Employment provisions for persons with disabilities in the northern province of Lake

(Conference of 1 February 2010)

Chapter I General

Article 1, in order to promote employment of persons with disabilities, guarantees the labour rights of persons with disabilities, in line with the People's Republic of China Disability Guarantee Act, the Employment Regulations for Persons with Disabilities, the Northern Province of Lake, and other relevant legislation, legislation and regulations.

Article 2

Article 3. Governments of the local population at the district level should incorporate the employment of persons with disabilities into local national economic and social development planning, adhere to a combination of concentrated employment and decentralized employment, and establish preferential policies and specific enabling measures to promote employment of persons with disabilities through multiple channels, multiple forms.

Article IV. Local Governments encourage social organizations and individuals to help, promote employment of persons with disabilities, and encourage the placement of persons with disabilities in excess of the prescribed proportion of units.

Persons with disabilities enjoy the right to equal employment, self-employment and equal access to labour. Discrimination against persons with disabilities in employment is prohibited.

Persons with disabilities should be actively involved in employment training to improve their quality and skills and to enhance their entrepreneurial capacities.

Article 5 Governments at all levels should strengthen integrated planning for the employment of persons with disabilities in the current administration, integrated coordination and create conditions for the employment of persons with disabilities.

The Committee on the Work of Persons with Disabilities at the district level is responsible for organizing, coordinating, mentoring and promoting the employment of persons with disabilities in the relevant sectors.

The human resources and social security, civil affairs, business and tax sectors of the local people's government over the district level are employed by persons with disabilities within their respective responsibilities.

More than the local Disability Federation is responsible for the implementation and supervision of specific organizations working with persons with disabilities.

Article 6 provides recognition and incentives to the local people at all levels for units and individuals that have made significant achievements in the employment of persons with disabilities.

Chapter II

Article 7.

The use of persons with disabilities across administrative regions should be taken into account in the number of persons with disabilities arranged.

Article 8 does not arrange for employment of persons with disabilities or arrange for employment of persons with disabilities to be proportional to the provisions, and shall pay the employment security of persons with disabilities on an annual basis. The employment security scheme for persons with disabilities is calculated according to the annual payment of employment guarantees for persons with disabilities= (the total number of active employees in the previous year's units x 1.5 per cent - the number of workers with disabilities in the previous year) x the average salary of workers in the region.

The employment security of persons with disabilities paid by institutional and financial support groups, business units has been addressed by the agents in the budget of this unit. The employment security of persons with disabilities paid by businesses, civil service non-commercial units, business-administered business units and other economic organizations is covered by management costs.

Article 9. Local Governments and social forces at all levels should concentrate on the employment of persons with disabilities, in accordance with the law, of persons with disabilities' welfare enterprises, blinds, mobile agencies, workers' and other welfare units (hereinafter referred to as the pooling of user units for persons with disabilities).

The qualifications of the user units that concentrate on the use of persons with disabilities are determined to be implemented in accordance with national and provincial provisions.

Article 10. Recruitment of persons with disabilities by a person's unit shall be made in accordance with the law and shall enter into a labour contract or service agreement for social security.

The recruitment of persons with disabilities and the termination or removal of labour relations with persons with disabilities by a person's unit should be made in accordance with the provision of the local public employment services for registration of persons with disabilities. The registration process should be carried out within 30 days of the date of recruitment (exploitation) and the termination or removal of labour relations with persons with disabilities should be processed within 15 days of termination or dismissal of labour relations.

Article 11 does not discriminate against workers with disabilities in terms of promotion, promotion, evaluation, labour compensation, social insurance and welfare.

Persons with disabilities should be given adequate labour conditions and labour protection in accordance with the characteristics of workers with disabilities and be renovated on the basis of actual needs.

Article 12. The user units shall conduct free induction, induction and re-entry training for disabled workers, in accordance with the actual situation of workers with disabilities in this unit.

