Decision of the Government of the People of Blue Heavy Province to amend the Science and Technology Awards of the Blue Heavy Province

(Summit No. 55 of 2 April 2010 of the Government of the People of Blue Sea considered the adoption of the Decree No. 74 of 13 April 2010 on the date of publication) of the People's Government Order No. 74 of 13 April 2010

In order to promote scientific and technological progress and to promote economic and social development, in accordance with the provisions of the National Science and Technology Approval Regulations, the Government of the province has decided to amend the Science and Technology Awards of the Blue Sea as follows:

I amend article 1 as follows: “In order to encourage individuals and organizations that have contributed prominently in scientific and technological progress activities in this province, to promote scientific and technological progress and innovation, to promote economic and social development, to develop this approach in the light of the National Science and Technology Approval Regulations.”

Article 3, paragraph 1, was amended to read: “The Government of the Provincial People established the Provincial Committee on Science and Technology Awards, which is responsible for the evaluation of the provincial science and technology awards, and the provincial science and technology administration authorities are specifically responsible for the day-to-day work of the provincial science and technology awards evaluation”.

Paragraph 2 was amended to read: “The Provincial Committee on Science and Technology Accreditation consists of permanent members and professional members, consisting of the relevant functional departments of the provincial government, approved by the provincial scientific and technical administration authorities; and the professional commission consists of experts, approved by the provincial scientific and technical administration authorities”.

iii. Amendments to article IV as “the provincial science and technology incentives to respect knowledge, respect talents, promote scientific and technological progress and innovation, and promote the transformation of science and technology outcomes, and uphold the principles of scientific democracy and open equity”.

Article 5, paragraph 1, was amended to read: “The evaluation of the provincial science and technology awards is carried out with an indicative and circumventive system and is subject to social oversight”. Delete paragraph 2.

V. Amendments to Article 8 as follows:

(i) Create significant economic benefits or social benefits in science and technology innovation, scientific and technological transformation and industrialization in the province;

(ii) A major breakthrough on science and technology, which has made a prominent contribution to science and technology development, recognized by national and external peers.”

Article 11, paragraph 1, was amended to read as follows: “The major scientific and technological contributions awards, science and technology international cooperation awards are not ranked, the science and technology advancement awards are awarded, the two awards, and three awards.

Paragraph 2 was amended to read: “The incentives for the provincial science and technology awards amounted to 500,000 dollars; the Science and Technology Progress Award: 1 = US$ 10 million each award and US$ 2 million each such award; and the award of honorary awards for scientific and technical cooperation awards”.

Article 12 was amended to read: “The provincial science and technology awards are evaluated every year. One of the major scientific and technological contributions awards (the number of awards is generally one) may also be vacant; the science and technology advancement prize does not exceed 30, one of which exceeds five awards, no more than 10 awards, or no more than 15 awards; and science and technology international cooperation awards do not exceed 2 posts).

Article 13, paragraph 1, adds one to subparagraph (iv) as follows: “The Provincial Army, the Provincial Police Force, the Blue Forces”.

Article 15, subparagraph (i), was amended to read Article 15: “The unit recommended for provincial science and technology awards should complete the proposal for a unified format, provide authentic and reliable inputs, and report to the provincial scientific and technical administration according to the prescribed time”.

Amend the remaining article 15 as article 16 to read: “The evaluation of the provincial science and technology awards is conducted in accordance with the following procedures:

(i) The provincial science and technology administration authorities are responsible for the review of declarations, recommendations and the submission of qualified declarations, recommended materials to the Provincial Committee on Science and Technology Awards;

(ii) The provincial science and technology incentive committees organize the online early evaluation of relevant experts within and outside the province;

(iii) A review of the professional evaluation team, composed of relevant industry experts within and outside the province, based on an online evaluation opinion, and offer incentives;

(iv) The Provincial Committee on Science and Technology Awards conducts an integrated evaluation based on incentives from the professional evaluation team and validated the results of the integrated evaluation;

(v) The provincial science and technology administrative authorities have presented the results to the society through provincial media, which is 30 days. During the public statements, any unit and individual may object. The objections made by provincial science and technology administrative authorities should be answered within 10 days. At the end of the demonstration, the provincial science and technology administrative authorities reported to the Provincial Committee on Science and Technology Awards.

