Regulatory of construction work safety in the city of Sichuan

(Act No. 6 of the Decree No. 6 of 19 November 2009 on the People's Government of the Galichuan City, which came into force on 1 January 2010)

Chapter I General

Article 1, in order to strengthen the management of construction work safety production, to prevent and reduce production safety accidents and to guarantee the lives and property security of the people, to develop this approach in line with the State Department's Safety Production Regulations.

Article II activities such as new construction, expansion, alteration, etc. in the current city's administration and the implementation of oversight over the production of construction works must be subject to this approach.

The construction works described in this approach refer to the construction and accompanying lines, pipelines, equipment installation works, construction renovation works, municipal infrastructure works.

Article 3 builds the safe production management of works and should adhere to a safe first, preventive and integrated approach to governance, and introduce a system for the management of safe production that combines management with sub-management, integrated management and professional management.

Article IV Governments and their relevant sectors should encourage the extension of the use of new materials, new processes, new equipment and new technologies to continuously increase the level of construction of energy production technologies.

Any unit and individual have the right to investigate and complain about violations of the provisions of the construction of safe production management.

Chapter II

Article 6. The Government of the city, the city, the district, and the people should strengthen its leadership in the construction of work safety production, support and promote compliance by all relevant departments with the responsibility for safe production management.

Article 7. Safety and productive management implements integrated monitoring management of construction work safety.

The city-building administrative authority oversees the construction of safety in the city's administration.

The construction of administrative authorities in Metropolitan, Yininton and Tunavu is responsible for overseeing the management of the production of engineering security in the Territory and receiving oversight and guidance from the municipal authorities.

The Sichuan Municipal Construction Industry Administration is entrusted by the municipal construction administration to monitor the construction sites in the Hangkoh region, the Quanti region, the Summer area and to implement administrative penalties for violations of the construction safety and production control provisions.

Article 8

(i) Follow-up to national and autonomous areas, laws, regulations, regulations and regulations relating to the construction of safe production of works;

(ii) Guidance for the safe production of buildings throughout the city, regulation of the management of business safety in the construction industry, and supervision of construction safety production and civilization construction;

(iii) To summarize, share and promote the development of advanced technology, processes and management experience for construction;

(iv) Monitoring of the use of construction safety protection and civilization construction measures;

(v) Organizing training for key heads of the construction industry, project heads, and safe production managers;

(vi) To investigate evidence in accordance with the law and to impose administrative penalties for violations of the provisions of the construction of work safety production management;

(vii) Coordinate with the Government accident survey team to investigate security accidents in construction.

Article 9 Trade unions, construction industry associations should cooperate with the monitoring of construction safety production.

Article 10. The construction of administrative authorities shall, when granting construction permits, review the availability of security construction measures for construction works, and shall not be granted a construction permit without security construction measures.

Article 11. The right to take the following measures when establishing a security monitoring inspection by administrative authorities:

(i) To request the inspection units to provide documentation and information on the production of construction work safety;

(ii) Access to inspection on the construction site of the inspectorate;

(iii) Removal of violations of security production requirements in construction;

(iv) Constraints of security accidents found in the inspection, the issuance of time-bound releasing correspondence, the immediate exclusion of a warrant, the inability to guarantee security before the exclusion of a major security accident or the exclusion process, and the evacuation of operational personnel from hazardous areas or the suspension of construction;

(v) To verify changes in the construction site and to decide whether to resume construction;

(vi) The project manager or the construction of the construction unit, the full-time security production manager, the master plan manager of the institution's project, the Engineer of the Professional Architecture, in violation of the provisions of the construction work safety production management, is recorded on-site, in which the enterprise credit management manual is published.

The inspection shall not affect the normal construction activities of the inspectorate.

Article 12. The construction of a safety and production evaluation system is implemented. The construction of administrative authorities shall carry out a safety production evaluation of the entire construction process during construction work.