Article 13. In accordance with the number of active workers in this unit and the number of persons with disabilities in which employment is scheduled to be employed, the number of persons with disabilities under this unit's terms of reference shall be filled in real terms, and after the approval of the local disability employment service institution, the number of persons authorized by the local disability employment service institution shall be based on the amount of the disability guaranteed.

Chapter III Safeguards

Article 14. Local governments at the district level should strengthen the construction of employment assistance systems for persons with disabilities, take loans, social insurance subsidies, job subsidies, etc., and focus on employment of persons with disabilities through public service arrangements.

Article 15. The right of persons with disabilities to gain employment, exceed the prescribed proportion or concentrate on the use of persons with disabilities and persons with disabilities engaged in their personal operations is governed by the law, with the right to benefit from tax incentives in the areas of production, operation, technology, finance, material and site use. Persons with disabilities are exempt from the payment of administrative expenses.

Article 16 Governments and their relevant departments should identify products, projects that are suitable for the production, operation of persons with disabilities, prioritize the production or operation of user units that concentrate on the use of persons with disabilities, and identify certain products from their exclusive production in accordance with the characteristics of the production of user units that concentrate on the use of persons with disabilities.

Under the same conditions, the Government's procurement should give priority to the purchase of products or services produced by a pool of persons with disabilities.

Article 17: The user units that concentrate on the use of persons with disabilities should organize a proportion of the annual tax credits for social insurance and basic cost-of-living payments to persons with disabilities.

Article 18 encourages and promotes the self-employment and ownership of persons with disabilities.

Persons with disabilities may apply for small-guarantee loans, in accordance with national and provincial provisions, for personal operations, partnership operations or the organization of employment other than national restricted industries.

Article 19 Persons with disabilities have been created by individuals and private businesses during the receipt of the unemployment insurance scheme, which may be paid in full by a lump sum for the period covered by the unemployment insurance; and, after their business licence, a one-time entrepreneurship allowance for each person's specified amount may be granted from the special funds for employment.

After the successful entrepreneurship of persons with disabilities who enjoy the minimum living security of the urban population, their monthly income is still less than the prescribed criteria and may be retained in accordance with the provisions for the minimum living security of the urban population.

Article 20 should raise funds at all levels of local people and grass-roots organizations in rural areas, and organize and support rural persons with disabilities in the cultivation, reproduction, handicraft and other forms of production.

Persons with disabilities engaged in various types of agricultural production should be assisted in the areas of production services, technical guidance, supply of agricultural goods, agro-product acquisition and credit.

Article 21, the employment security of persons with disabilities, such as agencies and financial assistance, shall be paid by the employment services of persons with disabilities under the terms of reference, and where conditions exist, may be taken by the financial sector.

In addition to the preceding paragraph, other user units should pay for employment guarantees for persons with disabilities, which are charged by local tax authorities at all levels in accordance with the principle of sub-prime. The collection of employment guarantees for persons with disabilities in the central subsidiaries in the provinces is the responsibility of the provincial local tax authorities.

Article 2

(i) To promote the collective and independent operation of persons with disabilities;

(ii) Subsidies for vocational training and social security for persons with disabilities;

(iii) Subsistance for free employment services for persons with disabilities;

(iv) Support for the organization of a facility (Antenna) for the rehabilitation of persons with disabilities;

(v) To encourage units with a higher proportion of employment of persons with disabilities or to make significant achievements in the organization of employment for persons with disabilities;

(vi) Other expenditures directly for the provision of employment services and employment assistance to persons with disabilities.

Article 23.5 per cent of the total year of employment security for persons with disabilities collected at the district level and in the establishment of provincial pools for persons with disabilities for employment training for persons with disabilities throughout the province, the promotion of employment for persons with disabilities in poor areas and the provision of employment for persons with disabilities with special hardship.

Article 24 Specific approaches to employment security for persons with disabilities, the use and management of the Ministry of Finance are developed in accordance with national provisions.

