Sub-level approval of environmental impact evaluation documents in Southern Province

(It was considered at the 61th ordinary meeting of the Government of the Republic of Southern Province on 21 January 2010 for the adoption of Decree No. 133 of 2 April 2010 on the People's Government of the River Southern Province, which came into force on 15 May 2010)

Article 1 provides for the approval of environmental impact evaluation documents for the construction of projects and enhances the efficiency of clearance, in accordance with the People's Republic of China Environmental Impact Assessment Act, the Regulations on the Environmental Protection of the Construction of Projects and the Environmental Protection Regulations for the Construction of the River Southern Province.

Article 2

In accordance with the relevant provisions, the approval of the project environmental impact evaluation document, which should be approved by the Department of State Environmental Protection Administration.

Article III presents the environmental impact evaluation documents, including environmental impact reports, environmental impact reports and environmental impact registration forms.

Article IV. Environmental impact evaluation documents for construction projects are approved by the executive authorities of the provincial, provincial and district (markets, areas) for environmental protection.

Article 5

(i) The approval or approval of construction projects by the provincial government investment authorities;

(ii) Construction projects across provinces;

(iii) Construction projects that may result in significant environmental impacts, as reflected in the sub-electoral approval of environmental impact evaluation documents for construction projects in Southern Province (see annex).

Article 6

(i) The construction projects approved or approved by the provincial government investment authorities;

(ii) Construction projects in cross-districts (markets, areas);

(iii) Construction projects that may result in a light environmental impact and in part may have a greater impact, as shown in the sub-review of environmental impact evaluation documents in the Southern Province.

Article 7. The environmental impact evaluation documents of the following construction projects are the responsibility of the district-level executive authorities for environmental protection:

(i) The construction projects approved or approved by the district-level government investment authorities;

(ii) Construction projects that may have a small and partial impact on the environment, as shown in the sub-review of environmental impact evaluation documents in the Southern Province.

Article 8. The provincial executive authorities for environmental protection may adjust, in accordance with this provision and national industrial policies, the specific elements of the Environmental Impact Assessment Paper of the Southern Province.

Article 9. The provincial, provincial and municipal environmental protection administrative authorities may entrust their parts of the project's environmental impact evaluation documents to the environmental protection administrative authorities at the next level of the project location.

The executive authorities of the provincial and provincial authorities for the protection of the environment should monitor the actions of the executive authorities of the environmental protection at the lower level in accordance with the authorization of environmental impact evaluation documents and assume legal responsibility for the consequences of the act.

Article 10. Construction projects may have adverse environmental impacts in other administrative regions, and the environmental impact evaluation findings of the relevant executive authorities in relation to environmental protection are disputed, and their environmental impact evaluation documents are approved by the executive authorities of environmental protection, jointly by the parties.

Article 11. The environmental impact evaluation of cross-sector, re-engineering projects is determined by the highest level of the terms of reference for approval.

Article 12 Environmental protection administrative authorities are not charged with any cost.

Any unit or person may not designate environmental impact evaluation units in any form for the construction unit.

Article 13 Construction of project environmental impact evaluation documents should be available to the executive authorities for environmental protection at the highest level. Approval of the environmental impact evaluation document that goes beyond the statutory mandate and violates the statutory procedures may be withdrawn by the executive authorities of the superior environmental protection authority or responsibly revoked by the executive authorities of the environmental protection, in the case of a serious basis for the provisional provisions on the disposition of unconstitutional environmental protection.

Article 14. The sub-prime approval of the environmental impact evaluation for the construction of the project in Southern Province, published on 1 March 2005, was repealed at the same time.