The scope, procedures, standards, methods, etc. of the evaluation of security production, are defined by the municipal authorities.

Article 13. The construction of administrative authorities should establish a security inspection file for the engineering project, which should include the basic conditions of the construction project, the improvement of the relevant construction process, the inspection records of the works, the security production evaluation information, and the processing of production safety accidents.

Chapter III Security responsibility of the parties in construction

Article 14. Construction, survey, design, construction, construction, engineering and engineering units, as well as other units related to construction of work safety production, must be implemented in accordance with the law, in order to effectively strengthen the management of safe production, to develop regulations for safe production, and to establish a system of safeguards for the safe production of the construction site.

Article 15. The construction units shall be subject to the construction of a security oversight procedure for construction by the administrative authorities and shall submit the following information:

(i) The roster of construction unit engineering managers, including names, age, education, job title, contact;

(ii) The security analysis of construction projects by construction units, including elements such as the construction work environment, engineering features, safety production and security management objectives for civilization construction;

(iii) The requirements and recommendations of the design cell for the construction of work safety;

(iv) Relevant information on the construction site and the various roubles in the neighbouring region and on the adjacent buildings, constructions and underground works;

(v) A security protection of units and payment of civilization construction measures;

(vi) The award of the treasury of the institution;

(vii) The staffing and corresponding qualifications certificates for the professional governor of the engineering project institution;

(viii) Rules for the planning and implementation of the safety of the construction project;

(ix) A security production permit for construction units;

(x) The temporary facility planning programme and the construction of a general photocopy map for the use of a set of activities with a product production permit and the installation of testing receipt records;

(xi) The security production responsibility regime for construction units and the security production assurance system;

(xii) The security protection of the construction unit, the use of plans and guarantees for the cost of civilian construction measures;

(xiii) Head of the construction unit project, full-time security manager staffing and security for the production of prequalification certificates, as well as lists of special equipment operators and operational qualifications for specialized equipment operations;

(xiv) Designation and dedicated construction programmes for construction units;

(xv) The number of construction units entering the construction site using heavy mechanical equipment (taboldens, elevation machines, outdoor ladder);

(xvi) The construction unit and the construction project safe production of emergency relief advances;

(17) Other conditions under the law, regulations.

The cost of security protection, civilization construction measures shall be paid to the construction unit in full after the construction contract is signed by the construction units and the construction units.

During construction work, there were serious security accidents, and construction units should be required to reclassify construction units; the construction of administrative authorities were responsible for relapse and security accidents were not eliminated and the construction units should not be mandatory or implied to continue construction operations.

Article 18 shall establish a engineering project manager at the construction site, with a professional custodian, to organize, in accordance with the characteristics of the work, the rules for the planning and implementation of the institution containing the elements of the security administration.

The security construction measures for construction work are not in line with the mandatory standards of safety or the safety-targeted guidance content, and the PAE may not sign implementation.

Article 19 Laws, regulations stipulate that there is a need for a treasury engineering project, which shall not be subject to the approval of the construction unit at the same time as the master of other projects; the law, regulations do not stipulate that the construction project must be carried out, and the overall engineer of the project shall have the consent of the construction unit when he or she deems it necessary to serve as a master of other projects.

Article 20 shall review nuclear tests for field construction machinery and security facilities. The General Architects should organize engineering treasury personnel, with the heads of construction, construction units project, conduct safety and production inspections for engineering projects and maintain security records.

In the course of the construction of a security evaluation of the works, the construction unit evaluation activities should be carried out.

Article 21, in the course of the implementation of the engineering administration, found that the security accident was hidden and should require that the construction unit be restructured in a timely manner and that construction units should be required to stop the construction and report on the construction units in a timely manner. The construction unit refuses to modify or discontinue construction and should report on time to the construction of administrative authorities.

Article 2 The construction units are established in accordance with the law to establish regulations for the safe production of production, to ensure the input of the funds required for the safety and production conditions of the unit, to conduct regular and dedicated safety inspections of the construction work undertaken and to maintain a security inspection record. Governance, monitoring programmes should be developed for major dangerous sources and security accidents.