Article 16, paragraph (vi), was amended to read: “The Provincial Committee on Science and Technology Awards offer incentives projects, levels, numbers of opinions submitted to the Government of the Provincial People's Government for approval”.

Article 20 was amended to read as “in expert and relevant staff participating in the provincial science and technology awards evaluation activities, in the course of the evaluation exercise, for example, for misrepresentation, forcible fraud and other violations of evaluation provisions, and for experts to be removed from their evaluation qualifications by the provincial science and technology administrative authorities; and for the staff concerned, by law.”

Adjustments and modifications were made to the order and individual languages of the provisions.

This decision is implemented since the date of publication.

The Scientific and Technical Awards of the Blue Heavy Province were re-published in accordance with the consequential changes in the present decision.

Annex: Science and technology incentives in Blue Heavy Province (as amended)

(Act No. 36 of the People's Government Order No. 36 of 3 December 2003, as amended by the Decision of the Government of the Blue Sea of 13 April 2010 on the revision of the science and technology incentives scheme in the Blue Sea province)

Chapter I General

Article 1, in order to encourage individuals and organizations that have made a prominent contribution in scientific and technological progress in the province, to promote scientific and technological progress and innovation, to promote economic and social development, and to develop this approach in the light of the National Science and Technology Awards.

Article 2. The Government of the Provincial People's Government has established provincial science and technology awards (hereinafter referred to as provincial science and technology awards) and is rewarded in accordance with this approach.

The Government of the State (local, municipal) can set up scientific and technological awards in accordance with local scientific and technological advances and economic and social development. Specific approaches have been developed by the Government of the State (local, municipal) to report back to the provincial Government's scientific and technical administration authorities.

The Ministry of the People's Government has no longer established government science and technology awards.

Article 3. The Government of the Provincial People's Government has established provincial science and technology incentives committees responsible for the evaluation of the provincial science and technology awards, and the provincial science and technology executive authorities are specifically responsible for the day-to-day work of the provincial science and technology awards evaluation.

The Provincial Committee on Science and Technology Grants consists of permanent members and professional members, consisting of the relevant functions of the provincial government, approved by the provincial scientific and technical administrative authorities, and approved by the relevant experts by the provincial scientific and technical administration authorities.

Article IV

Article 5 Evaluations of the provincial science and technology awards are carried out by means of an indicative and evading system and are subject to social oversight.

Article 6. The provincial science and technology awards are earmarked in the Government of the province's incentive fund and the provision for evaluation is included in the sectoral budget.

Chapter II

Article 7.

(i) Major scientific and technological contributions awards;

(ii) Science and technology progress awards;

(iii) Prize for international cooperation in science and technology.

Article 8

(i) Create significant economic benefits or social benefits in science and technology innovation, scientific and technological transformation and industrialization in the province;

(ii) A major breakthrough on science and technology fronts and a strong contribution to science and technology development was recognized by national and external peers.

Article 9. The Science and Technology Progress Prize awards to the following individuals and organizations:

(i) Major scientific and technological innovations in research development, such as new products, new processes, new materials, biomass and new varieties, to promote the transformation of scientific and technological outcomes and to create significant economic benefits or social benefits;

(ii) To introduce, absorb and re-transfer new technologies, to promote, apply scientific and technological outcomes, make a significant contribution to achieving significant economic benefits or social benefits;

(iii) Implementation of major engineering projects, with significant innovation in key technology and system management, to achieve significant economic benefits, social benefits and ecological benefits;

(iv) Achieve significant results in the work on basic science and technology and socio-public science and technology such as Coopte and create tangible social benefits.