The financial sector and the audit body should strengthen, in accordance with the law, the monitoring of the use of employment guarantees for persons with disabilities.

Chapter IV Employment services

Article 25 Public employment services established by local people's governments should provide targeted employment assistance services free of charge to persons with disabilities, encourage and promote employment training and vocational skills identification institutions to provide free services for persons with disabilities, and organize regular career skills competitions for persons with disabilities.

In accordance with the law, legislation or by the Government of the People with Disabilities, the Local Disability Federation has commissioned the establishment of employment services for persons with disabilities in the current administration, with the staffing requirements approved by the Committee on the basis of the actual needs of the work, and the provision of funds in the same-level financial budget to guarantee free employment services to persons with disabilities.

Article 27 Employment services at all levels should strengthen employment information networks and related facilities for persons with disabilities, improve the employment information system for persons with disabilities, improve the information dissemination system and improve the quality and level of employment services for persons with disabilities.

Article 28 Employment services for persons with disabilities should be provided free of charge to persons with disabilities:

(i) The publication of employment information on persons with disabilities;

(ii) Organizing vocational training for persons with disabilities;

(iii) Provide services such as vocational psychological counselling, vocational adaptation assessment, vocational rehabilitation training, job orientation and career presentations for persons with disabilities;

(iv) Provide the necessary assistance for the self-determination of persons with disabilities;

(v) Provide the necessary support for the organization of employment for persons with disabilities by human units.

Local governments encourage other employment services to provide free employment services for persons with disabilities.

Article 29 provides for employment registration by persons with disabilities who operate independently or are flexible.

Article 33 is often disabled persons within the statutory age of labour, in terms of labour capacity and employment requirements, in the town where there is no business, and can be registered with unemployment by local disability employment services. In towns without employment experience, persons with disabilities are registered for unemployment at home locations, and other non-indigenous persons with disabilities have stabilized their employment for a period of six months in their habitat.

Article 31, commissioned by the human resources and social security sector, the employment services of persons with disabilities can conduct employment and unemployment registration, employment and unemployment statistics for persons with disabilities, and the employment services of persons with disabilities are accredited by the current human resources and social security sector.

Article 32 encourages social forces to carry out employment services for persons with disabilities under the law and to provide donations and funding for employment services for persons with disabilities.

In the event of labour disputes between disabled workers and agents, local legal aid agencies should provide legal assistance to persons with disabilities in accordance with the law, and the associations of persons with disabilities at all levels should provide assistance.

Chapter V

Article 34, in violation of this provision, provides for penalties under the law, administrative regulations.

Article 35 bis. In violation of this provision, the user unit refused to provide for employment of persons with disabilities in accordance with the provisions, to be corrected by a local disability employment service agency; to reject the correctness and to determine employment of persons with disabilities.

Article XVI does not pay the employment security of persons with disabilities under the provisions of the Convention, which is warned by the financial sector to pay their deadlines; remains unpaid after the expiry of the period, and shall also receive five lags from the date of payment, but the total amount of the lag shall not exceed the amount owed.

Article 37 rejects the obligation to pay, and the organ responsible for levy may apply under the law to the enforcement of the People's Court.

In violation of this provision, a person's unit is not in the process of registration of employment for persons with disabilities on time and is subject to correction by the human resources and social security sector at the district level, with a fine of up to 1000.

In violation of this provision, the employment services of persons with disabilities receive fees for persons with disabilities, which are converted by the Federation of Persons with Disabilities at the district level, to the extent that the fees charged by the law are returned to persons with disabilities and to administratively disposed of by law by the competent and other direct responsibilities directly responsible.

Annex VI

Article 40 provides for employment of persons with disabilities as described in this Article, which refers to persons with disabilities holding the People's Republic of China Disability Procedural, reaching the age of employment, employability and employment requirements for employment.

Article 40 The Northern Province of Lakes, which was released on 28 May 1998 by the Government of the People's Government of the Northern Province of Lake Tan, was also abolished.