The head of the construction unit project is the first responsible for the production of safety for construction projects, which should be held by persons with corresponding qualifications, responsible for the safety of construction projects, the implementation of the security production responsibility regime, the security production regulations and operating protocols, ensuring the effective use of safety protection, the cost of civilian construction measures, and the timely and real reporting of safety accidents.

Article 23 provides for specialized construction programmes involving heavy pits, underground exhumation, high templates, which should organize expert validation and review. Members of the Group of Experts shall be elected in the pool of experts established by the relevant departments.

The construction unit, prior to construction work, should be informed in writing by the construction of administrative authorities of the security production conditions available on the construction site and, in the course of the construction process, on a regular basis, the construction safety and production inspection reports and related tables provide details of the security inspection and accident clearance of the construction work performed.

Article 25. The construction unit shall comply with the relevant provisions of the construction of a security production evaluation and submit information on the safety evaluation of the works to the construction of administrative authorities in a timely manner.

Chapter IV

Prior to the start-up of the construction project, the construction unit should establish a security production leadership team at the Ministry of Engineering, with dedicated (and part-time) security production managers. The construction works are carried out by the Security Production Leadership Team, consisting of the heads of the General Contracting Enterprise, the Professional Contracting Enterprise and the Labour subcontractor project, the technical heads and the dedicated security productive manager.

Article 27 Safety producers, as well as electrical workers, welded workers, heavy drivers, heavy signals, heavy machines for the installation of demolitions and the installation of the basket demolitions, must be documented.

The construction units should organize training for safe production of education for practitioners, such as safety producers and special practitioners, in accordance with the relevant national provisions.

The Director-General of the construction unit shall not act as project chiefs in two and more construction projects, or allow others to implement the safety and production management of engineering projects in their own name.

The project manager shall organize and implement safety construction measures, in accordance with the requirements of the legal regulations and the mandatory standards of work, in accordance with the characteristics of the work, methods of construction, construction and construction procedures, and ensure safety.

Safety construction measures should include measures in such areas as fire prevention, detection, detection, fire prevention, fire protection, firefighting, firefighting, anti-attacking, anti-soiling, defence of objects, anti-mechanical injuries, fire safety accidents, protection of transport accidents, typology, fire prevention, sanitary, environmental pollution.

Article 29 Registration of facilities, such as construction units, for example, heavy machinery, shall be submitted to the following information:

(i) The acquisition, rental, installation and treasury of facilities, such as heavy machinery;

(ii) List of equipment managers and special operating qualification certificates and safe operating protocols;

(iii) Information on the bottom of the safe operation technologies;

(iv) The inspection of qualified reports by the statutory inspection body;

(v) A security management system for facilities such as heavy machines (including the production of safe accident response scenarios);

(vi) Evidence of facilities such as heavy machines;

(vii) Relevant information communicated by the installation units;

(viii) The construction site has a heavy mechanical operating environment with a trajectory and basic map.

Article 33

Article 31 of the construction unit's dedicated security production manager is responsible for security inspections and safe production during the construction day prior to the operation of the construction site, finding that security accidents are hidden and should be reported in a timely manner to project chiefs and security production management authorities; and that the treasury direction, in contravention of the chapter, should be stopped immediately and that the construction of the engineering security officer's oversight day.

Article 32 should comply with the mandatory standards, technical norms and regulations governing the construction of safe civilization and related sanitation, and take effective measures on the construction site to prevent damage and contamination of the construction operation on the ground.

