Rural Highway construction management approach in Hindu Province

(The 20th ordinary meeting of the People's Government of Honour, dated 24 December 2009, considered the adoption of Decree No. 112 of 23 December 2009, by the People's Government Order No. 112, dated 1 February 2010)

Chapter I General

Article 1, in order to strengthen the construction, conservation and management of rural roads, promote rural economic development and the development of new rural areas of the socialist society, and to develop this approach in line with the relevant laws, regulations, such as the People's Republic of China Highway Act, the Honoural Roads Regulatory Regulations.

Article 2

Article 3 of this approach refers to rural roads, including zones, communes and villages and their bridges, tunnels and crossings.

Districts refer to the main towns and communes within the district-level administrative region (communes), major commodity production and catchment roads, as well as inter-zonal roads that are not part of national spaces and provinces.

The communes refer to the roads in which economic, cultural, administrative services are mainly communes (communes), as well as between communes and communes that are not part of the district's roads and communes.

Villages refer to roads directly for rural production, living services that do not belong to the construction of villages between the communes and the construction of villages and communes (communes).

Article IV. Construction, conservation and management of rural roads should be guided by the principles of integrated planning, divisional responsibility, building and re-establishing and securing access.

Article 5

The provincial Government's transport authorities and their affiliated road management authorities, the city (the State) people's government or regional administrative authorities are responsible for the guidance, supervision and supervision of rural road construction, conservation and management.

Article 6

The specific responsibilities of the commune (communes) government for communes, village construction and conservation are determined by the commune people's Government.

Chapter II Planning

Article 7. Rural road planning should be coordinated with national, provincial development planning and other means of transport development planning, in line with the requirements of national economic and social development planning, land-use master plan, in the context of the actual development of new rural construction and mass production life in the socialist society, in line with national and provincial rural road development goals.

Article 8 Planning is prepared by the provincial-level Government's transport authorities in conjunction with the same sector, with approval by the Government of the current people, by the Government of the city (the State) or by the Regional Administration, and by the provincial Government's transport authorities.

The communes and villages are planned by the commune government transport authorities to assist the communes (communes) in the preparation of the Government of the People's Government, to report on the approval of the district-level people's government and to report on the provincial Government's transport authorities, the municipality of the people's Government or the Regional Agency's transport authorities.

Article 9 Governments' transport authorities at all levels should determine the criteria for building rural roads in accordance with the principle of territorial integrity.

Districts and communes should generally be built in accordance with the standard of the hierarchical roads; villages and works are daunting, complex zones and communes, in accordance with the technical standards of the rural roads in the province.

Article 10

The construction units should properly dispose of abandoned sands, stones, soils for land collation and to prevent the destruction of rural ecological environments.

Article 11 Technical standards are designed for more than four-tier road works, medium- and medium-term bridges, tunnel works, which should be borne by the design units with corresponding qualifications, and the design of less than four-tiered road works and small bridges, which can be assumed by a corresponding qualification technic in the organization of transport authorities at the district level.

Article 12. The procurement of rural road construction projects survey, design, construction, treasury and related important equipment, materials, etc., is consistent with the terms and scale of tendering for national and provincial construction projects.

Article 13. Rural Highway construction projects are responsible for safe production and quality of work. The Government's transport authorities at the district level should strengthen monitoring of the safety and quality of rural roads.

The provincial-level people's transport authorities may hire technical personnel other than rural road construction projects to participate in monitoring the safety and quality of construction in rural roads.

The construction of the rural roads should establish a safety production and quality responsibility brand, indicating the content of the responsible units, responsibilities, and telephone reporting.

Article 14. Rural Highway construction projects should be delivered and completed in accordance with the provisions. The inspection was conducted by a project corporate organization, which was completed by the project design approval unit or by a project corporate organization entrusted to it.

The handover of rural highway construction projects and the completion of the tests can be consolidated. Districts generally receive project tests; communes and villages are united in communes (communes).

Article 15. Rural Highway construction units should be established in accordance with the relevant provisions of the archives management, and the construction of the engineering archives should be transferred in a timely manner to the district-level government transport authorities.

Chapter III Conservation management

Article 16 Rural road conservation should be carried out in accordance with technical norms and operational protocols to guarantee the normal use of the road.

Article 24 The inspection and evaluation results serve as a basis for project arrangements for rural road construction, financial arrangements and the implementation of awards.

Chapter IV Fundraising and management

Article 25

Article 26 The provincial Government, the city (the State) people's Government and the regional executive branch have organized commensurate financial inputs.

Rural Highway management funds are incorporated into the financial budget in accordance with the principle of divisional responsibility.

Rural Highway conservation, renovation and alteration projects are financed by provincial finances, in accordance with the scale and standard arrangements for central transfers, by the provincial Government's transport authorities. The Provincial Government, the municipality of the people's Government, the Regional Administration and the Government of the People's Deputies at the district level have organized commensurate financial resources for the conservation, rehabilitation and alteration of rural roads.

Article 27 provides for the construction and conservation of rural roads by the provincial-level people's transport authorities with exclusive management, specific accounting, and earmarking.

In accordance with their respective responsibilities, sectors such as the Finance, Audit and Monitoring of the People's Government at the district level are responsible for overseeing and inspecting the use of funds for rural road construction, conservation and management.

Chapter V

Article 28, Rural Highway, Highway and Highway subsidiary facilities are protected by law and cannot be destroyed, damaged or illegally occupied.

Any unit and individual have the obligation to protect rural roads, highway sites and highway subsidiary facilities and have the right to investigate and prosecute acts of destruction, damage or unlawful occupation of rural roads, roads, subsidiaries and impact on road safety.

Article 29 of the National Transport Authority and its affiliated Highway Authority are responsible for the management of district and communes and for the implementation of road protection in accordance with relevant laws, regulations and regulations, such as the People's Republic of China Highway Act.

The Villagers' Committee is responsible for the protection of village sites under the guidance of the people's Government. Villagers' councils should include the protection of village trajectory. Article 33 prohibits the following acts in the village:

(i) The illegal construction of cards, fees, fines and interceptive vehicles;

(v) Exclusive transport;

Article 31 states that the Village People's Committee has established facilities to limit the movement of transport vehicles at the village line and shall be conducted under the guidance of the authorities of the National Transport of the District.

Chapter VI Legal responsibility

Article 32 of the road violations took place in the communes, in the communes, and in accordance with the provisions of laws, regulations and regulations such as the People's Republic of China Road Law.

Chapter VII

Article 55 of this approach is implemented effective 1 February 2010.
