should be rewarded.

Article 16 Security facilities for the production of new construction, alteration, expansion of projects are to be designed in conjunction with the main works, while at the same time construction and in conjunction with production.

(i) In preparing project design documents, the construction of project design units will be accompanied by the development of design documents for security facilities;

(ii) Construction of project construction units will require construction in strict compliance with the construction map and design requirements of the security facility;

(iii) Evaluation of the effectiveness of the testing phase of the production of equipment, at the same time, of the testing and evaluation of security facilities;

(iv) The design and completion of the security facility will require a review of the receipt by the safe production management organization.

Article 17

Article 18 Maintenance, maintenance, testing are recorded and signed by the relevant personnel.

Article 19

Article 20 shall be governed by law by law for practitioners in the conduct of work injury insurance and may be subject to accidental injury insurance for persons engaged in high-risk operations, such as high-risk operations, such as safe production.

Article 21 Production operators are required to establish, in accordance with the law, recovery and operational emergency response measures for the production of safe accidents. Predicts must be made public and at least once a year has been organized.

Article 22 Production, operation, storage units and mines, construction units will be required to establish emergency relief organizations, with corresponding emergency response equipment and equipment, and to conduct regular exercises. The units of the Emergency Relief Organization are to be equipped with emergency relief assistance personnel and to enter into emergency relief agreements with the near-largest emergency relief organizations.

Article 23. During changes in property rights, such as conversion, insolvency, acquisition, merger, restructuring, etc., the transferee of property rights and the licensee enter into specialized security production management agreements or agree on security production management matters in the property rights change contract. The absence of a security production management agreement or the unanimity of safe production management matters, and the occurrence of a safe accident, with the corresponding consequences of the physical control of the accident unit.

Chapter IV

Article 24 requires the establishment by law of a responsible system for the safe production of this unit, with clear elements of responsibility, responsibility and responsibility for the implementation of the full-fledged responsibility for safe production.

(i) The responsibility for the safe production of the main head (Director, General Manager);

(ii) The responsibility for safe production for the heads of security production and other heads of subsidiaries (Vice-Chairman, Deputy Director, General Manager);

(iii) The responsibility for safe production for heads of departments (security production management, management offices, subsidiaries, workshops);

(iv) The responsibility for the safe production of the team leader;

(v) The responsibility for the safe production of work practitioners.

Article 25. The main holder of the productive unit is the first responsible for the safe production of this unit and is fully responsible for the implementation of the responsibility of the subject of safe production, as follows:

(i) Establish a safe and safe production responsibility;

(ii) Organization of safe production management systems and operating protocols;

(iii) Ensure the effective implementation of safe production inputs;

(iv) Conduct regular studies on security production and promote the safe production of other custodians, and eliminate production safety accidents in a timely manner;

(v) Organization in the development and implementation of pre-emptions to assist in the production of safe accidents;

(vi) Timely reporting on the production of safety accidents, effective organization of accident relief, assistance and collaboration with accident checks;

(vii) Other responsibilities under laws, regulations.

Article 26 heads responsible for the safe production of the productive units are directly responsible for the production of security and assists key heads in the safe production process. Specific responsibilities are:

(i) Regular meetings of safe production to receive reports from safe production management agencies and other sectors to study the issue of safe production;

(ii) Implementation of the management system for the production of security, operation protocols and security of production responsibilities, and organization of egregious commands, unconstitutional operations and illegal labour disciplines in the course of the operation;

(iii) Regular screening and testing of the occupational health conditions of the facilities, process and operating sites used for service delivery, ensuring that the facilities are well-established, the safety and occupational health conditions of the process are consistent with the relevant provisions and standards;

(iv) Registration of major dangerous sources, organization of concealment or governance of safe production, assistance and collaboration with accident identification sites;

(v) A timely revision of the improved emergency preparedness and regular organization performance.

In accordance with the principle of “one-two-point” and “or who is responsible”, other heads of the productive units will assist the principal and supervisors in the safe production process and assume the corresponding leadership responsibility for the security production within the pipeline.

Chapter V

Article twenty-eighth heads of the productive units are responsible for the consequences of failure to implement the responsibility of the subject matter of safe production.

Article twenty-ninth production units would be required to dedicate specific responsibilities based on the security production system, enter into safe production responsibilities on a case-by-step basis, and organize periodic appraisals for the implementation of the responsibility for safe production.

Article 33 Production operators should include safe production responsibilities in the conduct of performance studies by business managers.

Article 31 provides for the establishment of a robust internal oversight mechanism to fully perform the oversight role of the Board, the shareholders' chambers, the job chairs, and to receive self-respect for the democratic oversight of trade unions and workers.

Annex VI

Article 32 provides otherwise for the responsibility of the subject matter of the production of the units.