The construction unit should establish the archive of information on the sound construction of the security management of works. The main elements of security management information include:

(i) Safe production assurance system documents, including laws, regulations, standards and norms;

(ii) Servicing of safe production at all levels, regulations for safe production and security operating regulations;

(iii) Safe production finance security systems and safety protection, civilization construction measures and implementation;

(iv) Safety production objective management, including: indicators of death and injury control, safety production achievement, civilization construction objectives;

(v) The construction organization design, security-specific construction programmes and safety technology measures;

(vi) In the context of the safety technology of the engineering, including the overall security of the engineering project, the subsectional security technology;

(vii) The training of business practitioners in safety education, as well as the examination of records, special safety education and evidence-based induction;

(viii) The security accident reporting system and the work-related files;

(ix) Safe inspection of the receipt system, including inspection tests such as heavy machinery, construction machines, footage, construction of temporary electricity;

(x) Regular and daily inspection records, including inspection content, problems, corrective measures, inspection results, security evaluation.

Article 34 of the construction of a security production evaluation at the construction stage was not qualified, and the construction unit should change the issue of construction and security accidents in line with the standards set out in the safety production evaluation.

Article 33 fracture accidents during construction work, the accidental site-related personnel should report immediately to the head of the unit; the head of the unit should report to the city's administrative authorities and the safe production management of the accident within one hour. In the event of emergency, the accidental site-related personnel can report directly to the city's management for the construction of administrative authorities and the safety of productive management.

Chapter V Legal responsibility

Article XVI provides for the construction of a unit in breach of this approach, with one of the following acts, to be converted by a warrant for the construction of an administrative authority, warnings and fines of up to 100,000 dollars:

(i) The construction of the work started without the implementation of security construction measures;

(ii) After having received reports of a major security accident in the institution, the construction unit was not required to relocate;

(iii) After the suspension of construction by a warrant, the major security accidents were not eliminated and forced or implied that construction units continued to operate.

Article 37 violates this approach by one of the following acts, by creating an administrative authority responsible for corrections, warnings, and by paying a fine of up to €50 million for 20000:

(i) The construction site does not establish the engineering project manager;

(ii) Safety construction measures, specialized construction programmes and the restatement of reports signed that do not meet the mandatory standards for construction of work or that are not safely directed;

(iii) There is no provision for the preparation of the rules for the planning and implementation of the rules containing the content of the security prison.

Article 338 violates this approach, with one of the following acts, being redirected by the construction of administrative authorities, warnings and fines of up to 100,000 dollars:

(i) The General Inspectorate Engineer has not been mandated to carry out the project;

(ii) The absence of a provision for a special prison;

(iii) The absence of a review of the construction of machinery and security facilities at the construction site would be the signing of observations;

(iv) No security inspection and rehabilitation of construction units;

(v) No evaluation of the security production of construction units projects was carried out.

In violation of this approach, the construction unit consists of one of the following acts, being modified by a warrant for the construction of administrative authorities, warnings and fines of up to $300,000:

(i) No emergency relief advance for the safe production of this unit and engineering projects;

(ii) No unauthorized construction prior to the commencement of the work of a nuclear test or non-qualified nuclear test, as required;

(iii) The head of the construction unit project will act as project chiefs in two and more construction projects, or allow others to implement the safety and production management of engineering projects in their own name;

(iv) The office, the living area and the operating area are not established in accordance with national and local standards;

(v) In violation of the construction of the safety technology protocols and the safety operation protocols;

(vi) The work requiring expert argument is not validated and reviewed;

(vii) The project does not conduct a safe production evaluation as required;

(viii) No record of construction security production, the absence of a safe production management file, the unmanaged security inspection reports and various security statements.

Article 40 Construction, survey, design, construction, construction, construction and engineering units and other units related to the construction of work security production are not in compliance with the responsibility for safe production, in violation of other acts under this approach, punishable by the construction of administrative authorities and other relevant administrations, within their respective responsibilities, in accordance with the provisions of the relevant laws, regulations and regulations.

Article 40 provides administrative disposal by its units or superior agencies, in cases of serious offences, and criminal liability by law.

Annex VI

The safe production supervision of specialized construction works, such as transport and water, may be implemented in the light of this approach.

Article 43