Article 10 International Cooperation Prize awards to foreigners or foreign organizations that have made a prominent contribution to the scientific and technological cause of my province:

(i) In cooperation with young Chinese citizens or organizations to study, develop and achieve significant scientific and technological outcomes;

(ii) The transfer of advanced technologies to young Chinese citizens or organizations to develop the effectiveness of the talent;

(iii) Promote the exchange and cooperation of my province with foreign science and technology and make important contributions.

Article 11. Major scientific and technological contributions awards, science and technology international cooperation awards are not ranked, and science and technology progress awards are awarded at all levels.

The incentives for the provincial science and technology awards amounted to $500,000 for major scientific and technological contributions; the Science and Technology Progress Award: 1 ten million yen awards, 25,000 yen for each of these awards, and 2 million dollars for science and technology international cooperation awards.

Chapter III Evaluation and award of provincial science and technology awards

The provincial science and technology awards are evaluated every year. One of the major scientific and technological contributions awards (the number of awards is generally one) may also be vacant; the science and technology advancement prize does not exceed 30, one of which exceeds five awards, no more than 10 awards, or no more than 15 awards; and science and technology international cooperation awards do not exceed 2 posts.

Article 13 Candidates for provincial science and technology awards are recommended by the following units:

(i) Government of the State (land, city);

(ii) The Government's work sector;

(iii) Central presence units;

(iv) The provincial military area, the provincial military unit, the Blue Forces;

(v) Enterprise units and social groups in the province.

Article 14. Provincial science and technology administration authorities shall, by 90 days of evaluation, evaluate declarations, recommend time, modalities, etc. through the media to the Social Proclamation Provincial Science and Technology Awards, and establish advisory telephones to provide advisory services to all sectors of society.

Article 15 recommended that units of the provincial science and technology awards should complete proposals in the harmonized format, provide authentic and reliable inputs and report to the provincial science and technology administrative authorities on time.

Article 16

(i) The provincial science and technology administration authorities are responsible for the review of declarations, recommendations and the submission of qualified declarations, recommended materials to the Provincial Committee on Science and Technology Awards;

(ii) The provincial science and technology incentive committees organize the online early evaluation of relevant experts within and outside the province;

(iii) A review of the professional evaluation team, composed of relevant industry experts within and outside the province, based on an online evaluation opinion, and offer incentives;

(iv) The Provincial Committee on Science and Technology Awards conducts an integrated evaluation based on incentives from the professional evaluation team and validated the results of the integrated evaluation;

Article 17 awards for major scientific and technological advances and awards for honorary awards and awards by the Government of the Provincial People; the International Prize for Science and Technology International Cooperation was awarded by the Government of the Provincial People.

Chapter IV Legal responsibility

Article 18 deducts, inventses the discovery, invention or other scientific results of others, or uses other unjustifiable means of decepting provincial science and technology awards, with the approval of the provincial government of the Ministry of Science and Technology.

Article 19 recommended units provide false data, materials and evidence to assist others in decepting provincial science and technology awards, which are criticized by the provincial scientific and technical administrative authorities; in the event of serious circumstances, the suspension or distribution of their recommended qualifications; and the disposition of persons responsible for direct responsibility and other persons directly responsible.

Article 20 experts and relevant staff involved in the provincial science and technology awards evaluation exercise, in the evaluation exercise, misrepresentation, infrastructural fraud and other violations of the evaluation provisions, the expert was dismissed by the provincial science and technology administrative authorities; and the staff concerned were disposed of by law by the unit.

Chapter V

Article 21

Article 2 encourages social forces to establish scientific and technical awards for society, with specific reference to the establishment of a science and technology incentives management approach by the Social Forces.

Article 23 recommended the declaration of national science and technology awards, in accordance with the provisions of the National Science and Technology Approval Regulations.

Article 24 The science and technology incentives adopted at the 21st ordinary meeting of the Government of the province in April 2001 were also repealed.
